PILATES IN THE CLUB – WAIVER & RELEASE OF LIABILITY
(Sounders Dallas | May 30, 2026)

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration of being permitted to attend and participate in Pilates In the Club (the “Event”) on Saturday, May 30, 2026 at Sounders Dallas, located at 1211 E Levee St, Dallas, TX 75207. Doors open at 2:00 PM. The first class begins at 3:00 PM and the second class begins at 4:00 PM.

By purchasing a ticket, registering, or entering the Event premises, Participant acknowledges and agrees as follows:
	1.	Assumption of Risk

Participant understands that Pilates, fitness classes, and physical activity involve inherent risks including, but not limited to, muscle strains, tears, fractures, sprains, fainting, dehydration, dizziness, heart complications, aggravation of pre-existing conditions, permanent disability, or death.

Participant voluntarily and knowingly assumes all risks, known and unknown, associated with participation in the Event, including risks arising from the negligence of the Organizer, Venue, instructors, DJs, videographers, photographers, sponsors, contractors, employees, volunteers, and affiliates.

Participant affirms that they are physically fit to participate and have not been advised otherwise by a medical professional.
	2.	Nightclub Environment Risks

Participant acknowledges that the Event takes place in a nightclub setting which may include loud amplified music, flashing or strobe lighting, lasers, fog, atmospheric effects, dim lighting, uneven flooring, crowd movement, and limited visibility.

Participant voluntarily assumes all risks associated with these conditions.
	3.	Alcohol, Substance Use & Personal Conduct

Alcohol may be served to individuals 21 years or older with valid identification.

Participant understands that alcohol consumption increases risk of injury and impaired judgment.

Participant assumes full responsibility for any consequences arising from alcohol or substance use, whether legal or illegal.

Pilates In the Club, Sounders Dallas, sponsors, and affiliates are not responsible for any injury, damage, loss, arrest, citation, or other legal matter related to Participant’s intoxication or substance use.
	4.	Vendors, Giveaways & Third-Party Services

Participant understands that giveaways or brand partnerships may be present.

Participant voluntarily assumes all risks related to consumption or use of any product, supplement, or item provided.

Organizer and Venue are not liable for allergic reactions, adverse reactions, injuries, or damages resulting from any third-party products.
	5.	Media, Photography & Videography

Participant understands that professional photography, videography, and media capture will occur during the Event.

Participant grants full, irrevocable permission for Pilates In the Club, Sounders Dallas, sponsors, media teams, and affiliates to use Participant’s image, likeness, and voice for promotional, commercial, and marketing purposes without compensation.

Participant waives any right to inspect or approve such media and releases all claims related to its use.

Participant also acknowledges that other attendees may independently record content and Organizer has no control over third-party postings.
	6.	No Refund Policy

All ticket sales are final.

There are no refunds, transfers, credits, or exchanges for any reason, including but not limited to lateness, missed classes, illness, scheduling conflicts, or inability to participate.

By purchasing a ticket, Participant expressly waives any right to dispute or charge back payment.
	7.	Release of Liability

Participant releases, waives, discharges, and holds harmless Pilates In the Club, Sounders Dallas, instructors, DJs, videographers, photographers, sponsors, contractors, employees, volunteers, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising out of or related to participation in the Event.

This includes claims for personal injury, property damage, emotional distress, or wrongful death.
	8.	Indemnification

Participant agrees to indemnify and defend the Organizer, Venue, and all affiliated parties against any claims, lawsuits, damages, attorney’s fees, or liabilities arising from Participant’s conduct or actions during the Event.
	9.	Communicable Diseases

Participant acknowledges the risk of exposure to communicable diseases and voluntarily assumes all such risks.
	10.	Governing Law

This Agreement shall be governed by the laws of the State of Texas. Any dispute shall be resolved in the appropriate courts located in Texas.
	11.	Severability

If any portion of this Agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment

Participant acknowledges that they have read this Agreement carefully, understand its contents, and voluntarily agree to its terms. Participant understands that this is a legally binding release of liability.
