PILATES IN THE CLUB – WAIVER AND RELEASE OF LIABILITY
(March 6, 2026 – Temple Nightclub, Denver CO)

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration of being permitted to attend and participate in Pilates In The Club on Friday, March 6, 2026, hosted at Temple Nightclub, 1136 Broadway, Denver, CO 80203. By purchasing a ticket, registering, or entering the premises, the Participant agrees to all terms below:

1. Assumption of Risk

• I acknowledge that Pilates, fitness classes, and related movement activities involve physical exertion and inherent risks, including but not limited to strains, sprains, fractures, fainting, dehydration, dizziness, heart issues, or other injuries.
• I voluntarily assume all risks associated with participation and understand that Pilates In The Club, Temple Nightclub, instructors, DJs, employees, contractors, vendors, and affiliates are not responsible for any injury, illness, or condition that may occur.

2. Venue, Environment & Drones

• I understand this event takes place inside a nightclub environment with loud music, flashing or strobe lighting, fog or atmospheric effects, elevated sound levels, and limited visibility.
• I acknowledge drones or handheld filming equipment may be used for professional recording and content creation. I understand there is minimal risk of contact and agree Pilates In The Club, Temple Nightclub, drone operators, and affiliates are not liable for any injury or inconvenience related to filming equipment.
• I understand other attendees may independently take photos or videos outside of Pilates In The Club’s control.

3. Photography, Videography & Publicity Release

• I grant full permission to Pilates In The Club, Temple Nightclub, and affiliates to record, photograph, or capture video/audio (including drone footage) during the event.
• I authorize the use of my likeness for promotional, commercial, and marketing purposes without compensation.
• I waive any right to review or approve final media and release all claims related to its use.

4. Age, Alcohol & Personal Responsibility

• This is a 21+ event only and valid identification is required for entry.
• Alcohol may be served and consumed at the venue. If I choose to drink, I assume full responsibility for my actions and resulting consequences.
• Pilates In The Club, Temple Nightclub, and affiliates are not responsible for incidents, injuries, or legal issues related to alcohol consumption.

5. Attendance, Punctuality & Refund Policy

• I understand it is my responsibility to arrive early to allow time for parking and check-in.
• If I arrive late, miss my class, or fail to bring a mat, I forfeit my ticket.
• All sales are final. No refunds, transfers, or credits will be issued for any reason, including late arrivals, dissatisfaction, illness, scheduling conflicts, or weather.

6. Equipment & Sanitation

• I agree to bring my own exercise mat; mats are not provided.
• Shoes may not be permitted on the main floor for safety and sanitation reasons.
• I acknowledge the venue is cleaned but cannot be guaranteed allergen-free or germ-free.

7. Vendors, Food & Beverage

• Vendors may be present. Any food, beverage, or service I consume or engage with is at my own discretion and risk.
• Pilates In The Club and Temple Nightclub are not liable for allergic reactions, illness, product use, or adverse effects.

8. Parking & Transportation

• Parking options are independent of the event and used at my own risk.
• Pilates In The Club and Temple Nightclub are not responsible for theft, towing, break-ins, or damage to personal property.
• If I consume alcohol, I agree to arrange safe transportation.

9. Drones, Lighting & Media Notice

• Filming and lighting effects may take place above, around, or near participants.
• I agree to stay aware of surroundings and exercise caution.
• I release Pilates In The Club, Temple Nightclub, and media affiliates from any claims related to media production.

10. Communicable Diseases

• I acknowledge the potential risk of exposure to COVID-19 and other communicable illnesses.
• I release Pilates In The Club, Temple Nightclub, and affiliates from claims related to illness resulting from attendance.

11. Release of Liability & Indemnification

• I release, waive, and discharge Pilates In The Club, Temple Nightclub, instructors, DJs, employees, vendors, contractors, and affiliates from all claims arising from participation, including negligence.
• I agree to indemnify and hold harmless all listed parties from any third-party claims caused by my actions.

12. Acknowledgment of Understanding

• I have read and understand this Waiver and Release of Liability.
• I acknowledge this Agreement is legally binding and protects Pilates In The Club and all affiliated parties.
• By purchasing a ticket and attending the Event on March 6, 2026, I voluntarily agree to all terms and accept full responsibility for participation.
