Special Guest Instructor: Ivonne Guerra will be leading the flow with high-intensity movement and pure Reggaeton energy.

PILATES IN THE CLUB – WAIVER & RELEASE OF LIABILITY

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration of being permitted to attend and participate in Pilates in the Club events (the “Event”) hosted at Afër (2701 Fannin St, Houston, TX 77002). By purchasing a ticket, registering, or entering the premises, the Participant agrees to the following:

1. Assumption of Risk

I acknowledge that participation in Pilates, fitness classes, and related activities involves strenuous physical movement and carries inherent risks, including but not limited to: muscle strains, sprains, fractures, fainting, dehydration, abnormal blood pressure, heart disorders, dizziness, and other injuries.

I understand and accept all risks associated with participation and acknowledge that Pilates in the Club, Afër, instructors, DJs, vendors, contractors, and affiliates are not responsible for any injury or medical condition that may occur.

2. Venue, Environment & Drones

I understand that the Event will take place in a nightclub setting with flashing or strobe lights, loud amplified music, fog or atmospheric effects, and limited visibility.

I acknowledge that drones may be operated during the Event for videography/photography purposes. I understand drones carry a small risk of accidental contact, and I agree that if I am struck, injured, or inconvenienced in any way by a drone, Pilates in the Club, Afër, operators, and affiliates are not liable.

I understand that attendees may also be taking photos and videos independently. Pilates in the Club has no control over such recordings and is not responsible for their use or distribution.

3. Photography, Videography & Publicity Release

I grant permission to Pilates in the Club, Afër, and their affiliates to record, photograph, and capture video/audio footage (including drone footage) during the Event and to use my likeness in promotional, commercial, and marketing materials, without compensation.

I waive any right to inspect or approve final materials and release all claims related to their use in any medium.

4. Age, Alcohol & Personal Responsibility

This is an 18+ event. Valid government-issued photo ID is required for entry.

Alcohol will be served only to those 21+ with valid ID. By consuming alcohol, I accept full personal responsibility for my actions, behavior, and any resulting consequences.

Pilates in the Club, Afër, and affiliates are not responsible for incidents, injuries, accidents, or legal issues arising from alcohol consumption.

5. Attendance, Punctuality & Refund Policy

I understand it is my responsibility to arrive early to allow time for parking and check-in. If I arrive late, cannot find parking, or otherwise miss my scheduled class, I forfeit my ticket.

All sales are final. There are absolutely no refunds, transfers, or credits for any reason, including but not limited to: late arrivals, missed classes, personal scheduling conflicts, failure to bring a mat, dissatisfaction, illness, or weather-related cancellations.

6. Equipment & Sanitation

I agree to bring my own exercise mat, as mats are not provided.

I acknowledge that shoes are not permitted on the main floor for sanitary purposes.

I understand that the venue is cleaned before each event, but the organizers cannot guarantee an allergen- or germ-free environment.

7. Food, Beverage & Vendors

Food and beverage vendors may be present at the Event. I consume any food or beverage, whether alcoholic or non-alcoholic, at my own risk.

Pilates in the Club and Afër are not responsible for allergic reactions, illness, foodborne illness, or other adverse effects from consumption.

8. Parking & Transportation

Parking is available via street parking (at my own discretion and risk) or valet for $10. Pilates in the Club and Afër are not responsible for theft, damage, towing, or incidents involving my vehicle.

If I consume alcohol, I am solely responsible for arranging safe transportation.

9. COVID-19 & Communicable Diseases

I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk of exposure by attending the Event.

I release Pilates in the Club, Afër, and affiliates from any claims related to illness, infection, or complications arising from attendance.

10. Release of Liability & Indemnification

I release, waive, and discharge Pilates in the Club, Afër, instructors, DJs, vendors, contractors, employees, affiliates, insurers, and representatives from any and all claims, demands, actions, or causes of action arising out of or related to my participation, whether caused by negligence or otherwise.

I agree to indemnify and hold harmless Pilates in the Club, Afër, and all affiliates from any third-party claims or damages resulting from my conduct during the Event.

11. Acknowledgement of Understanding

I have carefully read and fully understand this Waiver and Release of Liability.

I acknowledge that this Agreement is legally binding and intended to protect Pilates in the Club, Afër, and affiliates in every aspect of the Event.

By purchasing a ticket and attending, I voluntarily agree to all terms and conditions herein.

By attending, I confirm that I have read, understood, and agreed to this Waiver & Release of Liability, including the zero-refund policy, assumption of risk, and personal responsibility for my participation.
