Rose Girl Social – Running & Walking Club Waiver and Release of Liability
IMPORTANT NOTICE

Please read this agreement carefully before participating. By participating, you waive certain legal rights.

This event is 18 years of age or older. No minors are permitted.

This agreement is governed by the laws of the State of Florida, and any disputes must be brought in Orange County, Florida.

1. Activities Covered

This waiver applies to participation in Rose Girl Social Running & Walking Club activities, including but not limited to:

Group running and jogging at varying paces

Group walking and walk-run intervals

Warm-ups, cool-downs, and light stretching

Social meetups before and after movement

Activities may take place in public parks, sidewalks, trails, and shared outdoor spaces.

2. Assumption of Risk

I understand that participation in running and walking activities involves inherent risks, including but not limited to:

Slips, trips, and falls

Muscle strains, sprains, joint injuries, shin splints, or overuse injuries

Collisions with other participants, pedestrians, cyclists, or vehicles

Uneven surfaces, curbs, pavement, trails, or road conditions

Exposure to weather conditions (heat, sun, humidity, rain, wind)

Dehydration, fatigue, dizziness, or overexertion

Exposure to communicable illnesses

I voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation, including those arising from the ordinary negligence of the Released Parties (defined below).

3. Health & Personal Responsibility Acknowledgment

I certify that:

I am 18 years of age or older

I am physically and mentally capable of participating in running or walking activities

I have no medical condition that would make participation unsafe

I understand it is my responsibility to monitor my own pace, hydration, and physical limits

I acknowledge that Rose Girl Social does not provide medical advice, screening, or supervision, and that participation is entirely voluntary.

4. Waiver & Release of Liability

In consideration of being permitted to participate, I, on behalf of myself and my heirs, executors, administrators, and assigns, hereby waive, release, and forever discharge:

Rose Girl Social, its organizers, hosts, volunteers, instructors, ambassadors, partners, sponsors, venue owners, and affiliates
(collectively, the “Released Parties”)

from any and all claims, demands, damages, injuries, losses, or causes of action arising out of or related to my participation or presence at the event, including claims resulting from ordinary negligence.

This release does not apply to gross negligence or intentional misconduct, which cannot be waived under Florida law.

5. Public Space & Environmental Disclaimer

I acknowledge that running and walking activities occur in public and shared spaces not controlled by Rose Girl Social. I accept full responsibility for risks related to:

Other park users or vehicles

Wildlife or insects

Surface conditions or obstacles

Limited supervision or crowd control

6. Emergency Medical Consent

In the event of an emergency, I authorize Rose Girl Social representatives to seek emergency medical care or transportation on my behalf if deemed necessary. I understand that I am solely responsible for any medical costs incurred.

7. Photo & Media Release

I grant Rose Girl Social the irrevocable right to photograph, film, or record my image, likeness, and voice during the event and to use such content for promotional, marketing, and social media purposes without compensation or approval rights.

8. Governing Law & Venue

This agreement is governed by the laws of the State of Florida. Any dispute arising from this agreement or participation must be resolved exclusively in the state or federal courts located in Orange County, Florida.

9. Severability

If any provision of this waiver is found unenforceable, the remaining provisions shall remain in full force and effect.

10. Acknowledgment & Acceptance

By registering for or participating in this running club, I acknowledge that:

I have read and understood this waiver in its entirety

I voluntarily agree to its terms

I understand that I am waiving substantial legal rights, including the right to sue

Participant Acknowledgment

Participation in this event constitutes acceptance of this waiver.
