IMPORTANT NOTICE

Read this agreement carefully before signing. By signing, you waive certain legal rights.

Participants must be 18+ years old. No minors are allowed.
●
This agreement is governed by Florida law, and any disputes must be brought in
Orange County, Florida.
1. Assumption of Risk
The participant understands that the Damn Booty Social event includes a range of wellness,
fitness, recovery and social activities, which may include, but are not limited to:
●
Glute‑focused group fitness classes such as HIIT, Pilates, dance/Zumba, strength
training, mobility work, stretching, bodyweight exercises and functional training.
●
Cold‑plunge sessions involving exposure to freezing water.
●
IV drips and B12 injections administered by licensed medical staff.
●
Recovery services (massage, stretching, compression therapy, percussive therapy,
red/infrared light therapy, etc.).
●
Vendor village participation with wellness, beauty, food, beverage and lifestyle products,
as well as curated music sets, brand activations, giveaways and swag.
●
Consumption of food, drinks and supplements provided by third‑party vendors, including
coffee/tea and other beverages.
The participant acknowledges that these activities involve inherent risks (known and unknown),
including but not limited to:
●
Physical injuries (muscle strain, burns, broken bones, cardiac events, nerve damage,
skin sensitivity), illness or allergic reactions.
●
Exposure to communicable diseases (e.g., COVID‑19).
●
Adverse reactions to cold immersion, heat exposure, IV therapies, injections or
supplements.
●
Slips, falls or collisions with people or equipment.
●
Foodborne illness or allergic reactions arising from vendor‑provided food or drink.
●
Property damage or economic loss.
●
Serious injury, permanent disability or death.
The participant voluntarily assumes all risks associated with the event, known or unknown,
inherent or caused by the ordinary negligence of the Released Parties (defined below).
Participants understand that even if all safety rules are followed, accidents and injuries can still
happen.
2. Health & Medical Certification
By signing, the participant warrants that they are at least 18 years of age, are physically and
mentally fit, and have no medical, psychological or other condition (including pregnancy) that
would prevent safe participation. Participants accept full responsibility for consulting with a
physician regarding their participation and agree to comply with all posted and verbal
instructions. The event organizer does not screen participants for medical fitness; participants
must make their own determination.
Participants acknowledge that IV drips, injections and other treatments are provided by
independent, licensed vendors. They have had an opportunity to ask questions, understand
the risks, and voluntarily choose to participate.
3. Waiver & Release of Liability
In consideration of being allowed to participate, the participant, on behalf of themselves and
their heirs, executors, administrators, successors and assigns, waives, releases and forever
discharges Damn Booty Brand, LLC d/b/a Damn Booty Social, its owners, officers, directors,
members, employees, contractors, instructors, volunteers, vendors, sponsors, the venue, and all
associated entities and individuals (“Released Parties”) from any and all claims, demands,
damages, actions or causes of action of any kind, including attorneys’ fees and costs
(collectively,
“Claims”), arising out of or related to participation in or attendance at the event.
This release expressly includes Claims arising from the ordinary negligence of any
Released Party, but does not extend to Claims based on gross negligence, intentional
misconduct or recklessness, which Florida law does not allow to be waived.
4. Indemnification
The participant agrees to defend, indemnify and hold harmless the Released Parties from
any Claims brought by third parties arising out of the participant’s conduct, including injuries or
property damage caused by the participant and all related legal costs.
5. Food, Beverage & Vendor Participation
Independent vendors will provide food, beverages, products and services. These vendors
operate separately from the event organizer. Participants consume all food, beverages and
supplements at their own risk and are solely responsible for checking ingredients and allergens.
Participants release the Released Parties from liability related to foodborne illness, allergic
reactions or dissatisfaction with vendor products. Participants also acknowledge that treatments
such as IV drips, injections, massage and red‑light therapy are administered by independent
professionals; the event organizer does not supervise, endorse, warrant or assume
responsibility for any third‑party service.
6. Alcohol & Substance Disclaimer
Damn Booty Social is intended as a sober, wellness‑focused event. The event organizer will not
serve alcohol. If any vendor chooses to serve alcoholic beverages or regulated substances,
participants consume them at their own risk and release the Released Parties from liability for
any related injury or damages. Participants must be at least 21 years old to consume alcohol
when available.
7. Emergency Medical Consent
The participant authorizes the event organizer and its representatives to obtain emergency
medical care and transportation on the participant’s behalf. The participant understands they are
responsible for any resulting medical costs and releases the Released Parties from liability
associated with emergency medical care.
8. Photo & Media Release
The participant grants the event organizer and its partners the irrevocable right to photograph,
film, record and otherwise capture the participant’s image, voice and statements during the
event and to use such media, worldwide and in perpetuity, for any lawful purpose (publicity,
advertising, social media, promotional material, etc.) without compensation. The participant
waives any right to inspect or approve such media.
9. Governing Law, Venue & Dispute Resolution
This agreement is governed by Florida law. Any dispute arising from this agreement or from
participation in the event must be litigated in state or federal courts located in Orange County,
Florida. Participants waive the right to a jury trial and agree to bring claims only on an individual
basis (no class or collective actions). Choice‑of‑law and venue provisions offer an extra layer of
protection and deterrence.
10. Severability & Binding Effect
If any provision of this agreement is found unenforceable, the remainder remains valid. This
agreement binds the participant and their heirs, guardians, successors and assigns, and
ensures to the benefit of the Released Parties.
11. Acknowledgment & Signature
By purchasing this ticket the participant acknowledges that they have read, understood and
voluntarily accepted this agreement; that they have had the opportunity to ask questions; that
they are giving up substantial legal rights including the right to sue; and that they sign
voluntarily, without duress. This waiver is conspicuous and uses clear language, as required.
COI (Certificate of Insurance) Recommendations
To align with the waiver and meet venue requirements, obtain event‑specific insurance that
includes at least:
●
General Liability – $1M per occurrence / $2M aggregate. This covers bodily injury and
property damage claims arising from the event.
●
Participant Accident Medical Coverage – secondary medical coverage for participants
injured during fitness activities.
●
Product & Completed Operations Liability – covers claims arising from food,
beverages, supplements and products sold or provided by vendors.
●
Professional Liability for Instructors & Vendors – ensures independent contractors
(instructors, IV drip providers) have their own coverage; alternatively, list them as
additional insureds on your policy.
●
Liquor Liability – only if vendors serve alcohol; not needed for a sober event.
●
Additional Insured Endorsements – name the venue, vendor partners and Damn
Booty Brand LLC as additional insureds.
●
Waiver of Subrogation & Primary/Noncontributory wording – many venues require
these endorsements.
These coverages can typically be obtained through one-day event policies from providers like
The Event Helper, EventPolicy or Markel Event Insurance. Always verify the specific limits and
endorsements required by the venue and vendors.
