Liability Waiver and Release of Claims
IMPORTANT: PLEASE READ CAREFULLY BEFORE PARTICIPATING

This is a legally binding agreement. By signing this document, you waive certain legal rights, including the right to sue for injuries or damages.

I acknowledge and understand that participation in Refine Pilates Co. fitness activities, including but not limited to Pilates, padel, stretching, yoga-inspired movement, and other wellness or group exercise activities, involves inherent risks and dangers that could result in serious personal injury, illness, or death, as well as property damage or loss.

These risks include, but are not limited to: physical exertion and overexertion; contact with other participants, instructors, or equipment; slipping, falling, or tripping on uneven surfaces; weather-related hazards (heat, humidity, rain, lightning, etc.); dehydration or heat-related illness; muscle strains, sprains, or tears; cardiovascular stress or failure; allergic reactions; equipment malfunction; negligent or intentional acts of others; and my own physical condition or limitations. I acknowledge that this list is not exhaustive and that other risks, both known and unknown, may exist.

I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury (including death) that may be sustained by me as a result of participating in any activities organized by Refine Pilates Co., whether caused by the negligence of the organizers, partners, other participants, or otherwise. I certify that I am in good physical condition, have consulted a physician if needed, and will immediately stop and inform the instructor if I experience any pain, illness, or discomfort.

In consideration of being permitted to participate in Refine Pilates Co. activities, I hereby release, waive, discharge, and covenant not to sue Refine Pilates Co., its owners, operators, instructors, contractors, employees, volunteers, affiliates, partners, sponsors, and venue hosts including Platinum Padel and Matcha Maven (collectively referred to as “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in such activities, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs (including attorney fees) that may occur due to my participation in Refine Pilates Co. events, whether caused by negligence of the Released Parties or otherwise.

I authorize Refine Pilates Co. and its representatives to obtain emergency medical treatment for me if necessary, to transport me to a medical facility if required, and to share relevant medical information with emergency personnel. I understand that I am financially responsible for any costs incurred.

I grant Refine Pilates Co., its partners (including Platinum Padel and Matcha Maven), and their authorized representatives permission to use photographs, videos, or other media of me taken during events for promotional, marketing, or educational purposes without compensation. I may opt out of this by notifying Refine Pilates Co. in writing at info@refinepilatesco.com prior to the event.

I acknowledge that participation in group fitness activities may expose me to communicable diseases, including but not limited to COVID-19. I voluntarily assume this risk and agree to follow all health and safety protocols. I will not participate if I am feeling ill or have been recently exposed to a contagious illness.

I understand that Refine Pilates Co. and its partners are not responsible for any loss, theft, or damage to my personal property during events, and that I am solely responsible for the care of my belongings.

I agree to follow all instructions from event organizers and instructors, respect other participants and property, refrain from participation under the influence of alcohol or drugs, and use all equipment safely. I understand that Refine Pilates Co. reserves the right to remove me from any activity if my behavior is deemed unsafe or disruptive, without refund.

If any portion of this agreement is found void or unenforceable, the remaining portions shall remain in effect. This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions.

I HAVE READ THIS WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
