PINK PARTY — PARTICIPANT WAIVER & RELEASE OF LIABILITY

Event Date: November 7, 2026
Location: Hyatt Regency Coconut Point
Organizer: NGWC Studios LLC, operating as Naples Coffee Club

PLEASE READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF CLAIMS FOR ORDINARY NEGLIGENCE.

**1. Voluntary Participation & Assumption of Risk**

I voluntarily choose to attend the Pink Party and participate in activities I select, which may include Pilates by Sculpted, cold plunges, recovery and wellness services, shopping, refreshments, dancing, and swimming or pool use if I purchase the appropriate Pool Pass ticket.

I understand these activities involve risks, including muscle strains, falls, slippery surfaces, cold shock, fainting, cardiovascular complications, allergic reactions, infection, drowning, serious injury, permanent disability, and death. I knowingly assume the risks associated with my attendance and participation, including risks arising from the ordinary negligence of the parties identified below.

**2. Health & Safety**

I am responsible for determining whether each activity is appropriate for my health, fitness, and swimming ability, and for obtaining medical advice when needed. I will disclose relevant health conditions to individual service providers before receiving services.

I agree to follow all instructions, posted rules, and safety requirements. I will stop participating and notify staff if I experience pain, dizziness, breathing difficulties, or other concerning symptoms. I will not participate in exercise, cold plunges, or swimming while impaired by alcohol or other substances.

**3. Release of Liability**

To the fullest extent permitted by Florida law, I release NGWC Studios LLC, Naples Coffee Club, the owner and operator of Hyatt Regency Coconut Point, Sculpted, participating instructors, vendors, service providers, sponsors, and their respective officers, employees, contractors, and volunteers (“Released Parties”) from claims for personal injury, death, or property damage arising from my attendance or participation in the event, including any authorized post-event pool use.

**THIS RELEASE EXPRESSLY INCLUDES CLAIMS CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.** It does not release claims for gross negligence, intentional misconduct, or liability that cannot legally be waived.

**4. Independent Providers**

Participation in vendor services is optional. I understand that individual providers are responsible for evaluating my suitability for their services and may require separate consent forms or waivers. This agreement does not replace informed consent for medical treatment.

Shopping, refreshments, and separately priced services are additional purchases unless expressly included in my ticket.

**5. Pool Pass Terms**

Pool access is included only with a Pool Pass ticket. Standard event admission does not include pool access.

If I purchase a Pool Pass ticket, I may use the designated resort pools after the health and wellness portion of the event until **5:00 PM**, subject to hotel rules, weather, safety closures, and operating restrictions. I must follow hotel staff instructions and any additional hotel waiver requirements. I understand that a pool pass does not guarantee lifeguard supervision.

**6. Personal Belongings & Emergency Care**

I am responsible for my personal belongings. The release above applies to property damage or loss to the extent permitted by law.

If I am unable to consent during an emergency, I authorize staff to contact emergency services and seek necessary assistance. I remain responsible for charges legally payable by me.

**7. Photography & Video Consent**

I consent to NGWC Studios LLC and Naples Coffee Club photographing or recording me at the event and using my image, voice, and likeness in event recaps, social media, websites, and promotional materials without compensation.

**8. Ticket Policy**

All ticket purchases are final, non-refundable, and non-transferable for attendee cancellations, no-shows, late arrivals, or a decision not to participate in an activity, except as required by law.

If the organizer cancels or reschedules the event, ticket holders will be notified of the applicable refund or credit options. Individual activities, vendors, and schedules may change.

**9. Acknowledgment & Agreement**

I confirm that I am at least 18 years old, have read and understand this agreement, and voluntarily accept its terms. I understand that I am giving up legal rights, including certain rights to seek compensation for injuries caused by ordinary negligence.

Florida law governs this agreement. If any provision is held unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
