FREE PILATES EVENT
 PARTICIPANT WAIVER, ASSUMPTION OF RISK & RELEASE OF LIABILITY

 1. ACKNOWLEDGMENT OF PHYSICAL ACTIVITY

I understand that participation in this free Pilates event involves physical exercise and movement that may include stretching, balance exercises, core strengthening, controlled body movements, mat-based exercises, and the use of exercise equipment or props.

I understand that participation in Pilates and other physical activities involves inherent risks, including but not limited to muscle soreness, strains, sprains, falls, loss of balance, joint or back injuries, aggravation of pre-existing injuries, dizziness, fainting, and other physical injuries or medical complications.

I acknowledge that these risks may occur regardless of my fitness level, experience, or the precautions taken by the instructor or event organizers.

2. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

I voluntarily choose to participate in this event and knowingly assume the inherent risks associated with participation.

I understand that I am responsible for determining whether I am physically able to participate safely. I agree to work within my personal limitations, modify or discontinue exercises as needed, follow reasonable safety instructions, and immediately stop exercising if I experience pain, dizziness, shortness of breath beyond expected exertion, or other concerning symptoms.

I understand that I may decline any exercise or leave the event at any time.

I acknowledge that participation is voluntary and that no guarantee has been made regarding the outcome, benefits, or safety of any particular exercise.

3. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in this free Pilates event, I hereby release and discharge, to the fullest extent permitted by applicable law, the following individuals and entities, together with their respective officers, employees, representatives, agents, volunteers, and authorized affiliates, as applicable:

- Samantha Smith
- Built After Hours Personal Training LLC
- Braxton County Schools

This release applies to claims, demands, causes of action, damages, or liabilities for personal injury, illness, death, or property damage arising out of or relating to my participation in the event, including claims arising from the ordinary negligence of a released party to the extent such a release is enforceable under applicable law.

I understand that this agreement does not waive or release claims that cannot legally be waived, including liability for gross negligence, willful or intentional misconduct, or other conduct for which a release is prohibited by law.

4. MEDICAL CONDITION AND EMERGENCY CARE

I acknowledge that I am responsible for considering my own health, physical condition, and limitations before participating.

I understand that the instructor and event organizers are not providing individual medical evaluations or medical treatment as part of this event.

In the event of an emergency, I authorize event personnel to contact emergency medical services and request assistance on my behalf. I understand that I may be responsible for medical expenses incurred for evaluation or treatment, to the extent permitted by law.

5. EQUIPMENT AND FACILITY SAFETY

I agree to use exercise equipment and props only as instructed, maintain awareness of my surroundings, and follow reasonable facility rules and safety instructions.

I agree to notify the instructor or event organizer of any unsafe conditions, damaged equipment, or concerns that may affect my safety.

I understand that I am responsible for my personal belongings and that any release relating to loss of or damage to personal property applies only to the extent permitted by law.

6. ACKNOWLEDGMENT OF FREE EVENT

I understand that this Pilates event is being offered free of charge. I acknowledge that the absence of a participation fee does not eliminate the inherent risks associated with physical exercise or change my responsibility to participate within my abilities.

7. ACKNOWLEDGMENT AND SIGNATURE

I have carefully read this waiver and release agreement, understand its contents, and understand that signing it means I am giving up certain legal rights. I have had the opportunity to ask questions and am signing voluntarily.

I understand that this agreement is intended to be legally binding to the extent permitted by applicable law.
