Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement
For Participation in Plunge Party Events

This Release and Waiver of Liability (the “Release”) is executed by the undersigned participant (“Participant”) in favor of Imagination Basin LLC, the operating entity for the event series known as Plunge Party, and all event sponsors, partners, and affiliates (collectively referred to as “Released Parties”).

1. Acknowledgment of Risks

By signing this Release, Participant acknowledges and agrees that participation in Plunge Party events, which include cold plunges, heat sources (e.g., saunas), wellness activities, and related experiences (the “Activities”), involves inherent risks, including but not limited to:
	•	Exposure to cold water and potential adverse health effects (e.g., hypothermia, cardiovascular events);
	•	Exposure to heat sources and potential adverse health effects (e.g., dehydration, overheating, burns, or heat stroke);
	•	Risk of slips, trips, and falls in and around wet or heated areas;
	•	Physical exertion, stress, and discomfort;
	•	Any injuries or illnesses that may arise during or after participation.

Participant certifies that they are physically and mentally fit to participate in the Activities.

2. Assumption of Risk
Participant expressly and voluntarily assumes all risks associated with the Activities, including but not limited to those outlined above. Participant understands that these risks may result in physical injury, emotional distress, illness, or death.

3. Waiver and Release of Liability
To the fullest extent permitted by law, Participant hereby releases, discharges, and holds harmless Plunge Party, Imagination Basin LLC, and all event sponsors, partners, and affiliates from any and all claims, demands, liabilities, damages, and causes of action arising out of or related to the Activities, including but not limited to claims based on negligence.
This waiver and release extends to all Released Parties, ensuring that no sponsor, partner, or affiliate shall be held liable for any injuries, losses, or damages incurred by Participant as a result of their participation in the Activities.

4. Indemnification
Participant agrees to indemnify and hold harmless Plunge Party, Imagination Basin LLC, and all event sponsors, partners, and affiliates from any claims, damages, or expenses (including legal fees) arising from or related to Participant’s involvement in the Activities.

5. Medical Consent
In the event of an emergency, Participant authorizes Plunge Party to obtain medical treatment for them. Participant agrees to bear any costs incurred for such treatment.

6. Photography and Media Release
Participant grants permission to Plunge Party to capture and use photographs, video, and audio recordings taken during the Activities for marketing, promotional, and business purposes. This includes, but is not limited to, use on social media platforms, websites, advertisements, and other promotional materials.
Participant waives any right to review, approve, or receive compensation for the use of such media and releases Plunge Party, its sponsors, partners, and affiliates from any liability related to the use of such media.

7. Governing Law
This Release shall be governed by and construed in accordance with the laws of the state in which the Activities are conducted.

8. Acknowledgment of Understanding
Participant certifies that they have read and fully understand this Release. Participant acknowledges that they are signing this Release freely and voluntarily, and that it constitutes a complete and unconditional release of liability to the greatest extent allowed by law.
