Yoga

This waiver applies to participation in activities, including but not limited to Puppy Yoga or Puppy Pilates, or any private or public events, organized by Paws and Pose Inc. (“Organizer”). By signing this agreement, I, the undersigned, agree to the following terms on behalf of myself and (if applicable) any minor(s) I am supervising at the event:

1. Assumption of Risk
I understand that participating in this event involves inherent risks, including but not limited to:
Interaction with live animals (e.g., dogs), which may result in injury, allergies, illness, bites, scratches, or other incidents despite reasonable precautions. Potential allergic reactions to food, beverages, or environmental factors at the event.
I acknowledge and voluntarily accept these risks as a condition of participation, whether they arise from the Organizer's actions, omissions, or otherwise.

2. Waiver of Liability
I release, waive, and forever discharge Paws and Pose Inc., its owners, employees, agents, contractors, volunteers, sponsors, partners, affiliates, and event venue operators (“Released Parties”) from any and all claims, demands, actions, or causes of action arising from injuries, damages, or losses incurred while participating in or attending this event, including:
Personal injury, illness, or allergic reactions (from food, beverages, animals, or otherwise). Property damage or theft, regardless of the cause or source. Any other harm or loss, whether foreseeable or unforeseeable.
I understand that by signing this waiver, I relinquish my legal right to bring lawsuits or claims against the Released Parties for any reason associated with this event, regardless of negligence or fault.

3. Participant Conduct and Safety
I agree to abide by all safety instructions and rules provided by the Organizer. Failure to do so may result in removal from the event without refund. Specific safety provisions include, but are not limited to:
Avoiding behavior that may stress or harm animals, including but not limited to picking up, feeding, or attempting to remove them from the premises. Adhering to all food and beverage policies communicated during the event. Respecting the personal property and space of other guests.
Any costs associated with injuries to animals or damages caused by my actions are my responsibility.

4. Allergies, Health Conditions, and Emergency Situations
I confirm that I am aware of and responsible for managing my own allergies, dietary restrictions, and health conditions. Paws and Pose Inc. is not liable for:
Allergic reactions or health complications arising from exposure to animals, food, drinks (including mocktails, juices, donuts, cupcakes, gluten-free snacks, pretzels, and other offered snacks), or any other allergens or conditions present at the event.Emergency medical costs, which are solely my responsibility. In the event of injury, I authorize the Organizer to seek emergency medical attention if deemed necessary.

5. For Participants Accompanying Minors
If I am supervising a minor(s) at this event, I understand and agree that I am fully responsible for their:
Safety and behavior, including ensuring they follow all event rules and guidelines. Interaction with animals, including preventing harm to or from the animals. Dietary needs, including avoiding any food, drink, or environmental exposure that may trigger allergies or health conditions.
Paws and Pose Inc. is not responsible for managing allergies, monitoring dietary needs, or preventing harm resulting from the actions of the minor(s) I supervise.

6. Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, demands, losses, or liabilities arising from my or my minor’s actions during the event, including but not limited to claims from third parties or other attendees.

7. Photo and Video Consent
I grant Paws and Pose Inc. and its affiliates the right to take photographs, videos, or digital recordings of me (and any minors I am supervising) during the event for use in promotional, advertising, or marketing materials. These materials are the sole property of Paws and Pose Inc. I understand I will not receive compensation for their use. To opt out of this clause, I must provide written notice to the Organizer before the event.

8. Force Majeure
Paws and Pose Inc. is not responsible for cancellations or interruptions due to events beyond its control, including but not limited to weather, venue issues, or public health concerns. In such cases, refunds or rescheduling options will be at the Organizer’s discretion.

9. Refund and Cancellation Policy
All sales are final. Refunds are not provided for cancellations by participants or no-shows. Rescheduling options may be offered at the Organizer’s discretion.

10. Governing Law and Dispute Resolution
This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario. Any disputes arising from this agreement or the event shall be resolved exclusively in the courts of Ontario.

11. Acknowledgment and Agreement
By signing this document, I confirm the following:
I am at least 18 years of age or the legal guardian of any minor(s) I am supervising at the event. For group or private events, the organizer acknowledges responsibility for informing their guests of event rules, risks, and waiver terms. By signing this waiver, the organizer confirms they have communicated these terms and that all attendees participate with knowledge of the associated risks. For larger events, notice of the risks and waiver terms is provided at the entry or registration, and participation in the event constitutes agreement to these terms. I have read, understood, and voluntarily agreed to the terms of this waiver.
This agreement is binding upon me, my heirs, representatives, and assigns.

12. Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Acceptance of Terms
I acknowledge and agree that my participation in this event constitutes full acceptance of all terms outlined in this document. I release Paws and Pose Inc. from any claims, actions, or causes of action arising from my participation in this event.

By selecting 'I have reviewed and I confirm,' you acknowledge that you have read, understood, and agreed to the above terms and conditions.
