WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (THE “AGREEMENT”) CONTAINS A WAIVER OF YOUR RIGHT TO SUE, A RELEASE OF ALL CLAIMS, A COMMITMENT TO BINDING ARBITRATION, AND OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PARTICIPATING.

WAIVER:
In consideration for being allowed to participate in the event described below, including all associated activities, services, and use of the premises, facilities, equipment, and transportation (collectively the “Event”), I, for myself and on behalf of my heirs, representatives, executors, administrators, successors, assigns, and any other person or entity acting on my behalf or my estate, hereby release, waive, discharge, and covenant not to sue the Released Parties (as defined below) for any claims, damages, or liability, including but not limited to those arising from the negligence of the Released Parties, related to my participation in the Event. This includes, without limitation, personal injury (including death), accidents, illnesses, and damage to or loss of personal property.
The term “Released Parties” refers to Pups N Chill, LLC, all sponsors, advertisers, service, equipment, and treatment providers, as well as other individuals or entities involved in the planning and execution of the Event, the owners and lessors of the premises where the Event takes place, and all officers, directors, employees, partners, and shareholders of any of the foregoing.

DESCRIPTION OF EVENT & ACTIVITIES:
Event Name: Pups N Chill
 Event Activities: Event activities may include, but are not limited to, the serving and consumption of food and beverages, cold plunges, ice baths, saunas, compression therapy, stretching, physical activity, interaction with shelter puppies, IV treatments, red light therapy, congregation of people, and other related activities.

ASSUMPTION OF RISKS:
I acknowledge and agree that participation in the Event is entirely voluntary and involves certain inherent risks that cannot be completely eliminated regardless of the care taken. These risks may vary by activity and may not yet be fully known but can include, without limitation:
Death


Paralysis


Heart attacks


Stroke


Drowning


Hypothermia/Hyperthermia


Exhaustion or heat stroke


Joint or bone injuries


Concussions and loss of consciousness


Scratches, bruises, sprains


Allergic reactions, foodborne illness, or other adverse reactions


Minor/Severe burns


Exacerbation of pre-existing conditions


Exposure to COVID-19 or other communicable diseases


By clicking the consent box or electronically signing this Agreement, I confirm that I have considered the risks involved with participating in the Event, that I do not have any health or medical condition that might be exacerbated by participation, that I have either consulted with my healthcare provider about the associated risks or knowingly decided not to do so, and that I voluntarily choose to participate in the Event despite these risks.

INDEMNIFICATION:
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, procedures, costs, expenses (including attorney’s fees), damages, and liabilities that may arise out of or in connection with my breach of this Agreement or my participation in the Event, and to reimburse the Released Parties for any expenses incurred in connection with my breach of this Agreement or participation in the Event.

PUBLICITY & CONTENT OWNERSHIP:
I understand and agree that any and all photographs, videos, recordings, or other content captured at the Event—whether taken by the Released Parties, me, or any other attendee or third party—are the sole and exclusive property of Pups N Chill, LLC.
I acknowledge that I have no right to use, reproduce, distribute, display, or exploit any such content for commercial purposes (including but not limited to marketing, promotional use, social media monetization, advertising, or resale), unless I have received prior written consent from Pups N Chill, LLC.
By attending the Event, I grant Pups N Chill, LLC the irrevocable right and permission to use my name, image, likeness, and voice (collectively “Likeness”), as captured in any form of media during the Event, for any lawful purpose, including but not limited to advertising, marketing, and promotional uses in any format or platform now known or hereafter developed.
I waive any right to inspect or approve the use of such materials, and I agree that I am not entitled to and will not seek any compensation or royalties in connection with any use of my Likeness or any content taken at the Event.
Violation of this section may result in legal action and damages.

NO EXPECTATION OF EMPLOYMENT OR COMPENSATION:
I understand and agree that my participation in the Event does not create an employment, agency, or contractor relationship with Pups N Chill, LLC or any Released Party. I am participating voluntarily and will not receive any wages, benefits, insurance coverage, or compensation for my participation unless expressly agreed to in writing.

AUTHORIZATION AND RELEASE FOR MEDICAL TREATMENT:
I authorize Pups N Chill, LLC and/or its agents to secure emergency medical treatment for me if deemed necessary. I understand and agree that I am solely responsible for all medical costs arising from any illness or injury sustained during the Event, and I release and discharge the Released Parties from any claim arising from such treatment or lack thereof.

ANIMAL INTERACTIONS DISCLAIMER:
I acknowledge that the Event may involve interactions with dogs and other animals. I understand that animals can behave unpredictably and may bite, scratch, or transmit diseases. I accept full responsibility for any risks, injuries, or damages that may arise from contact with animals at the Event, and I release Pups N Chill, LLC and its partners from all liability arising from such interactions.

FORCE MAJEURE:
Pups N Chill, LLC shall not be liable for any delay or failure in performance of its obligations or the cancellation of the Event due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, labor strikes, acts of war or terrorism, public health emergencies, or actions of governmental authorities.

NO GUARANTEE OF OUTCOME:
I understand that while the Event may include services or experiences intended to support wellness, social interaction, or adoption efforts, Pups N Chill, LLC makes no guarantee of any specific outcomes related to health, business exposure, animal adoptions, or networking opportunities.

SEVERABILITY:
If any portion of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

GOVERNING LAW:
This Agreement shall be governed by the laws of the State of Florida without regard to its conflict of laws provisions.

CONSENT TO ELECTRONIC SIGNATURE:
I agree that clicking the consent box or electronically signing this Agreement shall have the same legal effect as a physical signature and confirms my intent to be bound by this Agreement.

ACKNOWLEDGMENT OF UNDERSTANDING:
I have read this Agreement, fully understand its terms, and understand that I am waiving substantial rights, including my right to sue the Released Parties. I confirm that I am signing the Agreement freely and voluntarily without any inducement.
