This immersive session combines somatic movement, breathwork, and intentional connection practices to help you feel safe in your body and open to meaningful encounters.

Bathe Society – Liability Waiver and Release Agreement
PLEASE READ CAREFULLY BEFORE SIGNING

This Waiver and Release Agreement ("Agreement") is entered into between the undersigned individual ("Participant") and Dream Bath INC (DBA: Bathe, Bathe Society), Beyond Bathe, and/or SUD Productions LLC (collectively, the “Company”). By signing below, you acknowledge and agree to the following:

 1.⁠ ⁠General Release of Liability
I voluntarily agree to participate in activities and use the facilities offered by the Company at my own risk. I understand that use of the amenities—including but not limited to saunas, cold plunges, pools, showers, and natural outdoor spaces—may result in serious injury, illness, or death. I hereby release, waive, and discharge the Company and its officers, directors, employees, agents, affiliates, and partners ("Released Parties") from any and all claims, liabilities, damages, or causes of action arising from or related to my use of the facilities, including claims resulting from ordinary negligence.

This release does not apply to gross negligence or willful misconduct, which are not waivable under Texas law.

 2.⁠ ⁠Assumption of Risk
I understand and acknowledge that use of the facilities—including saunas, cold plunges, cowboy pool, showers, and lounge areas—entails inherent risks. These include, but are not limited to, dehydration, burns, heat exhaustion, hypothermia, fainting, allergic reactions, falls, environmental exposure, illness (including communicable diseases such as COVID-19), and aggravation of pre-existing conditions. I voluntarily accept all risks and agree that I am solely responsible for monitoring my own physical condition and safety during use.

 3.⁠ ⁠Medical Acknowledgment
I certify that I am physically able and medically cleared to use the amenities offered by the Company. I understand that individuals with heart conditions, blood pressure issues, respiratory or neurological disorders, pregnancy, recent surgeries, or those under the influence of alcohol, drugs, or medications that impair judgment should consult a doctor before participating. I agree to stop use immediately if I feel lightheaded, dizzy, faint, or otherwise unwell.

 4.⁠ ⁠Guest Responsibility
I acknowledge that all guests I bring must complete this waiver prior to entering the premises, and I accept full responsibility for their conduct and any claims arising from their actions.

 5.⁠ ⁠Personal Property
I understand that lockers provided are unsecured. I release the Company from any liability related to lost, stolen, or damaged personal items.

 6.⁠ ⁠Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all claims, damages, or losses (including attorney’s fees) arising from my actions or those of any guests I bring.

 7.⁠ ⁠Media Consent
I understand that promotional photography or video may occur during my visit. Unless I notify the Company in writing before my visit, I grant permission for my likeness, image, or voice to be used in marketing and promotional materials in perpetuity without compensation.

 8.⁠ ⁠Arbitration & Dispute Resolution
Any dispute relating to this Agreement shall be resolved by binding arbitration in the State of Texas, pursuant to the rules of the American Arbitration Association. I waive my right to a jury trial or participation in a class action.

 9.⁠ ⁠Severability
If any part of this Agreement is held to be invalid or unenforceable, the remaining sections shall continue in full force and effect.

10.⁠ ⁠Electronic Signature Consent
By signing below, I acknowledge that this Agreement may be executed and stored electronically, and that my electronic signature shall be valid and enforceable as a written signature under applicable law.
