Remedy Run Club Waiver and Release of Liability

By signing below, I acknowledge and agree to the following terms as a participant in the Remedy Run Club hosted by Remedy Wellness (“Remedy”):

1. Voluntary Participation. I understand that my participation in the Remedy Run Club and all related events, activities, and gatherings offered by Remedy (collectively, the “Club Activities”) is completely voluntary. I acknowledge that the Club Activities are free community events, and I choose to participate at my own risk.

2. Assumption of Risk. I understand that running, walking, and participating in fitness-related or social activities involve inherent and potentially hazardous risks that could result in injury, illness, or death. These risks include, but are not limited to:
Slips, trips, and falls
Muscle strains, sprains, or other injuries
Dehydration, exhaustion, or other physical stress
Adverse weather conditions, including heat, humidity, or cold
Accidents involving traffic, pedestrians, or environmental hazards
Physical contact with other participants, volunteers, or spectators
I knowingly and freely assume all such risks, whether known or unknown, even if arising from the negligence of Remedy, its owners, employees, volunteers, sponsors, partners, or affiliated entities.

3. Health and Fitness Acknowledgment. I certify that I am physically fit and medically able to participate in the Club Activities. I have no medical condition or impairment that would prevent my safe participation. I understand it is solely my responsibility to consult with a physician regarding my ability to engage in physical activity and that Remedy does not evaluate or monitor participants’ health or fitness levels. If I am uncertain about my ability to participate safely, I will refrain from participating until I have obtained appropriate medical clearance.

4. Release and Waiver of Liability. In consideration of being permitted to participate in the Club Activities, I, for myself and anyone entitled to act on my behalf, hereby waive, release, and discharge Remedy, its owners, affiliates, employees, contractors, volunteers, sponsors, and partners (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action of any kind that may arise from or relate in any way to my participation in the Club Activities, including any loss, damage, injury, illness, or death, even if caused by the negligence of the Released Parties.

5. Indemnification. I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising out of my participation in the Club Activities or my violation of this waiver.

6. Personal Responsibility. I agree to conduct myself safely and respectfully during all Club Activities. I will obey all instructions, rules, and traffic laws, remain aware of my surroundings, and act in a manner that promotes the safety of myself and others.

7. Photo and Media Release. I grant Remedy permission to capture, use, and reproduce photographs, video recordings, or other media of me participating in the Club Activities for marketing, social media, and promotional purposes, without compensation or further approval. Any waiver of rights to my name, image, likeness, or other personality rights is limited solely to the extent necessary for Remedy to make reasonable use of such media in connection with those purposes.

8. No Guarantees or Medical Advice. I understand that Remedy and its representatives are not providing medical advice, diagnosis, or treatment. Participation in the Remedy Run Club or Club Activities does not guarantee any fitness or health results.

9. Acknowledgment of Understanding I have carefully read this waiver and fully understand its terms. I understand that by signing below, I am giving up substantial legal rights, including the right to sue. I sign this document freely and voluntarily, intending it to be a complete and unconditional release of all liability to the fullest extent permitted by law.
