WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AGREEMENT & MEDIA RELEASE

THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AGREEMENT, AND MEDIA RELEASE (the “Agreement”) contains a waiver of your right to sue, a release of claims, and other provisions that affect your legal rights. PLEASE READ CAREFULLY.

1. WAIVER AND RELEASE OF LIABILITY
In consideration of being allowed to attend and/or participate in an event organized by The Wellness Wave SoFlo, powered by Golden Wave Movement LLC (the “Event”), including all associated activities, services, and use of the premises, facilities, equipment, instructors, vendors, and other Event offerings, I, for myself and for my heirs, executors, administrators, assigns, and personal representatives, hereby release, waive, discharge, and covenant not to sue The Wellness Wave SoFlo, Golden Wave Movement LLC, the Event venue (including Johnny O’s Gymnasium when applicable), and their respective owners, officers, employees, contractors, instructors, volunteers, sponsors, vendors, partners, affiliates, property owners, and other associated parties (collectively, the “Released Parties”) from claims, demands, actions, causes of action, damages, losses, or liabilities arising out of or related to my attendance at or participation in the Event, to the fullest extent permitted by Florida law.

I understand that participation may involve risks of injury, illness, property damage, or other loss, including risks arising from physical activity, equipment, premises conditions, independent third-party services, or the ordinary negligence of a Released Party.

2. DESCRIPTION OF EVENT & ACTIVITIES

The Wellness Wave SoFlo events may include, but are not limited to:

Group workouts and fitness classes
Strength training and fitness challenges
Mat Pilates, sculpt, yoga, stretching, mobility, and movement classes
Handstand workshops and other fitness workshops
Cold plunges and ice baths
Sauna and other recovery experiences
Massage therapy and chiropractic services or adjustments
IV drips, vitamin/B12 shots, and other wellness services or treatments
Vendor booths, demonstrations, product samples, and retail products
Food, beverages, supplements, and nutritional products
Fitness and wellness education or advice
Social and community-building activities
Photography and content creation
Live DJs, music, entertainment, and other Event activities

Specific activities and vendors vary by Event.

3. ASSUMPTION OF RISKS

I acknowledge that my attendance and participation are voluntary and that physical activity, wellness services, recovery experiences, food and beverage consumption, and other Event activities involve inherent and other risks that cannot be completely eliminated.

Such risks may include, but are not limited to:

Sprains, strains, fractures, falls, concussions, or other physical injuries
Muscle soreness, exhaustion, dizziness, fainting, or dehydration
Cardiovascular stress or complications associated with physical activity
Hypothermia, cold-related reactions, or discomfort from cold plunges
Overheating, dehydration, or other reactions associated with sauna or heat exposure
Slips, trips, falls, collisions, or accidents on the premises
Allergic or adverse reactions to food, beverages, samples, supplements, skincare products, or other products
Choking, foodborne illness, or other illness associated with food or beverage consumption
Adverse reactions to IV therapy, injections, vitamin shots, massage, chiropractic services, or other wellness treatments
Injury or adverse effects associated with fitness equipment or demonstrations
Risks associated with services or products provided by independent vendors or third-party providers

I voluntarily assume all known and unknown risks associated with my attendance and participation.

I understand that I am responsible for determining whether I am physically and medically able to participate in any activity or receive any service. I am responsible for informing the appropriate instructor, vendor, provider, or staff member of relevant allergies, sensitivities, injuries, limitations, medications, or medical conditions before participating, consuming a product, or receiving a treatment or service.

I understand that The Wellness Wave SoFlo and Golden Wave Movement LLC do not provide medical advice and that participation in an Event is not a substitute for consultation with a qualified healthcare professional.

4. INDEPENDENT VENDORS, PRODUCTS, SERVICES, PURCHASES & REFUNDS

I understand that vendors, instructors, practitioners, food and beverage providers, product companies, and other third-party businesses appearing at the Event may be independently owned and operated and are not employees or agents of The Wellness Wave SoFlo, Golden Wave Movement LLC, or the Event venue unless expressly stated otherwise.

Any purchase, transaction, order, treatment, service, subscription, product, food, beverage, or other exchange made directly between me and an independent vendor is solely a transaction between me and that vendor.

If I am dissatisfied with a product or service, receive a defective or incorrect product, experience an issue with an order, or seek a return, refund, reimbursement, replacement, exchange, cancellation, or other resolution relating to a vendor purchase or service, I understand that I must resolve the matter directly with the applicable vendor.

The Wellness Wave SoFlo, Golden Wave Movement LLC, and the Event venue, including Johnny O’s Gymnasium when applicable, are not responsible for issuing or facilitating refunds, reimbursements, exchanges, replacements, or other remedies for transactions made directly with independent vendors.

The presence of a vendor at an Event does not constitute a guarantee or warranty by The Wellness Wave SoFlo, Golden Wave Movement LLC, or the Event venue regarding the vendor’s products, services, representations, results, safety, quality, effectiveness, or business practices.

5. PHYSICAL CONTACT DURING FITNESS & WELLNESS ACTIVITIES

I understand that during fitness classes, workshops, training sessions, or certain wellness services, instructors or practitioners may offer physical assistance to help with form, alignment, positioning, or safety. This may involve gently guiding or adjusting my posture or movements.

By signing this Agreement, I consent to appropriate physical assistance in connection with the activity in which I voluntarily participate. I understand that I may decline physical assistance at any time and should inform the instructor or practitioner if I do not wish to be physically assisted.

6. VOLUNTARY PARTICIPATION & PERSONAL RESPONSIBILITY

I understand that I am never required to participate in any particular activity, treatment, demonstration, challenge, cold plunge, sauna session, fitness class, workshop, or vendor service offered at the Event.

I agree to stop participating if I experience pain, dizziness, shortness of breath, unusual discomfort, or other symptoms that cause concern. I accept responsibility for my personal belongings and understand that the Released Parties are not responsible for lost, stolen, misplaced, or damaged personal property except where liability cannot legally be waived.

7. INDEMNIFICATION AND HOLD HARMLESS

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, damages, liabilities, costs, or expenses arising from my actions, my failure to follow Event rules or safety instructions, my failure to disclose relevant information to a service provider, or claims caused by my own negligent or intentional conduct.

8. PHOTO, VIDEO & MEDIA RELEASE

I understand that photography, videography, and other content creation may take place throughout the Event.

I grant The Wellness Wave SoFlo and Golden Wave Movement LLC permission to photograph, record, and otherwise capture my image, voice, and likeness during the Event and to use such content for legitimate promotional, advertising, social media, website, marketing, commercial, and Event-related purposes without compensation to me.

I waive the right to inspect or approve the finished content or its use.

9. AGE REQUIREMENT

I represent and warrant that I am at least 18 years of age at the time of signing this Agreement.

I understand and agree that individuals under the age of 18 may not attend or participate in the Event unless The Wellness Wave SoFlo has expressly established otherwise for a particular Event and appropriate parent or legal guardian documentation has been completed.

10. EVENT CHANGES & AVAILABILITY

I understand that Event schedules, instructors, vendors, activities, services, products, entertainment, and other offerings may be changed, substituted, delayed, limited, or canceled due to availability, weather, safety considerations, circumstances outside the organizer’s control, or other Event needs.

Participation in any particular activity or receipt of any particular vendor product, sample, treatment, or service is not guaranteed unless expressly stated otherwise.

11. SEVERABILITY

If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

13. ACKNOWLEDGMENT & SIGNATURE

I acknowledge that I have carefully read this entire Agreement and understand its terms.

I understand that this Agreement includes an assumption of risk, release and waiver of liability, indemnification provisions, vendor transaction provisions, and a photo/video/media release.

I understand that by signing this Agreement, I am giving up certain legal rights, including the right to bring certain claims or lawsuits against the Released Parties.

I voluntarily agree to these terms and confirm that I am signing this Agreement freely and without coercion.
