EVENT LIABILITY WAIVER, RELEASE OF CLAIMS & ASSUMPTION OF RISK
Digital Acceptance Agreement (SweatPals)
Event(s): REVIVAL Wellness Yoga Series at Scottsdale Civic Center (recurring — first event June 11, 2026)
Location: Scottsdale Civic Center, Scottsdale, Arizona (“Venue”)
Organizer: Revival Wellness Experience, LLC (“Organizer”)
Applies To: All yoga series events that I attend at this location during the applicable season, unless replaced by a newer version presented at registration.
IMPORTANT LEGAL NOTICE — READ CAREFULLY
By registering for or attending this event and by checking the box indicating “I agree,” I acknowledge that I have read, understood, and voluntarily agree to this legally binding Waiver, Release of Claims, Assumption of Risk, and Indemnification Agreement (“Agreement”).
This Agreement includes a release of liability, a covenant not to sue, and an indemnification obligation.
1. ELIGIBILITY AND CAPACITY
This event is open to participants of all ages. If I am the parent or legal guardian of a minor attending this event, I agree to the terms of this Agreement on behalf of myself and on behalf of the minor, and I assume full responsibility for the minor’s participation and conduct. By accepting this Agreement, I represent and warrant that I am at least 18 years old and legally competent to enter into this Agreement on my own behalf and, if applicable, on behalf of any minor in my care.
2. EVENT RULES — NO ALCOHOL OR SUBSTANCES
I acknowledge and agree that alcohol, illegal drugs, and recreational substances are strictly prohibited at this event. I agree not to possess, use, or distribute prohibited substances at the event.
The Organizer may, in its sole discretion, deny entry and/or remove any person for suspected impairment or any violation of event rules, with or without refund.
3. NATURE OF EVENT AND ACTIVITIES
I understand that this event is an outdoor wellness and yoga event held on City of Scottsdale property. Event programming may include, but is not limited to:
Yoga (all levels, including flow, restorative, and other yoga styles)
Breathwork and guided breathing exercises
Meditation and mindfulness sessions
Sound healing or other holistic wellness modalities
Movement warm-ups, stretching, and cool-down exercises
Any other fitness, wellness, or movement activations offered at the event
Programming and instructors may vary between events in the series.
4. ASSUMPTION OF RISK — GENERAL AND ACTIVITY-SPECIFIC
I understand that attending and participating in yoga and wellness activities involves inherent and foreseeable risks, including serious injury and death. These risks may arise from my own actions, the actions of others, the physical demands of yoga and movement, Venue conditions, weather, and other causes beyond the Organizer’s control.
Specific risks I understand and accept include, but are not limited to:
Musculoskeletal injury, joint strain, muscle strain, or overexertion from yoga postures, movement sequences, or other physical activity
Falls, balance-related injuries, or contact with the ground or surrounding surfaces during yoga or movement exercises
Injury arising from advanced, partner-based, or weight-bearing yoga postures
Dizziness, lightheadedness, hyperventilation, or temporary loss of consciousness related to breathwork or pranayama exercises
Cardiovascular events, heat exhaustion, heat stroke, or dehydration resulting from outdoor physical activity in warm or sunny conditions
Slips, trips, and falls on uneven, wet, or outdoor surfaces (grass, pavement, walkways, or temporary flooring)
Sun exposure, UV radiation, and heat-related illness from outdoor participation
Allergic reactions to outdoor environmental conditions (pollen, grass, insects, etc.)
Loud music or sound exposure during the event
Acts or omissions of other attendees, instructors, vendors, or third parties
Illness exposure associated with being in public or group settings
Equipment or prop-related injuries (yoga mats, blocks, straps, or other wellness props)
Property damage occurring in or around the Venue areas
I voluntarily and expressly assume all risks, known and unknown, foreseeable and unforeseeable, including risks arising from the negligence of the Released Parties (defined below), except to the extent such release is prohibited by law.
5. VOLUNTARY PARTICIPATION; PHYSICAL READINESS
I understand that my attendance and participation in all event programming are entirely voluntary. I acknowledge that the Organizer and instructors are not medical professionals and that any instruction given during the event is general guidance, not personalized medical or fitness advice.
I represent that I am in adequate physical condition to participate in yoga and wellness activities, and that I am not aware of any medical condition, injury, pregnancy, or health limitation that would make such participation inadvisable without medical clearance. I agree to inform any instructor of relevant physical limitations before participating.
I further agree to listen to my body, modify or stop participation at any time if I feel pain, discomfort, or distress, and to seek medical attention if needed.
6. MEDICAL ACKNOWLEDGMENT; EMERGENCY CARE
I understand that:
The Organizer does not provide medical services or professional medical personnel at this event.
I am responsible for my own health and safety and for obtaining medical advice prior to participating in any yoga or wellness activity.
In an emergency, the Organizer may call 911 or seek assistance, but has no obligation to provide medical care.
I authorize the Organizer and/or Venue personnel to obtain emergency medical care for me if they choose to do so, and I agree to be financially responsible for all related costs.
7. OUTDOOR VENUE AND CITY PROPERTY ACKNOWLEDGMENT
I understand and acknowledge that this event takes place on outdoor property owned and managed by the City of Scottsdale. I agree to comply with all City of Scottsdale rules, regulations, and ordinances applicable to the use of Scottsdale Civic Center, including those related to noise, use of public space, prohibited items, and conduct.
I understand that conditions at an outdoor city venue may include uneven terrain, exposure to the elements, proximity to public areas, and other environmental factors outside the Organizer’s control, and I accept all risks arising from such conditions.
8. RELEASE OF LIABILITY; COVENANT NOT TO SUE
To the fullest extent permitted by Arizona law, I hereby release, waive, discharge, and covenant not to sue:
Revival Wellness Experience, LLC, and its owners, officers, directors, members, managers, employees, volunteers, contractors, instructors, representatives, agents, affiliates, successors, and assigns; and
The City of Scottsdale, an Arizona municipal corporation, located at 3939 N Drinkwater Blvd, Scottsdale, AZ 85251, and its elected officials, officers, employees, agents, departments, representatives, successors, and assigns; and
Scottsdale Arts, located at 7380 E. 2nd Street, Scottsdale, AZ 85251, and its officers, directors, employees, agents, representatives, successors, and assigns; and
Plated Fitness Reset Old Town Scottsdale, LLC d/b/a Reset Mind & Body, located at 2515 N Scottsdale Rd, Suite 108, Scottsdale, AZ 85257, and its owners, officers, members, managers, employees, contractors, instructors, agents, successors, and assigns; and
Any event vendors, instructors, sponsors, and partners present at or associated with the event
(collectively, the “Released Parties”)
from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether known or unknown, suspected or unsuspected, arising out of or related to my attendance, participation, or presence at the event or Venue, including but not limited to claims for personal injury (including injury arising from yoga, breathwork, wellness activities, or any other event programming), illness, death, property damage, theft, or economic loss, even if caused in whole or in part by the negligence of any of the Released Parties, except to the extent such release is prohibited by law.
9. INDEMNIFICATION AND HOLD HARMLESS
I agree to defend, indemnify, and hold harmless the Released Parties—expressly including the City of Scottsdale (3939 N Drinkwater Blvd, Scottsdale, AZ 85251), Scottsdale Arts (7380 E. 2nd Street, Scottsdale, AZ 85251), and Plated Fitness Reset Old Town Scottsdale, LLC d/b/a Reset Mind & Body (2515 N Scottsdale Rd, Suite 108, Scottsdale, AZ 85257) as protected parties under this Agreement—from and against any claims, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
My acts or omissions at or related to the event, including my participation in yoga, breathwork, or any other wellness or fitness activity
My violation of any applicable law, City of Scottsdale ordinance, rule, or instruction
Any injury or damage I cause to myself, other persons, or property
Any claim brought by a third party arising from my conduct
I acknowledge and agree that the City of Scottsdale and Scottsdale Arts, as entities associated with the Venue, are intended third-party beneficiaries of this Agreement and may enforce this Agreement’s protections directly.
10. PERSONAL PROPERTY; LOSS, THEFT, AND DAMAGE
I understand and agree that I am solely responsible for my personal belongings, including but not limited to yoga mats, props, bags, phones, wallets, keys, jewelry, clothing, footwear, and other equipment. The Released Parties are not responsible for lost, stolen, or damaged property.
11. COMPLIANCE WITH RULES; REMOVAL
I agree to follow all posted rules, staff instructions, Venue policies, and applicable City of Scottsdale regulations. The Organizer and/or Venue may refuse entry or remove any attendee for safety reasons or policy violations, in their sole discretion.
12. PHOTO, VIDEO, AND MEDIA RELEASE
I grant the Organizer (and its designees) the irrevocable right to photograph, film, record, and otherwise capture my name, likeness, image, voice, and appearance at the event, and to use such content for marketing, promotional, educational, or commercial purposes, in any media now known or later developed, worldwide, in perpetuity, without compensation.
13. FORCE MAJEURE; CHANGED CONDITIONS
I acknowledge that outdoor conditions may change without notice, including weather, heat, air quality, wind, terrain, crowd size, event layout, and operational decisions. I accept all risks arising from such conditions and understand the Organizer may modify, pause, or cancel aspects of the event for safety or operational reasons, including at the direction of City of Scottsdale officials.
14. SEVERABILITY
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15. GOVERNING LAW; VENUE
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from this Agreement or the event shall be brought exclusively in Maricopa County, Arizona.
16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between me and the Released Parties regarding the subject matter and supersedes any prior understandings, whether oral or written.
17. DIGITAL SIGNATURE; ACKNOWLEDGMENT
I understand and agree that my acceptance on SweatPals constitutes a legal signature and is enforceable as if signed by hand.
By checking “I agree,” I affirm that:
I have read this Agreement in full
I understand its terms and the risks involved, including risks specific to yoga, breathwork, and outdoor event participation
I am in adequate physical condition to participate in the activities I choose to engage in, and if I am a parent or guardian registering a minor, I confirm the minor is also fit to participate
If registering on behalf of a minor, I am that minor’s parent or legal guardian and have the authority to bind the minor to this Agreement
I voluntarily accept and agree to be legally bound by this Agreement on my own behalf and, where applicable, on behalf of any minor in my care
