COMPREHENSIVE LIABILITY WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT

This Comprehensive Liability Waiver, Release of Claims, and Assumption of Risk Agreement ("Agreement") is entered into by the undersigned participant ("Participant") in favor of Olivia Santelli, LIV ITG, Rise Pilates Club, and the Chicago Park District, including their respective owners, officers, directors, employees, contractors, instructors, volunteers, sponsors, affiliates, successors, and assigns (collectively, the "Released Parties").

By signing this Agreement, Participant acknowledges and agrees to the following terms:

1. ASSUMPTION OF RISK
Participant understands that participation in Pilates classes, fitness instruction, wellness events, outdoor activities, and related programming (collectively, the "Activities") involves inherent risks, including but not limited to:
Physical injury (e.g., muscle strains, sprains, fractures, overexertion)
Slips, trips, and falls
Equipment-related injuries
Exposure to weather conditions (heat, cold, wind, sun)
Uneven or unpredictable outdoor terrain
Contact with other participants
Illness, including exposure to communicable diseases
Participant voluntarily assumes full responsibility for any risks, injuries, damages, or losses, whether known or unknown, foreseeable or unforeseeable, arising from participation in the Activities.

2. RELEASE AND WAIVER OF LIABILITY
Participant hereby knowingly, voluntarily, and expressly waives, releases, and forever discharges the Released Parties from any and all claims, liabilities, demands, causes of action, damages, costs, or expenses of any kind arising out of or related to participation in the Activities.
To the fullest extent permitted under Illinois law, Participant specifically acknowledges and agrees that this waiver is intended to be as broad and inclusive as permitted by the laws of the State of Illinois and expressly includes any claims based on the ordinary negligence of the Released Parties. Participant understands that this waiver is intended to satisfy the requirement under Illinois law that releases referencing negligence must do so clearly, explicitly, and unequivocally.
Participant further agrees that this waiver applies to any and all injuries, damages, or losses sustained as a result of any acts or omissions of the Released Parties, including but not limited to negligent instruction, supervision, maintenance of equipment, or conditions of the premises, whether indoor or outdoor.
Notwithstanding the foregoing, nothing in this Agreement is intended to waive or release claims arising from willful and wanton misconduct, reckless conduct, or any liability that cannot be waived under applicable Illinois law.

3. INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, or expenses (including attorneys’ fees) arising out of or related to Participant’s involvement in the Activities, including claims brought by third parties.

4. MEDICAL FITNESS AND HEALTH REPRESENTATION
Participant represents and warrants that they are physically fit and have no medical condition that would prevent safe participation in the Activities. Participant acknowledges that:
They have been advised to consult a physician prior to participation if they have any concerns
They are solely responsible for monitoring their physical condition
They will stop participation immediately if they experience pain, dizziness, or discomfort
Participant understands that the Released Parties are not medical professionals and do not provide medical advice.

5. EMERGENCY MEDICAL CARE
Participant authorizes the Released Parties to obtain emergency medical treatment on their behalf if deemed necessary. Participant agrees to be responsible for any costs incurred as a result of such treatment.

6. PERSONAL PROPERTY
Participant understands that the Released Parties are not responsible for any lost, stolen, or damaged personal property brought to the Activities.

7. PHOTO, VIDEO, AND MEDIA RELEASE
Participant grants the Released Parties the irrevocable right and permission to photograph, record, and use Participant’s likeness, voice, and image in any media, including marketing, advertising, and promotional materials, without compensation.

8. OUTDOOR AND PUBLIC SPACE ACKNOWLEDGMENT
Participant acknowledges that certain Activities may take place in public or outdoor spaces managed by the Chicago Park District. Participant agrees to comply with all applicable rules, regulations, and instructions and understands that such environments carry additional risks beyond controlled indoor settings.

9. NO GUARANTEES
Participant acknowledges that no guarantees have been made regarding fitness results, safety outcomes, or overall experience.

10. GOVERNING LAW AND SEVERABILITY
This Agreement shall be governed by the laws of the State of Illinois. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. BINDING EFFECT
This Agreement shall be binding upon Participant and their heirs, executors, administrators, and legal representatives.

12. ACKNOWLEDGMENT OF UNDERSTANDING
Participant acknowledges that they have read this Agreement carefully, fully understand its terms, and are signing it freely and voluntarily. Participant understands that they are giving up substantial legal rights, including the right to sue.
