WELLNESS EVENT WAIVER, RELEASE OF LIABILITY
& ASSUMPTION OF RISK AGREEMENT
Celebration Pointe Wellness Event | Gainesville, Florida
This Waiver, Release of Liability, and Assumption of Risk Agreement ("Agreement") is entered into by the
undersigned participant ("Participant") in connection with their voluntary participation in the Rise & Run Club
Wellness Event ("Event") held at Celebration Pointe, Gainesville, Florida.

1. PARTIES COVERED BY THIS AGREEMENT
By signing this Agreement, Participant agrees to release and hold harmless the following parties (collectively,
"Released Parties"):
• Rise & Run Club, LLC and all of its officers, directors, members, managers, employees, agents, and
representatives;
• Celebration Pointe and its owners, operators, affiliates, employees, and agents;
• All official Event sponsors, including but not limited to Nike, Fit2Run, and Celsius;
• All Event vendors, exhibitors, and their respective employees and agents;
• Any other individuals or entities associated with the organization or execution of the Event.

2. DESCRIPTION OF ACTIVITIES
Participant acknowledges that the Event includes, but is not limited to, the following activities: running,
jogging, walking, fitness demonstrations, wellness activities, product sampling, vendor interactions, and other
physical or recreational activities associated with a wellness and fitness event. Participant understands that
these activities carry inherent risks.

3. ASSUMPTION OF RISK
Participant voluntarily assumes all risks associated with participation in the Event, including but not limited to:
physical injury, illness, death, property damage, or other harm arising from participation in any activity at the
Event. Participant acknowledges that these risks may result from the negligence of the Released Parties or
from other causes, and Participant voluntarily accepts these risks.
These risks include, but are not limited to: overexertion, slipping, tripping or falling, contact with other
participants, adverse weather conditions, equipment failure, and physical conditions of the venue.

4. WAIVER AND RELEASE OF LIABILITY
In consideration for being permitted to participate in the Event, Participant, on behalf of themselves and their
heirs, executors, administrators, legal representatives, and assigns, hereby irrevocably releases, waives,
discharges, and covenants not to sue the Released Parties from any and all claims, demands, damages,
losses, liabilities, costs, or expenses of any nature whatsoever, whether known or unknown, arising out of or
in connection with Participant’s participation in the Event.
This release includes, without limitation, claims arising from the negligence of the Released Parties, except in
cases of gross negligence or intentional misconduct as prohibited by applicable law.

5. INDEMNIFICATION
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all
claims, actions, damages, liability, and expense, including attorneys’ fees, arising out of or in connection with
Participant’s participation in the Event, any breach of this Agreement, or any injury Participant may cause to a
third party during the Event.

6. MEDICAL AUTHORIZATION
Participant certifies that they are in adequate physical health and capable of participating in the Event
activities. Participant authorizes the Released Parties and Event medical personnel to obtain and administer
emergency medical treatment if Participant is unable to consent. Participant acknowledges that they are
solely responsible for any medical costs incurred.

7. PHOTO & MEDIA RELEASE
Participant grants the Released Parties a perpetual, royalty-free license to use any photographs, videos, or
other media captured at the Event in which Participant appears, for promotional, marketing, and social media
purposes, without compensation or further consent required.

8. GOVERNING LAW & SEVERABILITY
This Agreement shall be governed by the laws of the State of Florida. If any provision of this Agreement is
found to be unenforceable, the remaining provisions shall continue in full force and effect.

9. ACKNOWLEDGMENT
By signing below, Participant acknowledges that they have read and fully understand this Agreement, that
they are signing it voluntarily and freely, that they are 18 years of age or older (or a parent/legal guardian is
signing on behalf of a minor), and that no representations have been made to induce Participant’s
participation other than those set forth herein.
