PLUNGEWORX LLC – OFF-SITE EVENT LIABILITY WAIVER & RELEASE AGREEMENT

(Applicable to Run, Roast & Refresh at The Squeeze, Pensacola Beach)

PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT

By registering, I (“Participant”) acknowledge and agree to the following on behalf of myself, my personal representatives, heirs, next of kin, and assigns.

1. Acknowledgment of Event and Activities

I understand that I am voluntarily participating in Run, Roast & Refresh hosted at The Squeeze on Pensacola Beach, facilitated by PlungeWorx LLC. I acknowledge that this Event may include one or more physical and wellness-based activities (collectively, the “Activities”), including but not limited to:
	•	an optional outdoor run/walk;
	•	cold plunge therapy and hot plunge therapy;
	•	stretching or mobility exercises;
	•	guided breathwork sessions;
	•	general wellness demonstrations;
	•	music, DJs, and vendor interactions;
	•	the consumption of non-alcoholic food and beverages provided or made available during the Event.

2. Assumption of Risks (Including Cold Plunge-Specific Risks)

I understand that participation in the Activities involves inherent and potentially serious risks, which may include, but are not limited to:
	•	slips, trips, and falls on wet, sandy, or uneven surfaces;
	•	hazards from traffic, weather, or environmental conditions during the run;
	•	sudden loss of balance or consciousness;
	•	cold-induced physiological responses, such as shock to the nervous system, rapid changes in blood pressure, cardiac arrest, arrhythmia, hypothermia, shortness of breath, and respiratory distress;
	•	muscle, ligament, tendon or joint injuries;
	•	fainting, dizziness, or nausea;
	•	allergies or adverse reactions to materials or substances used in or around the plunge equipment or food/beverages provided;
	•	injuries arising from misuse or failure of any equipment or facility;
	•	actions or negligence of other Event participants, vendors, DJs, or members of the public at the Event location.

I hereby knowingly and voluntarily assume all risks—both known and unknown—including those that may result from the negligence of the Released Parties.

3. Release and Waiver of Liability

In consideration of being permitted to participate in the Event and Activities, I hereby irrevocably release, waive, discharge, and hold harmless PlungeWorx LLC, its owners, officers, employees, agents, representatives, contractors, volunteers, insurers, successors and assigns, as well as The Squeeze on Pensacola Beach and its owners and staff (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, liabilities, expenses, or costs of any kind (including attorney’s fees and medical expenses) arising out of or in any way related to my participation in the Event and Activities—including claims arising from the ordinary negligence of any Released Party.

This release expressly includes, but is not limited to, any claims for personal injury, property damage, illness, infection, or wrongful death.

4. Indemnification

I agree to indemnify and defend the Released Parties against any and all losses, liabilities, damages, or expenses (including attorney’s fees) arising out of, related to, or in connection with (a) my participation in the Event and Activities, and/or (b) my breach of this Agreement.

5. Medical Representation and Emergency Care

I represent that I am in good health and have no physical or medical condition that would prevent me from safely participating in the Activities. I understand that PlungeWorx LLC does not provide medical evaluation, treatment, or supervision during the Event.
In the event of a medical emergency, I authorize PlungeWorx LLC to obtain emergency medical care on my behalf and understand that PlungeWorx LLC shall have no liability or responsibility for any such medical decisions or treatment.

6. Third-Party Premises & Vendors

I acknowledge that the Event takes place at The Squeeze on Pensacola Beach, which is a third-party location not owned or controlled by PlungeWorx LLC. I understand that any food or beverage samples offered at the Event are provided by independent vendors, not by PlungeWorx LLC. I assume all risk of consumption and release PlungeWorx LLC from any liability related to food or beverage consumption. I agree that PlungeWorx LLC is not responsible for and shall not be held liable for any condition of the Event premises or for any acts or omissions of the venue owner, staff, vendors, DJs, or the general public present at the Event location.

7. Insurance

I understand that event liability insurance has been secured for general coverage, but that this does not replace or reduce my assumption of personal risk or the waivers contained in this Agreement.

8. Severability

If any portion of this Agreement is held to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

9. Entire Agreement

This Agreement contains the entire understanding between the parties and supersedes any prior oral or written agreements regarding the subject matter herein. No modification of this Agreement shall be enforceable unless in writing signed by PlungeWorx LLC.

BY REGISTERING FOR THIS EVENT, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND VOLUNTARILY AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE. I REGISTER FREELY AND VOLUNTARILY.
