GENERAL LIABILITY WAIVER AND RELEASE FORM
BY ACKNOWLEDGING THIS EVENT LIABILITY WAIVER AND RELEASE FORM, I acknowledge and
agree that I am voluntarily participating in a group fitness session (the “Event”) hosted by CityPlace Retail, L.L.C.
and CityPlace Hotel, LLC (collectively, “Host”) that may involve flexibility, strength, aerobic, cardio and other
exercises (“Activities”), all of which can be potentially hazardous. I am voluntarily agreeing to participate in the
Event and I hereby agree to expressly assume and accept any and all risks of injury, physical harm or death. I
acknowledge and represent that I am physically sound and I do not suffer from any illness, impairment, disease or
other condition that would prevent me from participating in the Event, performing any exercises or using any
equipment. I agree that if I experience any pain or discomfort, I will immediately inform the instructor/practitioner
and/or adjust my movements to my level of comfort or I will end my participation in the Event.
I acknowledge that the Event may be held either outdoors or at a space which carries additional inherent risks,
including, but not limited to, those caused by exposure to heights, terrain, facilities, temperature, weather,
environment, lack of hydration and/or actions of other people, including but not limited to, participants, spectators
and instructors.
Waiver & Release: In consideration of being allowed to participate in the Event, I do hereby knowingly and
voluntarily, on behalf of myself and my heirs, executors, administrators, successors and assigns, forever waive,
release, discharge and hold harmless Host, The Related Companies, L.P., Related Southeast LLC, Wells Fargo &
Company, Bank Hapoalim, Alliance Bernstein Holding L.P., The Related Companies, Inc. and each of their
subsidiaries and affiliates, and each of their respective officers, directors, employees, agents, representatives,
successors, assigns (collectively, the “Released Parties”) from any and all liability, damages, losses, suits, demands,
causes of action (including, without limitation, negligence), expenses (including attorneys’ fees or medical
expenses) or any other claims of any nature whatsoever, including, without limitation, any losses for property
damage, personal injury or death, arising out of or relating in any way to my participation in the Event and its related
programs and activities or my use of any facilities, equipment or machinery in connection with the Event, except to
the extent of the willful misconduct or gross negligent acts or omissions of any of the Released Parties.
I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident,
and/or illness during the Event. I understand and acknowledge that the Released Parties are not liable for any losses
or costs incurred as a result of any such medical services obtained, or for the quality of the care or services rendered.
In addition, I understand that the Event may be filmed and/or photographs may be taken in which an image of me
may be captured. I hereby irrevocably consent to the publication and use of such video or photograph of me and/or
my likeness for the purpose of promotion, publicity, advertising, or other manner or media by a Released Party
including publication on the internet, in brochures, or any other advertisements or promotional materials. I hereby
waive all rights to privacy or compensation that I may have in connection with the use of the above-mentioned
material for any of the said purposes. Further, I hereby waive my right to inspect or approve the finished product
and I discharge the Released Parties from payment of royalties and from any demand, claim, suit, or liability
including but not limited to, claims for libel, defamation, or invasion of privacy resulting from by participation and
use of the above-mentioned materials.
I represent and acknowledge that I (i) am at least eighteen (18) years of age; (ii) fully competent to sign this
release on my own behalf; (iii) have read and understand this General Liability Waiver and Release Form;
and (iv) understand that my voluntary agreement evidences my consent to the terms, provisions, waivers,
and releases as set forth above. The invalidity, in whole or in part, of any portion of the above paragraphs
will not affect the remainder of this form.
