WE RUN KINGS aka TeamWRK WAIVER OF LIABILITY FORM

I agree that I am a member of WE RUN KINGS aka TeamWRK Inc and I know that running and volunteering for organized group runs, social events, and races with this club are potentially hazardous activities, which could cause injury or death. I will not participate in any club organized events, group training runs, or social events unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform all activities associated with the club and am in good health, and I am properly trained. I agree to abide by all rules established by the club, including the right of any official to deny or suspend my participation for any reason whatsoever. I attest that I have read the rules of the club and agree to abide by them. I assume all risks associated with being a member of this club and participating in club activities which may include: falls, contact with other participants, the effects of the weather, including high heat and/or humidity/cold conditions, traffic, and the conditions of the road, all such risks being known and appreciated by me. I understand that personal music players, headphones, airpods used for music, listening to speeches, podcasts, telephone conversations at any capacity are inherently hazardous and I take full responsibility for any harm that could be potentially caused by using such devices. I understand that use of these devices for any reason is to be used AT MY OWN RISK and absolve We Run Kings, LLC, TeamWRK Inc, of any club organized activities and I agree to abide by this rule. Having read this waiver and knowing these facts and in consideration of your accepting my membership, I, for myself and anyone entitled to act on my behalf, waive and release WE RUN KINGS AKA TeamWRK, We Run Kings, LLC, TeamWRK Inc, all club sponsors, their representatives and successors from all claims or liabilities of any kind arising out of my participation with the club, even though that liability may arise out of negligence on the part of the persons named in this waiver. I grant permission to all of the foregoing to use my photographs, motion pictures, recordings, or any other record for any legitimate promotional purposes for the club.

Injury Policy
In the event of an injury, We Run Kings aka TeamWRK has a process in place to support your recovery and return to running:
1. Refer to Medical Professional: 
If necessary, we will refer you to a suitable medical professional for further evaluation and treatment.
2. Provide Guidance to Safely Return to Running:
Modified Training Plan: We will create a customized training plan to help you gradually return to running while considering your injury.
3. Offer Support: Throughout your recovery, we will offer continuous support to address any concerns or adjustments needed.
4. Membership Options if Injury Lasts Longer Than 4 Weeks:
a. You may choose to downgrade your membership to the Affiliate Membership tier at a prorated value until you return to training. 
b. Any remaining balance can be used as a pause to your training plan and/or credited to your TeamWRK account a prorated basis (if you purchased a 16-week, 24-week, or annual plan) until you return to training. This credit can be used for training and/or TeamWRK shop merchandise.
c. In rare instances, for instance, if you become injured within the first week of training, we may offer a full refund of your training plan.

Scenario 1: 
Katie suffered a stress fracture and was required to be in a boot for at least 6 weeks. She was offered an affiliate plan for 6 weeks with a return to running (modified) plan for the remainder of the season. Upon return to running (modified plan), she resumed to payments regular (non-reduced) costs. 

Scenario 2:
Henry has been having recurrent injuries for the past two seasons and decided to take a pause to address his issues. His training plan was paused, but he will continue to have access to team communications, including Heylo, until he has been cleared for a return to running. 

Scenario 3:
Bob fell down the stairs during his first week of training and broke his arm. He will be in a cast for the majority of the training season and may need surgery. He was offered a full refund. 

Failure to Pay Policy
Unless notified of financial hardship, failure to pay membership dues or any associated fees will result in immediate removal from team communications, including Heylo. Members will be notified of any outstanding payments, and if not resolved within the specified timeframe, their membership will be suspended until payment is received. Continuous failure to resolve outstanding payments may lead to permanent removal from the team.
When notified of financial hardship, TeamWRK may offer a full or part-time scholarship for membership dues on a case-by-case basis for a specified timeframe determined by both parties, member and TeamWRK staff.

**Terms and Conditions:**
1. The risk of injury from the activities in this training program is significant, including permanent paralysis and death, and while specific rules, equipment, and personal responsibility may reduce the risk of serious injury, I knowingly and freely assume all such risks, known and unknown, even those arising from the negligence of others, and I assume full responsibility for my participation (and child's participation). I assume full responsibility for any consumption or sampling or products. The risk of injury from participating with a stroller is significant and I assume full responsibility. The risk of injury from participating while using handheld devices or devices attached to ears such as headphones, AirPods, playing videos or music, podcasts, speeches, movies, or any streaming content is significant and I assume full responsibility. The use of such devices is discouraged by Coaches, officers, employees, servants, volunteers, ambassadors, representatives, and agents.
2. I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual significant hazard during participation, I understand that it is my responsibility to remove myself from participation and bring such to the attention of the nearest official immediately.
3. I, for myself, and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby RELEASE, INDEMNIFY AND HOLD HARMLESS, We Run Kings, LLC, TeamWRK, Inc, officers, employees, servants, volunteers, representatives, and agents from and against any and all claims, losses, damages, expenses (including attorneys’ fees, and all court and litigation costs) and liability (including statutory liability), resulting from injury and/or death of any person or damage to or loss of any property arising out of or in any way connected with this activity and my participation therein.
4. I understand that I am solely responsible for any and all expenses related to injuries and/or loss or damage of personal property incurred in connection with my participation in the activities in this program.
5. I agree that photographs, whether still or action, videos, film and/or motion pictures (hereinafter “Pictures”), and/or audio recordings (“Recordings”), may be taken of me by or on behalf of We Run Kings, LLC and/or TeamWRK Inc., and in connection with these Activities, and, without any compensation or further notification or approval by me, grant to We Run Kings, LLC, and/or TeamWRK Inc., its agents, employees, and others working on We Run Kings and/or TeamWRK behalf of (“ We Run Kings, LLC and/or TeamWRK, Inc. ”) the unlimited, perpetual, worldwide, unconditional and irrevocable right and license to use, distribute, publish, exhibit, digitize, broadcast, display, reproduce, make commercial use of and otherwise use directly or indirectly the Pictures, Recordings and/or my image, voice, likeness and/or video footage in any form, format or media (“Media”), for any purpose, including but not limited to advertising or trade or RACE-related, or Training Related activity in promoting or providing information about We Run Kings, LLC and/or TeamWRK, Inc., and its running events and agree that all rights therein shall irrevocably, exclusively, unconditionally and perpetually belong to We Run Kings, LLC and/or TeamWRK, Inc. I agree to We Run Kings, LLC and/or TeamWRK, Inc. using my image and likeness to promote and advertise in video and print format on all social media platforms (Instagram, Facebook, Twitter, etc.), their website, and worldwide internet.*
* PUMA Endorsement Grant Terms & Conditions During the Term, January 1, 2022-December 31, 2024, with the eligibility for renewal beyond above timeframe, TeamWRK grants to PUMA the non-exclusive, royalty free, worldwide right and license to use TeamWRK's name, and any associated trademarks, logos, or slogans of the TeamWRK and will secure the rights for PUMA to use the name, or part thereof, nickname, likeness, voice, photograph, signature or facsimile thereof, biographical material, statements, and any similar materials or description and activities containing or relating to its Members. TeamWRK shall secure the Endorsement rights of Members by ensuring that each Member to participate in a PUMA or TeamWRK sanctioned activity or event. The Endorsement may be used by PUMA in connection with the advertising, sale, promotion, distribution, marketing, and PR/media outreach of PUMA Products (as defined below) throughout the world in any media, including but not limited to PUMA's online properties, website, social media channels and blogs as well as above and below the line marketing worldwide during the Term; provided, that such use of Run Crew's name, image and/or likeness have been approved by TeamWRK in advance. PUMA shall provide a request to use twenty four (24) hours prior to any use of TeamWRK's name, image, and/or likeness, if after which no response is received, then TeamWRK's approval shall be deemed given. Any such notice may be provided in electronic form (i.e., e-mail). TeamWRK understands and agrees that any materials (without limitation, advertising, marketing, and/or promotional) produced hereunder using TeamWRK's Endorsement will be and remain the absolute property of PUMA forever, but any use of the materials by PUMA following the termination or expiration of this Agreement shall be limited to internal and/or archiving purposes only. 
Please note that explicit permission may be requested for use of likeness on mediums beyond Instagram, TikTok, Twitter, Facebook.
6. I hereby agree to release and discharge We Run Kings, LLC and/or TeamWRK, Inc., its officers, representatives, employees, agents, licensees, successors, and assigns from any and all claims, demands, or causes of action that I may now have or may hereafter have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or violation of any other right arising out of or relating to any utilization of the Pictures, Recordings, or Media.
7. Please note that event times are subject to change at any time. 
8. I hereby warrant that I am eighteen (18) years of age or older and competent to contract in my own name insofar as the above is concerned or that if I am under eighteen (18) years of age, my parent or legal guardian has reviewed and signed this release of liability and assumption of risk agreement. 
9. I have read this release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
