Participant acknowledges and agrees that he or she has voluntarily elected to participate in an activity,
demonstration, event, promotion, training, or other program (the “Event”), which may be sponsored,
hosted, organized, or otherwise supported by one or more of the Released Parties (defined below).
Participant understands and agrees that the Event may involve physical exertion, the use of equipment,
demonstrations, interactive components or other conditions that may pose risks of injury.
Participant hereby assumes all risks of participation in the Activity, wherever conducted (whether on
property owned or controlled by a Released Party or otherwise), including, without limitation: (i) risks
arising from the negligence or carelessness of any of the Released Parties; (ii) risks relating to dangerous,
defective, or unsafe equipment, facilities and conditions; and (iii) risks inherent in the Event itself,
including the potential for serious injury, disability and death.
Participant further acknowledges that no medical, emergency, or other assistance is guaranteed or
promised by the Released Parties. If any such assistance is provided, Participant consents to the same and
agrees that the Released Parties shall not be liable for the manner or adequacy of such assistance.
Participant assumes all responsibility for medical expenses incurred as a result of participation in the
Event and waives any right to claim such expenses from Released Parties.
Participant and Participant’s parent or legal guardian, if Participant is under age 18, on behalf of
themselves and and their executors, administrators, heirs, next of kin, successors, and assigns, hereby
agrees as follows:
1. TO FOREVER WAIVE, RELEASE AND DISCHARGE the Released Parties from any
and all liability for Participant’s death, disability, personal injury, property damage, property theft
or any other loss, claim or cause of action of any kind arising out of or relating to the Event;
2. TO INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all
liabilities, claims, demands, actions or causes of action arising out of or connected in any way
with Participant’s participation in the Event, whether cause in whole or in part by the negligence
of the Released Parties or otherwise; and
3. TO PROMISE, COVENANT AND AGREE NOT TO SUE any of the Released Parties
for any claim released herein.
For purposes of this Agreement, the “Released Parties” include: Scheels All Sports, Inc., its parents,
subsidiaries and affiliates (collectively,
“Scheels”); any licensee, distributor, supplier, sponsor, promoter,
and advertising or promotion agency of Scheels or of the Event; and all officers, directors, shareholders,
employees, volunteers, representatives, agents or contractors of any of the foregoing, as well as any other
party acting under their direction or control.
Participant agrees that this release and waiver shall be construed broadly to provide a release and waiver
to the maximum extent permitted by applicable law. If any portion of this Agreement is found to be
invalid, the remainder shall continue in full force and effect.
Participant further grants to the Released Parties the unrestricted right to photograph, film, record, or
otherwise capture Participant’s image, voice, likeness, appearance, actions and statements in connection
with the Event, and agrees that the Released Parties shall own all rights in such materials and may use
them in any manner and in perpetuity, without compensation to Participant.
Participant acknowledges that he or she has carefully read this Release, Waiver of Liability and
Agreement to Indemnify, fully understands its terms and signs it voluntarily.
