ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNITY, AND MEDIA CONSENT

1) PARTICIPANT INFORMATION

You are registering to participate in the Scottsdale Turkey Trot & Wellness Experience on November 27, 2025 (the “Event”). The Event includes running/walking (5K-style), group fitness classes, a recovery area, sauna, cold plunge, vendor market, food and beverage offerings, live music/DJ, and arts & crafts. These are referred to collectively as the “Activities.”

2) RELEASED PARTIES

“Released Parties” include:
• Scottsdale Run Club LLC, Revival Wellness Experience LLC, Phoenix Run Club Inc, and BLK Arizona Event Group LLC and their respective owners, members, officers, directors, employees, contractors, volunteers, insurers, sponsors, partners, vendors, and affiliates.
• The Scottsdale Resort & Spa and its ownership/management, including 7700 E McCormick Parkway, Scottsdale, LLC, Driftwood Hospitality Management, LLC, Driftwood Capital, and any Hilton/Curio Collection affiliates, as well as their respective owners, officers, directors, employees, agents, and insurers.
• The City of Scottsdale, Salt River Project Agricultural Improvement and Power District, and Salt River Valley Water Users’ Association, McCormick Ranch Property Owners' Association, Inc., and their respective departments, agencies, employees, officers, agents, and representatives.
• Any city, county, or other governmental entity having jurisdiction, and any medical or emergency service providers supporting the Event.

3) ASSUMPTION OF RISK

Participation involves inherent risks, including but not limited to:
	•	Slips, trips, or falls; collisions with other participants, spectators, or objects.
	•	Exposure to weather, heat, or cold; dehydration; exhaustion; cardiac or respiratory events.
	•	Risks from sauna use (elevated temperature, dizziness, dehydration) or cold plunge (shock, hypothermia, vasoconstriction).
	•	Food-borne illness or allergic reactions.
	•	Electrical hazards from event equipment, sound systems, or lighting.
	•	Noise exposure, strobe lights, or other sensory triggers.
	•	Limited availability of immediate medical care.

I understand these risks and accept full responsibility for my participation, including any injury, illness, or property loss that may occur.

4) HEALTH & SAFETY

I represent that I am physically able to participate safely in the Event. I understand it is my responsibility to consult a physician before participating. I agree to follow all Event rules, posted signs, and staff instructions. I will not attend if I am sick or contagious.

5) WAIVER & RELEASE OF LIABILITY

To the fullest extent permitted by Arizona law, I hereby release and hold harmless all Released Parties from any and all claims, damages, losses, or liabilities arising out of or related to my participation or attendance, including those resulting from the ordinary negligence of any Released Party.
This release does not apply to acts of gross negligence or willful misconduct.

6) INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from any claims or expenses (including attorneys’ fees) brought by me or any third party arising from my participation, conduct, or failure to follow Event rules.

7) MEDICAL CONSENT

I consent to receive medical treatment deemed advisable in the event of injury, accident, or illness. I accept full responsibility for any medical costs incurred.

8) PERSONAL PROPERTY & VENDORS

I am responsible for my personal belongings. I understand that vendors are independent and solely responsible for their products, food, or services.

9) PHOTO, VIDEO & MEDIA CONSENT

I grant the Released Parties permission to use my image, voice, and likeness for promotional or commercial purposes in any media, without compensation.

10) MINORS (KIDS TICKET HOLDERS)

If registering a minor (under 18), I certify that I am the minor’s parent or legal guardian and have the authority to accept this waiver on their behalf.
I understand that some Activities (including sauna and cold plunge) may have age restrictions and that minors must be supervised at all times by a responsible adult.
By registering a child, I accept all risks and liabilities on behalf of the minor participant.

11) CONDUCT & EVENT POLICIES

I agree to behave respectfully toward others and to comply with all venue and Event rules. Event organizers reserve the right to remove anyone for unsafe or disruptive behavior.

12) WEATHER, CANCELLATION & FORCE MAJEURE

The Event may be delayed, modified, or canceled for weather, safety, or reasons beyond the organizers’ control (e.g., acts of God, venue issues, government orders). All sales are final unless otherwise required by law.

13) GOVERNING LAW

This agreement is governed by the laws of the State of Arizona. Any disputes shall be resolved exclusively in Maricopa County, Arizona.

14) ELECTRONIC ACCEPTANCE

By checking the box below, I acknowledge that I have read, understood, and agree to the terms of this Assumption of Risk, Release of Liability, Indemnity, and Media Consent.
I affirm that I am at least 18 years of age and legally competent to agree to this waiver, or that I am the parent/legal guardian of a participant under 18 and have full authority to accept these terms on their behalf.
I understand that my electronic acceptance has the same legal effect as a handwritten signature.
