WAIVER AND RELEASE OF LIABILITY, VOLUNTARY ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

I, ____________________________, being over the age of eighteen, as a participant and/or a parent or legal guardian of ____________________________, a minor child participant (the “Minor Child”), and/or on my own behalf or the Minor Child’s behalf, as applicable (the “Participant”), for and in consideration of Participant’s (a) participation in and use of any of the cold plunges, saunas, showers, red light therapy, and other services oCered by Soft Sand LLC, a California limited liability company d/b/a Likeminded wellness studio (“Studio”) and use of equipment supplied or used therewith (collectively, the “Services”) located at 116 Washington Blvd, Marina Del Rey, CA 90292 (the “Premises”), and (b) being permitted to enter onto the Premises (such participation in the Services and entry into the Premises, collectively, “Participation”), to the fullest extent permitted by applicable laws, hereby enter this WAIVER AND RELEASE OF LIABILITY, VOLUNTARY ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ( the “Agreement”).

1. CERTAIN ACKNOWLEDGMENTS AND REPRESENTATIONS.

(a) Risks. I fully understand that Participation represents a test of physical and mental limits, and involves known and unknown risks that are beyond the control of the Released Parties (defined below), and that may not be reasonably foreseeable at this time, including but not limited to risks associated with exposure to extreme heat, cold, light, and water; infectious and/or communicable diseases including COVID 19 and its variants; and other conditions, that may result in serious bodily injury, including but not limited to cardiac incidents, heart attacks, muscle strains, burns, hypothermia, dizziness, illness, other physical conditions, paralysis; permanent disability; and death.
