WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (THE “AGREEMENT”) CONTAINS A WAIVER OF YOUR RIGHT TO SUE, A RELEASE OF ALL CLAIMS, AS WELL AS OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ ALL OF THE PROVISIONS OF THIS AGREEMENT VERY CAREFULLY.
WAIVER:
In return for being permitted to participate in classes, events, workshops, and all associated activities at Dharma Healing Sanctuary, including the use of premises, facilities, staff, and equipment (collectively, the “Activity”), I, for myself and for my heirs, representatives, executors, administrators, successors, assigns, and any other person or entity acting on my behalf or on behalf of my estate, do hereby release, waive, discharge, and promise not to sue the Released Parties (as defined below) for any claim, damages, or liability, including those arising from the negligence of the Released Parties, in connection with my participation in the Activity. This includes, but is not limited to, personal injury (including death), accidents or illnesses, and loss or damage to personal property.
The term “Released Parties” includes Dharma Healing Sanctuary LLC, its owners, sponsors, advertisers, service and treatment providers, instructors, facilitators, event hosts, and all persons involved in the facilitation of the Activity, as well as the owners and lessors of the premises where the Activity is held, and all officers, directors, employees, partners, and shareholders of any of the foregoing.
DESCRIPTION OF ACTIVITY:
Activity Name: Classes, Events, and Workshops at Dharma Healing Sanctuary
Activity Description: Activities include, but are not limited to, yoga, stretching, breathwork, meditation, dance, sound healing, pilates, mobility training, fitness exercises, energy healing, sauna, cold plunge, hot tub, group ceremonies, holistic wellness practices, and other movement-based, meditative, or therapeutic experiences.
ASSUMPTION OF RISKS:
I acknowledge and agree that participation in the Activity is completely voluntary and that it involves inherent risks that cannot be completely eliminated, regardless of the care taken to avoid them. These risks include, but are not limited to:
• Muscle strains, sprains, and other physical injuries
• Overexertion and exhaustion
• Dizziness or loss of balance
• Joint and bone injuries
• Risks associated with pre-existing medical conditions
• Exposure to COVID-19 or other communicable diseases
• Risks associated with exposure to high temperatures in the sauna or hot tub, including heat exhaustion, dehydration, and fainting
• Risks associated with cold exposure in the cold plunge, including hypothermia, dizziness, and shock
• Emotional, energetic, or spiritual effects that may arise from participation in meditation, breathwork, sound healing, or other holistic practices
By signing this Agreement, I confirm that I am in good health and physically and mentally able to participate. I assume all risks associated with my participation.
INDEMNIFICATION AND HOLD HARMLESS:
I agree to indemnify, defend, and hold the Released Parties harmless from and against any and all claims, actions, suits, procedures, costs, expenses (including attorney fees), damages, and liabilities that may arise from my participation in the Activity.
REPRESENTATION OF AGE:
I hereby represent and warrant that I am at least 18 years of age or have the consent of my legal guardian.
SEVERABILITY:
If any portion of this Agreement is held invalid, the remaining portions will continue to have full legal force and effect.
GOVERNING LAW:
This Agreement shall be governed by and construed in accordance with the laws of the state in which the Activity is held.
ACKNOWLEDGMENT OF UNDERSTANDING:
I have read this entire Agreement, understand its terms, and voluntarily agree to its provisions.
