Release Voluntary Participation & Release. I certify that I am in good health and able to participate in the physical activity offered and have not been diagnosed with any condition that would impair my ability to participate or that would endanger the health or safety of others participating in the program. I acknowledge that with any physical activity there may be risk of injury or other loss from my participation or from the actions, inactions or negligence of others. I voluntarily assume all risk of injury, illness, loss or impairment including death or property damage (“Loss”) arising out of or connected in any way with my participation. I assume full responsibility for any damages that may occur to me or that I may cause in, on or about the premises of the Provider and I hereby release, indemnify, acquit and forever discharge Lesa George aka Fit & Fierce Soca Aerobics aka (the “Provider”), from any and all claims, demands, losses, liabilities, obligations and/or causes of action of whatever kind or nature, whether known or unknown, which may hereafter be made arising out of or related to my participation. I assume this risk on my own behalf and on behalf of my successors, personal representatives, heirs, assigns and for any and all others claiming through on behalf of me or them (“Releasors”). In the event the participant is a minor and requires medical attention while participating in any physical activity at the Provider, I authorize such treatment and agree to be financially responsible for any related costs. Materials Release. I hereby grant the Provider the absolute right and permission to use, sell, publish, duplicate, disseminate, broadcast, display and exhibit electronically or in print my picture, name, likeness, video, recorded verbal statement and other audio communications or likeness in the current form or as retouched, digitized, or altered or modified in any way (the “Materials”). I assume the sole risk for any loss or harm related to authority granted herein and hereby for myself and Releasors do waive and release any and all rights, claims, liabilities, losses, damages, costs, expenses (including attorneys' fees), and causes of action whatsoever that I or they may now or in the future have against the Provider for any matter, cause or thing whatsoever with respect to the Materials, including without limitation any and all liability for Loss, damage or harm due to invasion of privacy, confidentiality, defamation, copyright, right of publicity and the like. I acknowledge I will not receive compensation of any type associated with the Materials and agree that publication of the Materials confers no right of ownership or royalties whatsoever and that any commercial rights to the Materials or anything derived therefrom will be owned solely by the Provider. To serve you best, the Provider may contact you by mail, telephone (including wireless, cellular or VOIP accounts associated with your account and by automated dialing equipment and/or pre-recorded messages regardless of whether you incur charges as a result), or e-mail regarding your account, promotions, services and/or benefits. If any of the provisions of this Release are construed to be invalid or unenforceable, it shall not affect the legality or validity of any other provisions or its enforceability and all other provisions shall continue in full force and effect.
