SOCA•LATES & SCULPT
Participant Waiver, Release of Liability & Assumption of Risk
Please read carefully before participating

This Waiver and Release of Liability ("Agreement") is entered into by the undersigned participant ("Participant") in connection with their voluntary participation in Soca•lates & Sculpt fitness classes, events, and pop-up sessions (collectively, "Classes") organized and instructed by Seraiah Smith, Founder of Soca•lates & Sculpt, also known as The Health Science Hottie.

1. Description of Activity
Soca•lates & Sculpt classes combine elements of Pilates, dance-inspired movement, and Soca music. Classes may include mat-based exercises, bodyweight training, resistance work, and rhythmic movement sequences. These activities carry inherent physical risks including but not limited to muscle strain, joint injury, sprains, and cardiovascular exertion.

2. Assumption of Risk
The Participant acknowledges and voluntarily assumes all risks associated with participation in Soca•lates & Sculpt Classes, including but not limited to:
1. Physical injury, illness, or discomfort arising from exercise
2. Aggravation of pre-existing medical conditions
3. Risks associated with the physical environment of the venue
4. Contact with equipment, mats, or other participants
5. Cardiovascular and musculoskeletal stress from physical activity
 
3. Release of Liability
In consideration for being permitted to participate in Soca•lates & Sculpt Classes, the Participant hereby releases, waives, discharges, and covenants not to sue Seraiah Smith, also known as The Health Science Hottie (Soca•lates & Sculpt), its instructors, collaborators, event venues, sponsors, volunteers, and affiliated parties (collectively, "Released Parties") from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the Participant, whether caused by the negligence of the Released Parties or otherwise.

4. Medical Acknowledgment
The Participant affirms that they are in good physical condition and have no medical conditions, injuries, or disabilities that would prevent or limit their safe participation in physical fitness activities. The Participant agrees to consult a licensed physician before participating if they have any concerns about their physical readiness. The Participant accepts full responsibility for their health and safety during Classes.

5. Instructor’s Right to Modify or Remove
The Participant acknowledges that the instructor reserves the right to modify class programming for safety purposes and to ask any participant to stop or leave the session if their behavior poses a risk to themselves or others.

6. Photo & Video Consent
The Participant grants permission to Soca•lates & Sculpt and The Health Science Hottie to photograph and/or record video during Classes and events for use on social media, marketing materials, and promotional content. If the Participant does not consent to being photographed or recorded, they must notify the instructor in writing prior to the Class.

7. Indemnification
The Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, cost, or expense (including attorney’s fees) arising out of the Participant’s participation in Soca•lates & Sculpt Classes.

8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from this Agreement shall be resolved in the appropriate courts of Harris County, Texas.

9. Acknowledgment
By signing below, the Participant confirms that they have read and fully understand this Agreement, that they are signing it voluntarily, and that they are 18 years of age or older (or have the consent of a parent or legal guardian if under 18).
