PARTICIPANT WAIVER, RELEASE OF LIABILITY & MEDIA RELEASE

PLEASE READ THIS WAIVER CAREFULLY BEFORE PARTICIPATING IN THIS EVENT. BY REGISTERING FOR AND/OR ATTENDING THE SOL SISTER SCULPT SUNDAY EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS DOCUMENT.

1. ACKNOWLEDGMENT OF RISK
I, the participant, acknowledge and fully understand that participation in Pilates, group fitness activities, craft activities (including bag charm creation), and all associated activities at the Sol Sister Sculpt Sunday event on August 2, 2025, involves inherent risks, including but not limited to: physical exertion, musculoskeletal strain or injury, cardiovascular stress, falls, and other risks associated with physical fitness and recreational activities.
I further acknowledge that the activities will take place at 1920 Ybor, Tampa, FL, and that I am voluntarily participating with full knowledge of the risks involved.

2. HEALTH & FITNESS DISCLAIMER
I represent and warrant that I am in good physical health and have no medical conditions that would prevent me from safely participating in a 45-minute mat Pilates class or any other activity offered at this event. I understand that it is my sole responsibility to consult with a physician or licensed healthcare provider before participating if I have any health concerns, medical conditions, recent injuries, surgeries, or am pregnant.
I agree to inform the instructor of any physical limitations, injuries, or health conditions prior to the start of class. I understand that the instructor is not a licensed medical professional and that any modifications provided are general fitness guidance only, not medical advice.

3. RELEASE OF LIABILITY
In consideration of being permitted to participate in the Sol Sister Sculpt Sunday event, I, on behalf of myself, my heirs, personal representatives, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Pilates With Heather, Heather (hereinafter "Instructor"), sol·kin, 1920 Ybor, and each of their respective owners, operators, employees, agents, officers, directors, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in this event or while on or near the premises where the event is conducted.
This release includes, but is not limited to, claims arising from the negligence of the Released Parties, defective equipment, inadequate supervision, craft materials, food and beverage consumption, or any other cause whatsoever.

4. ASSUMPTION OF RISK & INDEMNIFICATION
I voluntarily assume all risks associated with participation in this event, whether known or unknown, including all risks of injury or illness. I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, cost, or expense (including reasonable attorneys' fees) which they may incur due to my participation in this event, whether caused by the negligence of the Released Parties or otherwise.

5. PERSONAL PROPERTY
I understand and agree that the Released Parties are not responsible for loss, theft, or damage to my personal property, including but not limited to clothing, accessories, electronic devices, vehicles, and any other items brought to the event.

6. FOOD, BEVERAGE & CRAFT MATERIALS
I acknowledge that food, beverages, and craft materials may be available at this event. I understand that it is my responsibility to disclose any food allergies, dietary restrictions, or sensitivities to event staff prior to consuming any food or beverages. I release the Released Parties from any liability related to allergic reactions, dietary concerns, or reactions to craft materials used during the bag charm station activity.

7. MEDIA RELEASE & CONSENT
I hereby grant to Pilates With Heather, Heather, sol·kin, and their respective designees (collectively, "Content Holders") the irrevocable, royalty-free, worldwide, perpetual right and license to photograph, video record, film, or otherwise capture my image, likeness, voice, and/or performance during the Sol Sister Sculpt Sunday event on August 2, 2025.

I authorize the Content Holders to use, reproduce, edit, distribute, publish, and display such photographs, video recordings, and other media content in any and all media formats, now known or hereafter developed, including but not limited to:
Instagram, TikTok, Facebook, YouTube, and other social media platforms Websites, blogs, and digital platforms
Promotional and marketing materials for future events
Press releases, newsletters, and other publications
I understand that I will not receive compensation for this use and that the Content Holders are not required to use my image or likeness. I waive any right to inspect or approve the finished product in which my image, likeness, or voice may appear.

If you do NOT consent to being photographed or recorded, you must notify the event organizers in writing at the time of check-in. Every reasonable effort will be made to exclude non-consenting participants from media content.

8. CONTEST PARTICIPATION
I understand that a Best Coordinated Sister Look Contest will take place at this event. By participating in the contest, I grant the Released Parties full rights to photograph, share, and promote my contest entry across all media platforms without compensation. Contest participation is entirely voluntary.

9. SEVERABILITY & GOVERNING LAW
I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida. If any portion of this Release is held invalid, I agree that the balance shall continue in full legal force and effect. This Release shall be governed by and construed in accordance with the laws of the State of Florida, and any disputes shall be resolved in Hillsborough County, Florida.

10. VOLUNTARY AGREEMENT
I HAVE READ THIS RELEASE OF LIABILITY AND MEDIA RELEASE CAREFULLY AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT BY PARTICIPATING IN THIS EVENT, I AM GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR INJURIES OR OTHER DAMAGES THAT I MAY SUSTAIN AS A RESULT OF MY PARTICIPATION. I AM VOLUNTARILY AGREEING TO ALL OF THE TERMS OF THIS DOCUMENT FREELY AND WITHOUT INDUCEMENT.

By completing your registration and/or attending the Sol Sister Sculpt Sunday event on August 2, you confirm that you have read, understood, and agree to all terms outlined in this Participant Waiver, Release of Liability, and Media Release.
