You’ll be guided through gentle breath, visualization, and restorative sound. This experience is accessible for all bodies and can be experienced lying down or seated. Bring any comforts you love; a blanket, eye mask, or pillow to allow yourself to fully relax.

RELEASE, PARTICIPANT LIABILITY WAIVER, AND HOLD HARMLESS FORM
ACTIVITY: YOGA, BREATHWORK, SOUND BATH, (IN-PERSON, LIVE VIRTUAL, PRERECORDED ONLINE CONTENT)

RETREAT LIABILITY WAIVER
1. In consideration for receiving permission to participate in the above-mentioned activity, (herein referred to as ACTIVITY), which is sanctioned and/or sponsored by Mariah Oscar, Rising Rose Wellness LLC (herein referred to as SPONSOR), I (the undersigned) hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE, AND AGREE TO HOLD HARMLESS Rising Rose Wellness LLC, its volunteers, third parties, or employees (collectively referred to as RELEASEES) FROM ANY AND ALL LIABILITIES, CLAIMS, DEMANDS, OR ILLNESS including but not limited to COVID-19, and injury, including death, unless specifically exempted herein, that may be sustained by me or my child while participating in such ACTIVITY, travel to and from the activity, or while on the premises owned or leased by RELEASEES, including illness and injuries sustained as a result of the negligence and FUTURE NEGLIGENCE OF RELEASEES. I am/My child is able to participate in this activity and I know of no medical, physical, or mental reason why I or my child should not participate.

2. I am fully aware that there are inherent risks involved with the ACTIVITY, and I choose to voluntarily participate in said ACTIVITY with full knowledge that said ACTIVITY may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, ILLNESS (including but not limited to COVID-19) OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me as a result of participating in said ACTIVITY, including injuries sustained as a result of the negligence or FUTURE NEGLIGENCE OF RELEASEES, unless specifically exempted herein. I further agree to indemnify and hold harmless the RELEASEES for any loss, liability, damage or costs, including court costs and attorney's fees that may occur as a result of my or my child's participation in said ACTIVITY, unless specifically exempted herein.

3. I authorize staff and other medical personnel to take any action deemed necessary in case of emergency medical situations. I understand that RELEASEES may not maintain insurance covering circumstances arising from my participation in this ACTIVITY or any event related to that participation. As such, I am aware that I should review my personal insurance coverage and my personal insurance will be used when appropriate and applicable.

4. It is my express intent that this document shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representatives, if I am deceased.

5. In signing this Release, Waiver, and Hold Harmless, I acknowledge and represent that I have read the foregoing document, acknowledge that I have the right to review it with my own legal counsel, understand it, and sign it voluntarily as my own free act and deed. No oral representations, statements, or inducements apart from the foregoing agreement that has been reduced to writing have been made. I execute this document for full, adequate and complete consideration fully intending to be bound by the same, now and in the future.

6. All other terms notwithstanding, this document does not release, and expressly excludes from its terms, claims, liabilities, or causes of action which are non-releasable under State or Federal Laws, including, but not limited to, intentional torts, gross recklessness, gross negligence, fraud, or activities involving the public interest, depending on the jurisdiction.


SOUND BATH LIABILITY WAIVER

I acknowledge that sound therapy, sound energy medicine, sound healing with crystal singing bowls techniques use sound, vibration, and intention to gently transition a person from his or her normal waking state of consciousness (beta) to a highly relaxed state of consciousness (alpha, theta, and delta). I acknowledge that part of the session will involve a sound healer playing crystal singing bowls that may be placed near the body and will emit high and low-pitched sounds. *Note: If you have a reason to believe that these objects and the sounds they make may cause discomfort, pain, or injury, please advise before the session begins.

I acknowledge that sound healing does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that sound healing/meditation is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is my exclusive responsibility to seek such independent professional guidance as needed.

I knowingly, voluntarily, and intelligently decides to receive the services described above, and I knowingly, voluntarily, and intelligently assume all risks involved in the same. As a result of these assumptions of these risks, I agree to release, hold harmless, indemnify and defend Rising Rose Wellness LLC, and its owners, employees, and affiliates from and against any and all claims which me (or anyone in the group) may have for any loss, damage, or injury arising out of or in connection with use of the treatments or services described above, or arising out of or in connection with referral to other practitioners or merchants for delivery of any services. As a result, I agree not to pursue a claim against any of the foregoing if I am dissatisfied with the results of the above services.

I have read and understand the above disclosure. My signature further acknowledges that I shall not now or at any time in the future bring any legal action against Rising Rose Wellness LLC, its volunteers/employees & affiliates/associated studio space in case of personal injury and damage. I hereby release the listed businesses & organizations from any and all liability, negligence, or other claims arising from or in any way connected with my participation.

My signature is binding to this liability waiver from this day forth.
