PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

Event/Activity: SOVRN Training Club (including but not limited to group workouts, kettlebell/sandbag training, cold plunge/ice bath, and any other related activities)

PLEASE READ CAREFULLY. BY SIGNING, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS UNDER FLORIDA LAW.

1) Assumption of Inherent Risks

I understand that participation in fitness and cold exposure activities involves inherent risks, including but not limited to: muscle strains, joint or back injuries, slips/falls, cardiac events, fainting, hypothermia, cold shock, and in rare cases, serious injury or death.
I understand that cold plunging and ice baths may stress the cardiovascular system and may not be safe for people with certain medical conditions. I voluntarily assume all such risks, both known and unknown, including those that may result from the negligence of the Released Parties as defined below.

2) Fitness to Participate

I affirm that I am in good physical health and know of no medical condition that would prevent my safe participation. I have been advised to consult with a physician before engaging in strenuous exercise or cold exposure. I agree to immediately stop participating and inform a staff member if I feel unwell or unsafe.

3) Cold Plunge / Ice Bath Specific Consent

I understand that cold immersion can trigger a gasp reflex, rapid breathing, elevated heart rate, and blood pressure. I will enter slowly, maintain controlled breathing, and exit immediately if I feel faint, numb, or unsafe. I will not participate under the influence of alcohol, drugs, or medication that could impair my ability to safely participate.

4) Release and Waiver of Liability (Florida Law Notice)

In consideration for being permitted to participate in this event, I hereby release, waive, discharge, and covenant not to sue SOVRN FITNESS INC., its officers, directors, employees, contractors, volunteers, venue owners, sponsors, and affiliates (collectively the “Released Parties”) from any and all liability, claims, or causes of action for personal injury, property damage, or death arising from my participation, whether caused by the negligence of the Released Parties or otherwise.

This release extends to all claims under Florida Statutes § 744.301 and § 773.03 and applies to ordinary negligence, but does not release claims for gross negligence or intentional misconduct as defined by Florida law.

5) Indemnification

I agree to indemnify and hold harmless the Released Parties from any and all claims, demands, damages, or expenses (including reasonable attorney’s fees) arising from my participation or actions during the event.

6) Rules & Safety Compliance

I agree to follow all safety instructions, use equipment properly, and act in a responsible manner. SOVRN FITNESS INC. reserves the right to remove participants acting unsafely or in violation of event rules.

7) Medical Treatment Authorization

I authorize SOVRN FITNESS INC. or its representatives to obtain emergency medical treatment if necessary. I understand I am responsible for all medical costs incurred.

8) Photo/Video Release

I grant SOVRN FITNESS INC. permission to record and use my image, likeness, and voice in any media for promotional purposes, without further approval or compensation.

9) Governing Law & Venue

This Waiver is governed by the laws of the State of Florida, and any disputes shall be resolved exclusively in Miami-Dade County, Florida. If any portion is found unenforceable, the remainder shall continue in full effect.
