PARTICIPATION WAIVER & RELEASE OF LIABILITY

In consideration of being permitted to participate in any program, activity, league, pickup game, workout, tournament, event, training session, or facility use (collectively referred to as the “Program”) organized, operated, sponsored, or hosted by Sphere, I, the undersigned participant, or parent/legal guardian of a minor participant, acknowledge and agree to the following:

1. ASSUMPTION OF RISK
I understand that participation in soccer, fitness activities, training programs, recreational sports, and related activities involves inherent risks, including but not limited to serious bodily injury, permanent disability, illness, property damage, paralysis, and death. I knowingly and voluntarily assume all risks associated with participation in the Program.

2. RELEASE OF LIABILITY
I hereby release, waive, discharge, and covenant not to sue Sphere, including its owners, managers, officers, directors, employees, contractors, volunteers, sponsors, affiliates, partners, agents, representatives, successors, assigns, facilities, municipalities, venues, and event organizers (collectively “Released Parties”) from any and all liability, claims, demands, damages, costs, expenses, actions, or causes of action arising out of or related to any loss, injury, illness, disability, death, or property damage resulting from participation in the Program, whether caused by negligence or otherwise.

3. MEDICAL & PHYSICAL CONDITION
I certify that I, or my child, am physically fit and capable of safely participating in the Program. I understand that OMNi does not provide medical insurance coverage for participants and that I am solely responsible for any medical expenses incurred.

4. COMMUNICABLE DISEASES
I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume all risks related to exposure, infection, illness, or injury arising from participation in the Program.

5. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, costs, or expenses, including attorney fees, arising from my participation, or my child’s participation, in the Program.

6. MEDIA & PHOTO RELEASE
I hereby grant sphere and its affiliates, representatives, and assigns the unrestricted right and permission to photograph, videotape, record, or otherwise capture my likeness, image, voice, appearance, and/or performance during participation in the Program.

I authorize sphere to use, reproduce, edit, publish, distribute, display, and promote such media in any format or medium, including social media, websites, advertisements, promotional materials, marketing campaigns, broadcasts, and publications, without compensation, notification, or further consent.

I understand that all media captured during the Program shall remain the property of OMNi.

7. MINOR PARTICIPANTS
If signing on behalf of a participant under the age of 18, I certify that I am the parent or legal guardian of the minor participant and agree to all terms of this Waiver & Release on behalf of the minor.

8. ACKNOWLEDGMENT
I acknowledge that I have carefully read this Waiver & Release of Liability, fully understand its contents, and understand that I am giving up substantial legal rights by signing it. I sign this agreement voluntarily and without inducement.
