Waiver of Liability and Assumption of Risk

PLEASE READ CAREFULLY BEFORE SIGNING

By participating in an event organized by X INSIGHT CORP, INSIGHT RUN CLUB, INSIGHT X RUN (including, but not limited to, group runs, outdoor workouts, fitness events, and recreational activities), I acknowledge and agree to the following:


1. Voluntary Participation
I am participating voluntarily and understand that these activities involve physical exertion and inherent risks, including but not limited to: falls, collisions, heat-related illness, dehydration, overexertion, equipment failure, traffic accidents, or interactions with other participants or the environment.

2. Health Declaration
I confirm that I am physically and mentally fit to participate and have not been advised otherwise by a qualified medical professional. I take full responsibility for monitoring my own health and condition during the activity.

3. Assumption of Risk
I understand the nature of the activity and knowingly assume all known and unknown risks associated with my participation, including personal injury, illness (including but not limited to COVID-19), property loss or damage, or death.

4. Release of Liability
I release and discharge InsightxRun, its organizers, volunteers, affiliates, sponsors, partners, and representatives from any and all liability, claims, demands, or causes of action arising from my participation—whether caused by negligence or otherwise.

5. Photo & Media Release
I authorize InsightxRun to use any photos, videos, or media in which I appear, for promotional purposes including social media, websites, and event materials, without compensation or approval.

6. Registration Policy
All registration fees are non-refundable and non-transferable, including transfers to future events. Once registration is completed, fees are allocated toward event production, logistics, and operational expenses and cannot be returned under any circumstances.


7. Weather, Event Cancellation & Ticket Policy
I understand that Insight Run Club events may be affected by weather conditions or other circumstances beyond the organizer’s control. In the event of severe weather or force majeure that requires cancellation or rescheduling of an event, Insight Run Club reserves the right to cancel the event for the safety of all participants.

In such cases, I acknowledge and agree that registration fees are non-refundable. The amount paid will be treated as a donation to support of the Insight Run Club community, which already provides various free benefits to its members.


8. Consideration & Binding Effect
I understand that by signing this waiver, I am giving up legal rights, including the right to sue. I acknowledge that this release is a binding legal agreement and that I am signing it in consideration of being permitted to participate in Insight Run Club events. I do so freely and voluntarily, intending it to be legally binding to the fullest extent permitted by law.

9. Legal Agreement & Governing Law
I understand that this waiver constitutes a binding legal agreement, and that I am waiving significant legal rights, including the right to sue.
This agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey.

10. T-Shirt Size Disclaimer: Participant acknowledges that the t-shirt size selected during registration is a preference only and is not guaranteed. T-shirt availability is subject to inventory and event logistics. The Event Organizer reserves the right to substitute sizes based on availability, and no refunds or exchanges will be provided due to size availability limitations.

By completing my registration, I confirm that I have read, understood, and agreed to all terms stated above, and that I am participating freely and voluntarily.

By participating, I accept this policy and understand that safety considerations will always take priority.
