# ASSUMPTION OF RISK, LIABILITY WAIVER, RELEASE OF CLAIMS, MEDIA RELEASE, AND TICKET POLICY

By purchasing a ticket, registering for, attending, participating in, volunteering at, or otherwise engaging in any event, activity, program, trip, tournament, league, fitness experience, recreational activity, social gathering, or experience organized, hosted, promoted, sponsored, or operated by Over The Top ("OTT") (collectively, the "Event"), I acknowledge and agree to the following:

# 1. ACKNOWLEDGEMENT OF RISKS

I understand that participation in the Event involves inherent risks, hazards, and dangers that cannot be completely eliminated regardless of the care exercised by OTT, venues, sponsors, partners, staff, volunteers, contractors, or participants.

Such risks may include, without limitation:

• Physical exertion and athletic activity

• Sports and recreational activities

• Fitness and wellness activities

• Running, jumping, kicking, lifting, climbing, hiking, skiing, swimming, boating, or other physical activities

• Slips, trips, falls, collisions, and impacts

• Equipment malfunction or misuse

• Injuries caused by participants, spectators, staff, vendors, contractors, or third parties

• Exposure to weather, environmental conditions, uneven terrain, water hazards, traffic hazards, and transportation-related risks

• Food and beverage consumption

• Alcohol consumption by myself or others

• Exposure to communicable diseases, viruses, bacteria, or other illnesses

• Property damage, theft, or loss of personal belongings

• Serious bodily injury, disability, paralysis, emotional distress, illness, or death

I acknowledge that these risks may arise from known or unknown causes and may result from my own actions, the actions of others, or conditions of the Event or venue.

I voluntarily and knowingly assume all risks associated with my participation in and attendance at the Event.

# 2. HEALTH AND FITNESS REPRESENTATION

I represent that I am physically and mentally capable of participating in the Event.

I certify that I have no medical condition, illness, injury, impairment, or other condition that would prevent me from safely participating.

I understand that OTT does not evaluate participant fitness or medical readiness and makes no representation regarding my ability to safely participate.

I accept full responsibility for determining whether I am fit to participate.

# 3. RELEASE OF LIABILITY AND COVENANT NOT TO SUE

To the fullest extent permitted by California law, I hereby release, waive, discharge, hold harmless, and covenant not to sue:

• Over The Top (OTT)

• Event venues and property owners

• Sponsors, partners, and affiliates

• Event staff, volunteers, contractors, coaches, instructors, vendors, entertainers, and service providers

• Their respective owners, officers, directors, employees, agents, representatives, successors, assigns, and insurers

(collectively, the "Released Parties")

from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, attorneys' fees, judgments, or obligations of any kind arising from or relating to my attendance at or participation in the Event.

This release includes claims arising from the ordinary negligence of the Released Parties.

This release does not apply to claims arising from gross negligence, reckless conduct, or willful misconduct to the extent such claims cannot be waived under California law.

# 4. INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, demands, liabilities, damages, losses, expenses, costs, or attorneys' fees arising from:

• My actions or omissions

• My violation of any law, regulation, venue policy, or Event rule

• Any damage I cause to persons or property

• Any claim brought by a third party arising from my participation in the Event

# 5. MEDICAL AUTHORIZATION

In the event of injury, illness, accident, or medical emergency, I authorize OTT and its representatives to secure emergency medical treatment on my behalf if deemed necessary.

I understand and agree that:

• OTT has no obligation to provide medical care

• Medical personnel may not be present at the Event

• I am solely responsible for any medical expenses incurred

• OTT assumes no responsibility for the provision, quality, or cost of medical treatment

# 6. COMMUNICABLE DISEASE ACKNOWLEDGEMENT

I understand that participation in public events may expose me to communicable diseases, including but not limited to COVID-19, influenza, respiratory illnesses, bacterial infections, and other contagious conditions.

I voluntarily assume all risks associated with such exposure and release the Released Parties from any related claims except where prohibited by law.

# 7. ALCOHOL ACKNOWLEDGEMENT

Certain Events may involve the service, sale, or consumption of alcoholic beverages.

If alcohol is available at the Event, I acknowledge and agree that:

• I am solely responsible for my alcohol consumption

• I will consume alcohol responsibly

• I will comply with all applicable laws

• I will not operate a motor vehicle while impaired

• OTT is not responsible for any injury, accident, loss, damage, or claim arising from my alcohol consumption before, during, or after the Event

OTT reserves the right to refuse service, deny entry, or remove any attendee who appears intoxicated, impaired, disruptive, or unsafe.

# 8. AGE REQUIREMENTS

Certain Events may have age restrictions.

For Events designated as 21+, attendees must present valid government-issued identification upon request.

OTT reserves the right to deny entry to any attendee who cannot provide satisfactory proof of age.

No refund shall be provided in such circumstances.

# 9. PHOTO, VIDEO, AND MEDIA RELEASE

I understand that photography, videography, livestreaming, audio recording, and other forms of media capture may occur during the Event.

By attending the Event, I grant OTT and its authorized representatives the irrevocable, perpetual, worldwide, royalty-free right to:

• Photograph, film, record, and capture my image, likeness, voice, appearance, and participation

• Edit, modify, reproduce, publish, distribute, display, transmit, broadcast, and otherwise use such content

• Use such content in any media format now existing or later developed

• Use such content for advertising, marketing, promotional, editorial, public relations, social media, commercial, and other lawful purposes

I waive any right to compensation, royalties, approval, inspection, or additional notice regarding such use.

# 10. EVENT RULES AND REMOVAL

I agree to comply with all Event rules, venue policies, safety requirements, and instructions from Event staff.

OTT reserves the right to refuse entry to or remove any attendee who:

• Engages in unsafe conduct

• Violates Event rules or venue policies

• Harasses, threatens, or discriminates against others

• Causes property damage

• Disrupts the Event

• Fails to follow staff instructions

Removal from the Event shall not entitle the attendee to any refund, credit, or compensation.

# 11. TICKET POLICY AND NO REFUNDS

Except where required by applicable law, all ticket sales are final.

No refunds, exchanges, transfers, or credits will be provided due to:

• Scheduling conflicts

• Travel disruptions

• Illness or injury

• Failure to attend

• Weather conditions

• Removal from the Event

• Failure to satisfy entry requirements

• Personal circumstances

If an Event is postponed, modified, relocated, or rescheduled, tickets shall remain valid for the revised Event and shall not be eligible for refund except where required by law.

# 12. CALIFORNIA CIVIL CODE §1542 WAIVER

I expressly waive any rights under California Civil Code Section 1542, which provides:

"A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

I understand and acknowledge the significance of this waiver and expressly waive the protections of Section 1542 and any similar law.

# 13. GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed under the laws of the State of California.

Any dispute arising out of or relating to this Agreement or the Event shall be brought exclusively in the state or federal courts located in California.

I consent to the personal jurisdiction of such courts.

# 14. SEVERABILITY

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

# 15. ACKNOWLEDGEMENT AND AGREEMENT

BY PURCHASING A TICKET, REGISTERING FOR, ATTENDING, ENTERING, OR PARTICIPATING IN THE EVENT, I ACKNOWLEDGE THAT:

• I HAVE READ THIS AGREEMENT IN ITS ENTIRETY

• I FULLY UNDERSTAND ITS TERMS

• I UNDERSTAND THAT I AM RELEASING CERTAIN LEGAL RIGHTS

• I AM VOLUNTARILY AGREEING TO THESE TERMS

• I INTEND FOR THIS AGREEMENT TO BE LEGALLY BINDING TO THE MAXIMUM EXTENT PERMITTED BY LAW

• I AM AT LEAST EIGHTEEN (18) YEARS OF AGE OR THE LEGAL AGE REQUIRED TO ENTER INTO THIS AGREEMENT
