COMPREHENSIVE LIABILITY WAIVER, RELEASE OF CLAIMS, ASSUMPTION OF RISK, AND NO-REFUND AGREEMENT

This Comprehensive Liability Waiver, Release of Claims, Assumption of Risk, and No-Refund Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Alissa Seymoure, Deep House Yoga, Deep House Yoga Aux, and their respective owners, officers, directors, employees, contractors, instructors, DJs, facilitators, volunteers, sponsors, affiliates, successors, and assigns (collectively, the “Released Parties”).

By signing this Agreement, Participant acknowledges and agrees to the following terms:

1. ASSUMPTION OF RISK

Participant understands that participation in Deep House Yoga classes, guided yoga practices, ecstatic dance, meditation, sound experiences, facilitator trainings, wellness events, retreats, outdoor activities, fitness instruction, and related programming (collectively, the “Activities”) involves inherent risks, including but not limited to:

• Physical injury, including strains, sprains, fractures, falls, overexertion, dehydration, or other bodily injury
• Slips, trips, and falls
• Exposure to weather conditions including heat, cold, sun, rain, and wind
• Uneven terrain or outdoor environmental hazards
• Equipment-related injury
• Contact with other participants
• Emotional or psychological responses that may arise during movement, meditation, breathwork, or wellness experiences
• Illness or exposure to communicable diseases

Participant voluntarily assumes full responsibility for all risks, injuries, damages, or losses arising from participation.

2. RELEASE AND WAIVER OF LIABILITY

Participant knowingly and voluntarily waives, releases, and forever discharges the Released Parties from any claims, liabilities, demands, causes of action, damages, costs, or expenses arising out of participation in Activities.

This waiver includes claims resulting from ordinary negligence to the fullest extent permitted under applicable law.

This Agreement does not waive claims involving gross negligence, willful misconduct, or liabilities that cannot legally be waived.

3. INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless the Released Parties against claims, damages, losses, costs, or expenses (including attorney fees) arising from Participant’s involvement in Activities.

4. MEDICAL FITNESS AND HEALTH REPRESENTATION

Participant represents they are physically capable of participating and have no condition preventing safe participation.

Participant understands:

• They should consult a physician before participation if concerned
• They are responsible for monitoring their physical condition
• They will stop participating if pain, dizziness, emotional distress, or discomfort occurs

Participant acknowledges Released Parties do not provide medical advice.

5. EMERGENCY MEDICAL CARE

Participant authorizes emergency medical treatment if deemed necessary and accepts responsibility for associated costs.

6. PERSONAL PROPERTY

Released Parties are not responsible for lost, stolen, or damaged personal belongings.

7. PHOTO, VIDEO, AND MEDIA RELEASE

Participant grants Deep House Yoga, Deep House Yoga Aux, Alissa Seymoure, and Released Parties irrevocable permission to photograph, record, and use Participant’s image, likeness, voice, and participation for marketing, social media, promotional, educational, and business purposes without compensation.

8. OUTDOOR AND THIRD-PARTY VENUE ACKNOWLEDGMENT

Participant acknowledges Activities may occur in rooftops, studios, hotels, parks, wellness spaces, retreat centers, public spaces, private venues, or other third-party locations.

Participant agrees to comply with all rules and understands these environments may involve additional risks.

9. NO GUARANTEES

Participant understands no guarantees have been made regarding physical results, emotional outcomes, wellness benefits, safety outcomes, or overall experience.

10. PAYMENT POLICY, TICKET TRANSFERS, AND NO REFUNDS

Participant acknowledges and agrees that all purchases, registrations, tickets, memberships, trainings, workshops, retreats, and event fees associated with Deep House Yoga or related programming are final.

NO REFUNDS will be issued for any reason, including but not limited to:

• Scheduling conflicts
• Illness or injury
• Travel delays or cancellations
• Personal circumstances
• Dissatisfaction
• Weather conditions
• Inability to attend
• Change of teachers, or plans

Tickets may be transferred to another attendee up to twenty-four (24) hours before the scheduled event start time unless otherwise stated for a specific event, retreat, workshop, or training.

Participant understands events may be rescheduled, relocated, modified, or canceled due to weather, venue issues, safety concerns, or unforeseen circumstances. Deep House Yoga may, at its sole discretion, offer credits, rescheduling options, or alternative accommodations, but is not obligated to provide refunds.

By registering for Activities, Participant expressly agrees to this no-refund policy.

11. GOVERNING LAW AND SEVERABILITY

This Agreement shall be governed by Illinois law.

If any provision is deemed unenforceable, remaining provisions shall remain in effect.

12. BINDING EFFECT

This Agreement is binding upon Participant and Participant’s heirs, representatives, executors, administrators, and assigns.

13. ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges they have carefully read this Agreement, understand its contents, and sign voluntarily.

Participant understands they are waiving substantial legal rights, including the right to sue.
