Meditation

In consideration of being permitted to participate in the yoga class, meditation event, wellness activities, workshops, and related programming (collectively, the "Event") organized, hosted, or facilitated by Sam Atherley and Germaine de Capuccini (collectively, the "Released Parties"), I agree to the following:
ASSUMPTION OF RISK
I understand that participation in yoga, meditation, stretching, breathing exercises, wellness activities, and related physical or mental practices involves inherent risks, including but not limited to physical injury, muscle strain, falls, dizziness, emotional discomfort, aggravation of pre-existing conditions, illness, and other unforeseen risks.
I voluntarily choose to participate in the Event and knowingly assume all risks, whether known or unknown, associated with my participation.
HEALTH REPRESENTATIONS
I represent that I am physically and mentally capable of participating in the Event. I understand that the Released Parties are not medical professionals and do not provide medical advice, diagnosis, or treatment.
I agree to consult with a physician or other qualified healthcare provider before participating if I have any medical concerns, injuries, conditions, or limitations. I will immediately discontinue participation if I experience pain, discomfort, dizziness, or any adverse symptoms.
RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Sam Atherley, Germaine de Capuccini, their affiliates, officers, directors, employees, contractors, instructors, volunteers, agents, sponsors, successors, and assigns from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or related to my participation in the Event, including personal injury, illness, property damage, or death, except where prohibited by law.
INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, or expenses, including reasonable attorneys' fees, arising from my actions, conduct, negligence, or participation in the Event.
EMERGENCY MEDICAL TREATMENT
In the event of an emergency, I authorize the Released Parties to obtain emergency medical assistance on my behalf if deemed necessary. I understand that I am solely responsible for any medical expenses incurred.
PHOTO, VIDEO, AND MEDIA RELEASE
I grant to Sam Atherley and Germaine de Capuccini, and their respective affiliates, licensees, successors, and assigns, the irrevocable, perpetual, worldwide, royalty-free right and permission to photograph, videotape, record, and otherwise capture my likeness, image, voice, appearance, statements, and participation during the Event.
I authorize the use, reproduction, publication, distribution, display, editing, modification, and creation of derivative works from such photographs, videos, recordings, and other media in any format or medium now known or later developed, including but not limited to:
• Social media platforms
• Websites
• Marketing and advertising materials
• Promotional campaigns
• Print publications
• Digital communications
• Educational and training materials
• Public relations and media content
I understand that I will not receive compensation, royalties, or any other payment for such use.
I waive any right to inspect or approve the final materials and release Sam Atherley and Germaine de Capuccini from any claims related to the use of my likeness, including claims for invasion of privacy, defamation, or violation of publicity rights, to the extent permitted by law.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the state or jurisdiction in which the Event is held, without regard to conflict of law principles.
SEVERABILITY
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
ACKNOWLEDGMENT
I have carefully read this Agreement, fully understand its contents, and understand that I am giving up certain legal rights by signing it. I sign this Agreement voluntarily and without any inducement or assurance of any nature.
