PARTICIPATION, ASSUMPTION OF RISKS, AND RELEASE AGREEMENT

This Participation, Assumption of Risks, and Release Agreement (the "Agreement") is a legally binding document that affects your rights. Please read it carefully before participating in Houston Sweat & Chill (the "Event").

1. ASSUMPTION OF RISKS

​I acknowledge that my participation in the Event involves a variety of physical and wellness-related activities that carry inherent risks, including but not limited to:
​
General Event Risks:
Physical exertion during high-energy workouts, live music environments, and social interactions, which may result in injury or health issues.

​

Cold Plunge Activities:
Participation in cold plunge sessions exposes me to extremely low temperatures. I understand that the risks associated with cold plunges include, but are not limited to:

Sudden exposure to cold temperatures that can cause shock or rapid constriction of blood vessels;

Hypothermia (a dangerous drop in core body temperature);

Muscle cramps, dizziness, or loss of coordination;

Increased cardiac stress or exacerbation of pre-existing heart conditions;

Respiratory difficulties and other adverse reactions.

Additional Risks:
Risks associated with food and beverage consumption (such as allergic reactions or foodborne illnesses), use of any provided equipment, and any other hazards, whether known or unforeseen.

I fully understand these risks and voluntarily assume all risks, whether known or unknown, arising from my participation in any aspect of the Event.

2. RELEASE OF LIABILITY
​
In consideration for being permitted to participate in the Event, I hereby release, discharge, and hold harmless Houston Sweat & Chill, its organizers, employees, volunteers, sponsors, affiliates, and all related entities (collectively, the "Released Parties") from any and all claims, liabilities, damages, or losses (including those arising from negligence) that may result from my participation, whether caused by the Released Parties or otherwise.

3. INDEMNIFICATION
​
I agree to indemnify, defend and hold harmless the Released Parties from any and all claims, expenses, or liabilities (including reasonable attorney fees) arising from my participation in the Event or any breach of this Agreement.

4. HEALTH, SAFETY AND MEDICAL CONDITIONS
​
I certify that I am in good physical health and capable of participating in the Event. I acknowledge that I have been advised to consult with a physician regarding my fitness to participate, and I assume full responsibility for any medical issues that may arise. I agree to follow all safety instructions and guidelines provided by the Event organizers and understand that failure to do so may increase my risk of injury.

5. AGE VERIFICATION
​
I confirm that I am at least 18 years of age at the time of signing this Agreement. Participation in the Event is strictly prohibited for individuals under 18.

6. PUBLICITY RELEASE
​
I grant the Released Parties the right to capture and use my name, image, voice, and likeness (collectively, "Likeness") through photography, video, and other media for promotional, marketing, and commercial purposes, without compensation. I waive any rights to inspect or approve such materials and any claim for remuneration.​

7. SEVERABILITY
​
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

​

8. GOVERNING LAW
​
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, and any disputes shall be resolved in the appropriate courts within the territory in which the event is held. 

​

9. ELECTRONIC CONSENT
​
By electronically signing this Agreement or clicking the consent box, I acknowledge that my digital signature is legally binding and equivalent to a handwritten signature.

10. ACKNOWLEDGMENT OF UNDERSTANDING
​
I acknowledge that I have read and fully understand the terms of this Agreement. I voluntarily accept all risks associated with my participation in the Event and agree to the release, waiver, and indemnification provisions outlined above.
