RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDIA RELEASE AGREEMENT

Event: July 25 Rooftop Wellness Event
Location: Top of the Rox Rooftop, West Palm Beach, Florida
Date: July 25, 2026

In consideration of being permitted to participate in the July 25 Rooftop Wellness Event (the "Event"), including but not limited to yoga classes, Pilates classes, fitness activities, stretching, wellness activities, cold plunge immersion, swimming, pool use, poolside activities, social gatherings, vendor experiences, and all related activities (collectively, the "Activities"), I hereby acknowledge and agree to the following:

1. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

I understand that participation in the Activities involves inherent and significant risks, including but not limited to:

Muscle strains, sprains, tears, and other orthopedic injuries;
Slips, trips, falls, and collisions;
Drowning or near-drowning;
Injuries related to swimming or pool use;
Heat exhaustion, dehydration, sun exposure, heat stroke, or weather-related conditions;
Cold shock response, hypothermia, dizziness, fainting, cardiac stress, respiratory distress, loss of consciousness, or other risks associated with cold plunge immersion;
Aggravation of pre-existing medical conditions;
Illness, infection, allergic reactions, or other physical injuries;
Serious bodily injury, permanent disability, or death.

I knowingly, voluntarily, and expressly assume all risks associated with my participation in the Event and Activities, whether known or unknown, foreseeable or unforeseeable.

2. HEALTH REPRESENTATION

I certify that I am physically and mentally capable of participating in the Activities and have no medical condition that would make participation unsafe.

I understand that cold plunge immersion, intense physical activity, swimming, and heat exposure may not be appropriate for individuals with certain health conditions, including cardiovascular conditions, respiratory conditions, high blood pressure, pregnancy, seizure disorders, or other medical concerns.

I acknowledge that I am solely responsible for determining whether I am medically fit to participate.

3. RELEASE, WAIVER, AND DISCHARGE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE:

Alma Movement, event organizers, event hosts, instructors, yoga teachers, Pilates instructors, venue owners, property owners, property managers, sponsors, vendors, cold plunge providers, contractors, employees, volunteers, agents, representatives, affiliates, successors, assigns, and all other persons or entities associated with the Event (collectively, the "Released Parties"),

from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, expenses, or attorney's fees arising from or related to my participation in the Event or Activities, including but not limited to claims arising from bodily injury, illness, property damage, emotional distress, disability, death, or any other loss.

This release specifically includes claims arising from the alleged negligence of any Released Party, to the fullest extent permitted under Florida law.

4. SWIMMING, POOL, AND WATER ACTIVITY ACKNOWLEDGMENT

I understand that swimming pools and water activities present inherent dangers, including the risk of slips, falls, drowning, near-drowning, collisions, and other serious injuries.

I voluntarily assume all risks associated with entering, using, or being present in or around the pool area and acknowledge that I do so entirely at my own risk.

5. COLD PLUNGE ACKNOWLEDGMENT

I understand that cold plunge immersion exposes the body to extreme temperatures and may cause serious physical reactions, including but not limited to cold shock response, hyperventilation, dizziness, fainting, cardiac stress, hypothermia, injury, or death.

I voluntarily choose to participate in cold plunge activities and assume all associated risks.

6. RESPONSIBILITY FOR PERSONAL PROPERTY

I understand that I am solely responsible for my personal belongings. The Released Parties are not responsible for any lost, stolen, or damaged property.

7. PHOTO, VIDEO, AND MEDIA RELEASE

I grant the Event organizers and their representatives the irrevocable right to photograph, record, and use my image, likeness, voice, and appearance in photographs, videos, digital content, promotional materials, advertisements, social media, and other media now known or later developed, without compensation or further approval.

8. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, liabilities, damages, costs, expenses, or attorney's fees arising from my participation in the Event or my violation of any Event rules or instructions.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

10. ACKNOWLEDGMENT

I acknowledge that:

I have carefully read this Agreement in its entirety;
I understand its contents and legal effect;
I understand that I am giving up substantial legal rights;
I sign this Agreement freely and voluntarily without coercion;
I intend for this Agreement to be a complete and unconditional release of liability to the fullest extent permitted by Florida law.
