Join us for a one-of-a-kind **Swiftie Liftie Club** experience on **Thursday, August 27th** at **FLC Skate Rink** in Phoenix!&#x20;

We'll kick off the evening with our signature 45-minute Taylor-inspired workout before lacing up our skates for a fun community skate session and social.

This isn't just a workout—it's a chance to make a difference! We've partnered with **Valley of the Sun United Way** to help provide essential school supplies for underserved children across the Phoenix area.

Please bring **at least one** of the following new school supplies to help local students start the school year strong:

* Backpack, Mechanical Pencils, Erasers, Notebook, Highlighters, Pens, Folders, Markers, Glue Sticks, Scissors

## LIABILITY RELEASE, ASSUMPTION OF RISK & PHOTO/VIDEO WAIVER

**PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT.**

This Liability Release, Assumption of Risk, and Photo/Video Waiver ("Agreement") is entered into by the undersigned participant ("Participant") in favor of **Alexy Posner**, **Swiftie Liftie Club**, and **AP Brand Group**, including all owners, officers, employees, contractors, volunteers, agents, successors, assigns, sponsors, and affiliates (collectively, the "Released Parties").

## 1. ASSUMPTION OF RISK

I understand and acknowledge that participation in fitness classes, workouts, and related activities—particularly outdoor and recurring group fitness events—may involve inherent risks, including but not limited to:

* Physical exertion and strenuous activity
* Slips, falls, collisions, or contact with other participants
* Weather conditions (including heat, cold, rain, uneven surfaces, and outdoor hazards)
* Equipment-related injuries
* Muscle strains, sprains, broken bones, illness, heart attack, or other serious injury

I voluntarily choose to participate and **assume full responsibility for all risks**, known and unknown, associated with my participation.

## 2. RELEASE OF LIABILITY

In consideration of being permitted to participate in any Swiftie Liftie Club fitness classes or events, I hereby **fully and forever release, waive, discharge, and covenant not to sue** the Released Parties from **any and all claims, demands, damages, losses, liabilities, costs, or expenses** of any kind arising out of or related to my participation, including but not limited to:

* Personal injury
* Property damage
* Illness or death

This release applies **whether caused by negligence or otherwise**, to the fullest extent permitted by law.

## 3. MEDICAL ACKNOWLEDGMENT

I represent and warrant that:

* I am physically and mentally able to participate in fitness activities
* I have no medical condition that would prevent safe participation, or I have consulted a medical professional prior to participation
* I understand that I am responsible for monitoring my own physical condition and will stop participation if I experience pain, dizziness, shortness of breath, or discomfort

I acknowledge that the Released Parties are **not responsible for providing medical care** and I consent to emergency medical treatment if deemed necessary.

## 4. INDEMNIFICATION

I agree to **indemnify and hold harmless** the Released Parties from any claims, actions, damages, or costs (including attorneys’ fees) arising out of my participation in the events or my breach of this Agreement.

## 5. PHOTO & VIDEO RELEASE

I grant **Alexy Posner**, **Swiftie Liftie Club**, and **AP Brand Group** the irrevocable right and permission to **photograph, record, film, and otherwise capture my likeness, image, voice, and participation** during the fitness classes or related events.

I understand and agree that these photos and videos may be used for **marketing, promotional, social media, website, advertising, and other commercial or non-commercial purposes**, without compensation or additional approval.

I waive any right to inspect or approve the finished product and release the Released Parties from any claims related to the use of such media.

## 6. SEVERABILITY

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

## 7. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the **State of Arizona**, without regard to conflict of law principles.

## 8. ACKNOWLEDGMENT & SIGNATURE

I acknowledge that I have read and fully understand this Agreement, that I am voluntarily giving up substantial legal rights, and that I am signing this Agreement freely and voluntarily.
