WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK
SYNC WELLNESS LLC - Classes, Workshops & Events
This Waiver and Release Agreement ("Agreement") is entered into between the participant ("Participant," "you")
and SYNC WELLNESS LLC including their owners, instructors, hosts, volunteers, and venues (collectively, "Company").
Please read carefully. By signing, you are giving up certain legal rights.
1. Nature of Activities
I understand that classes and events may include physical movement, breath-work, meditation, strength training, stretching, dance, outdoor activities, and other wellness practices. Activities may take place in-studio, outdoors, online, or at a third-party venue. I acknowledge that participation is voluntary.
2. Assumption of Risk
I understand that participation involves inherent risks, including but not limited to physical injury, illness, allergic reaction, emotional distress, and property loss. I voluntarily assume all risks associated with my participation.
3. Health Representation
I represent that I am in good physical and mental health to participate, and I have no medical condition that would prevent safe participation. I will disclose any relevant injuries, conditions, or medications to the instructor before class. I agree to stop and rest if needed, and to seek medical attention if necessary. I understand it is my responsibility to consult with a physician before participating. For pregnant / postpartum participants: I confirm I have medical clearance to participate in movement classes.
4. Waiver and Release of Liability
In consideration for being permitted to participate, I hereby waive, release, and discharge the Company from any and all claims, demands, or causes of action arising out of my participation, including those arising from negligence, except for gross negligence or willful misconduct.
5. Personal Responsibility & Property
I agree to take full responsibility for my personal belongings. I will not hold Company liable for lost, stolen, or damaged property.
6. Medical Treatment
I authorize the Company to administer basic first aid and, if deemed necessary, to contact emergency services. I understand I am responsible for all medical costs incurred.
7. Photo / Video Release
I grant permission for the Company to photograph and video record classes and events for marketing, social media, and educational purposes. I understand I can opt-out by notifying the instructor in writing before the event at: joinsyncnyc@gmail.com
8. Minors
If Participant is under 18, a parent or legal guardian must sign below.
9. Cancellation & Conduct Policy
I understand that class packs, memberships, and event tickets are subject to the Company's cancellation and refund policy as posted at time of purchase. I agree to conduct myself respectfully and follow all studio/venue rules. The Company reserves the right to remove any participant for unsafe or disruptive behavior without refund.
10. Governing Law
This Agreement shall be governed by the laws of the State of New York. I agree that any dispute shall be brought in New York County, NY.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND AGREE TO THEM VOLUNTARILY
