## PARTICIPANT WAIVER, ASSUMPTION OF RISK & RELEASE OF LIABILITY

By registering for and/or attending this YoPro Sport Socials Houston Texans watch party (“Event”), I acknowledge and agree to the following:

### ASSUMPTION OF RISK

I understand that this Event is a voluntary social gathering that may take place at a restaurant, bar, brewery, entertainment venue, outdoor space, or other third-party location.

Participation may involve risks including, but not limited to, slips, trips and falls; crowded spaces; interactions with other attendees or members of the public; food-related illness or allergic reactions; alcohol consumption; theft or loss of personal property; conditions at the venue; and risks associated with traveling to and from the Event.

I voluntarily choose to participate and assume the risks ordinarily associated with attending the Event.

### ALCOHOL & TRANSPORTATION

Alcohol may be available for purchase at certain Events. If I choose to consume alcohol, I accept full responsibility for my consumption, behavior, safety, and transportation. I agree not to drive while impaired and understand that I am responsible for arranging safe transportation.

Unless expressly stated otherwise, YoPro Sport Socials does not provide transportation or sell, serve, or control the service of alcoholic beverages.

### **RELEASE OF LIABILITY – INCLUDING ORDINARY NEGLIGENCE**

**TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I RELEASE AND AGREE NOT TO HOLD LIABLE YOUNG PROFESSIONALS SPORT SOCIALS LIMITED COMPANY, ITS OWNERS, ORGANIZERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND EVENT REPRESENTATIVES (“RELEASED PARTIES”) FOR CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH ARISING FROM MY PARTICIPATION IN THE EVENT, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.**

**I UNDERSTAND THAT I AM GIVING UP CERTAIN RIGHTS TO BRING CLAIMS AGAINST THE RELEASED PARTIES FOR THEIR OWN ORDINARY NEGLIGENCE.**

This release does not apply to gross negligence, willful or intentional misconduct, or liability that cannot legally be waived.

### THIRD-PARTY VENUES & PERSONAL PROPERTY

I understand that Event venues are generally independently owned and operated. YoPro Sport Socials does not control venue conditions, employees, other patrons, security, parking, or food and beverage service.

I agree to follow venue policies and behave respectfully toward attendees, venue employees, and others. YoPro Sport Socials may remove anyone whose behavior is unsafe, threatening, harassing, excessively intoxicated, or materially disruptive.

I am responsible for my personal belongings, vehicle, parking, and transportation to and from the Event.

### MEDICAL EMERGENCIES

If I experience a medical emergency, I authorize Event organizers to contact emergency services when reasonably necessary. I understand that YoPro Sport Socials does not provide medical care and that I am responsible for medical expenses incurred on my behalf.

### ACKNOWLEDGMENT

I certify that I am at least 18 years old. I have read and understand this waiver, voluntarily assume the risks associated with participating, and agree to its terms.

**By completing my registration, I acknowledge that I have read and agree to this Participant Waiver, Assumption of Risk & Release of Liability.**
