Take a break from the busy holiday season, make some memories, and celebrate all the things we have to be thankful for, **including** the ability to move our bodies!&#x20;

Competition

 1. ACKNOWLEDGMENT OF ACTIVITIES AND RISKS

I understand that participation in the Fitness Field Day and its related activities may include physical exercise, fitness challenges, team competitions, relay races, walking, running, stretching, recreational games, and other physical or recreational activities.

I understand that participation in these activities involves inherent risks, including but not limited to slips, trips, falls, muscle strains, sprains, joint injuries, fractures, collisions with other participants or objects, dehydration, heat-related illness, cardiovascular events, and other personal injuries or property damage.

I acknowledge that these risks may occur regardless of my physical condition, level of experience, or the precautions taken by event organizers.

2. VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

I voluntarily choose to participate in this event and acknowledge that participation is entirely at my own risk.

I represent that I am physically capable of participating in the activities I choose to undertake. I agree to participate within my own abilities, follow applicable safety instructions, use equipment appropriately, and stop any activity that causes pain, dizziness, shortness of breath beyond expected exertion, or other concerning symptoms.

I understand that I am responsible for determining whether an activity is appropriate for me and for seeking medical advice when necessary.

3. WAIVER AND RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, I hereby release and discharge the following parties, including their respective owners, officers, directors, employees, agents, representatives, volunteers, and authorized affiliates, from claims, demands, causes of action, damages, losses, or liabilities arising out of or relating to my participation in this event, including claims arising from the ordinary negligence of a released party, where such a release is legally enforceable:

- Samantha Smith
- Built After Hours Personal Training LLC
- Gassaway Physical Therapy
- H2health

This release applies to personal injury, illness, death, property damage, and other losses arising from participation in the event or related activities, to the extent permitted by law.

I understand that this agreement does not release any party from liability that cannot legally be waived, including liability for gross negligence, willful misconduct, or other conduct that applicable law prohibits a person from releasing in advance.

4. INDEMNIFICATION

To the extent permitted by law, I agree to be responsible for claims, damages, or expenses arising from my own negligent or intentional conduct, violation of event rules, or failure to follow reasonable safety instructions.

This provision does not require me to indemnify or hold harmless any party for that party's own negligence or misconduct where such indemnification is prohibited by applicable law.

 5. MEDICAL EMERGENCIES

I understand that the event organizers may not have medical personnel on site and that emergency medical services may be required if an injury or medical emergency occurs.

In the event of an emergency, I authorize event personnel to contact emergency services on my behalf. I understand that I am responsible for any medical expenses incurred as a result of treatment, to the extent those expenses are legally my responsibility.

6. PERSONAL PROPERTY

I understand that I am responsible for my personal belongings during the event. To the extent permitted by law, I accept responsibility for loss of or damage to my belongings, except where applicable law does not permit such a release.

 7. RULES AND SAFE PARTICIPATION

I agree to follow event instructions, respect other participants, use equipment responsibly, and refrain from participating while impaired or when I believe participation may be unsafe for me.

I understand that event organizers may remove a participant from an activity if they reasonably believe continued participation presents a safety concern.

8. ACKNOWLEDGMENT AND SIGNATURE

I have read this agreement, understand its contents, and understand that I am giving up certain legal rights by signing it. I have had the opportunity to ask questions and am signing voluntarily.

I understand that this agreement is intended to be legally binding to the extent permitted by applicable law.
