WAIVER AND RELEASE OF LIABILITY
Lemontini Pilates Yacht Experience with Diana I. Burduja
Event Date: August 30th, 2025

In consideration of my voluntary participation in the wellness event hosted by Diana I. Burduja aboard the designated vessel Fantasy Inc dba Sophisticated Lady Yacht Charters, I, the undersigned participant, acknowledge, understand, and agree to the following:


Acknowledgment of Risks

I understand that participation in any wellness, movement, or fitness activity—including but not limited to Pilates, breathwork, stretching, meditation, and other forms of physical or mindful movement—carries inherent risks. These may include but are not limited to:
	•	Muscular strains or sprains
	•	Dizziness or fainting
	•	Accidental slips or falls, especially due to the marine environment (e.g., wet surfaces or boat motion)
	•	Serious injury, illness, or in rare cases, death

I understand that these risks may be increased due to the unique setting of this event on a moving boat, and I voluntarily choose to participate despite these risks.

Medical Disclaimer

I certify that I am in good physical health and have no conditions that would prevent me from safely participating. I have either received medical clearance from my physician or knowingly accept all risks associated with participating without it. I agree to stop any activity immediately if I feel discomfort, pain, dizziness, or any symptoms that feel unusual.

In the case of an emergency, I authorize Diana I. Burduja and/or her event staff to seek medical assistance for me, and I accept responsibility for any resulting expenses.


Waiver of Liability

I voluntarily and expressly waive, release, and discharge Diana I. Burduja, her contractors, collaborators, partners, venue operators, the captain and staff of the yacht, and all affiliated parties from any and all claims, actions, or liabilities for injuries, damages, or losses I may incur as a result of my participation in the event, including those arising from negligence.

Indemnification

I agree to indemnify and hold harmless Diana I. Burduja and all affiliated parties from any and all costs, claims, demands, or liabilities, including legal fees, that may result from my participation in the event.

Use of Likeness (Optional)

I give permission for photos and/or videos taken during the event to be used for promotional or marketing purposes by Diana I. Burduja, unless I provide written notice requesting otherwise.

General Terms
	•	This waiver is governed by the laws of the State of Illinois.
	•	If any part of this agreement is held unenforceable, the rest shall remain in full effect.
	•	This document constitutes the full agreement between the parties, superseding any prior discussions or representations.

Acknowledgment and Signature

By signing below, I affirm that I have read and fully understand this waiver and release. I acknowledge that I am giving up legal rights by signing it and do so voluntarily.
