The Wellness Drop: Winter Edition is a one-day fitness and wellness experience hosted by WellCō DFW, that brings together workouts, recovery, and community.

Take part in 5 instructor-led workouts from studios across N. Dallas, interactive wellness activations, brand pop-ups, and a high-vibe atmosphere designed to keep you moving and shake off the winter blues.

By checking the box marked “I AGREE” and providing my electronic signature, I acknowledge that I have read, understand, and voluntarily agree to the terms of this Liability Waiver, Release, Assumption of Risk, and Indemnity Agreement (this “Agreement”). I understand that this is a legally binding agreement and that I am waiving certain legal rights.

1. Assumption of Risk
I understand and acknowledge that participation in a fitness event involves inherent risks, including but not limited to physical injury, muscle strains, sprains, broken bones, illness, heart conditions, permanent disability, death, and damage to or loss of personal property. These risks may result from my own actions or inactions, the actions or inactions of others, or the condition of the premises or equipment.

I voluntarily and knowingly assume all such risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to my participation in the event and all associated activities (the “Activities”).

2. Release and Waiver of Liability
To the fullest extent permitted by Texas law, I hereby release, waive, and forever discharge:

The Food Hall Company, LLC and WellCō DFW, and each of their respective employees, agents, officers, directors, owners, members, partners, affiliates, subsidiaries, contractors, volunteers, successors-in-interest, and assigns (collectively, the “Releasees”),
from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether in law or equity, arising out of or related to my participation in the Event or Activities, including but not limited to claims for personal injury, illness, death, or property damage, even if caused in whole or in part by the ordinary negligence of any Releasee.

This release does not apply to claims arising from gross negligence or willful misconduct, to the extent such claims cannot be waived under Texas law.

3. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to my participation in the Event or Activities, or my violation of this Agreement, except to the extent caused by the gross negligence or willful misconduct of a Releasee.

4. Medical Representation and Consent
I represent that I am physically fit and have no medical condition that would prevent safe participation. I understand it is my responsibility to consult a physician before participating if I have any health concerns.
In the event of injury or medical emergency, I authorize the Releasees to obtain medical treatment on my behalf. I accept full financial responsibility for any such treatment.

5. Governing Law and Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action arising out of this Agreement shall be brought exclusively in the state or federal courts located in Collin County, Texas.

6. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. Electronic Signature and Acceptance
I understand that by checking the box indicating “I AGREE” and submitting my registration, I am providing my electronic signature, which is the legal equivalent of my handwritten signature. I agree that this Agreement may be executed electronically and that it is enforceable under the Texas Uniform Electronic Transactions Act (TUETA).

8. Acknowledgment of Understanding
I certify that:
* I am at least 18 years of age (or will complete a separate parent/guardian waiver if required),
* I have read this Agreement in its entirety,
* I understand that I am waiving substantial legal rights, and
* I am voluntarily agreeing to be bound by its terms.
