RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT

By registering for or participating in this event, I acknowledge that bowling and attendance at a bowling social involve risks of injury, property damage, illness, and, in rare cases, death. These risks include, but are not limited to, slips and falls; slippery or oily lane surfaces; dropped or thrown bowling balls; collisions with other people; injuries to fingers, hands, wrists, shoulders, backs, knees, ankles, or other body parts; bowling shoes and equipment; ball-return or pinsetting machinery; food and beverages; alcohol consumption; and conditions within the bowling venue, parking areas, entrances, exits, and common spaces.

I voluntarily choose to participate and agree that I am responsible for determining whether I can safely do so.

I KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH MY ATTENDANCE AT AND PARTICIPATION IN THIS EVENT, INCLUDING RISKS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY LAW.

For purposes of this waiver, the “Released Parties” include Young Professionals Sport Socials Limited Company (“YoPro Sport Socials” or “YoPro”), its owners, members, managers, employees, contractors, event hosts, co-hosts, volunteers, representatives, agents, affiliates, sponsors, partners, and insurers, as well as the bowling venue and its owners, employees, agents, and representatives.

I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE THE RELEASED PARTIES FOR CLAIMS ARISING FROM OR RELATING TO MY ATTENDANCE AT OR PARTICIPATION IN THE EVENT, INCLUDING CLAIMS FOR PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE, NEGLIGENT ACTS, OR NEGLIGENT OMISSIONS OF A RELEASED PARTY, INCLUDING NEGLIGENT EVENT ORGANIZATION, SUPERVISION, FAILURE TO WARN, OR FAILURE TO IDENTIFY OR CORRECT A DANGEROUS CONDITION, TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW.

I agree to follow all YoPro and venue safety rules, use bowling equipment only as intended, and avoid dangerous or reckless conduct. I will not intentionally enter the bowling lane, interfere with bowling machinery, or participate if I am too impaired or otherwise unable to do so safely.

If alcohol is available, I am solely responsible for my decision to consume it and for doing so responsibly. I agree not to operate a vehicle while impaired.

If I become injured or ill and cannot make decisions for myself, I authorize YoPro representatives to contact emergency medical services or obtain reasonable emergency assistance on my behalf. I accept responsibility for any resulting medical or transportation costs.

I am responsible for my personal belongings and release YoPro, to the fullest extent permitted by law, from claims involving lost, stolen, or damaged property.

I agree to indemnify and hold harmless the Released Parties from third-party claims, damages, liabilities, or reasonable costs arising from my negligent, reckless, intentional, or unlawful conduct, my violation of event or venue rules, or injury or property damage I cause to another person.

This agreement is governed by Texas law. To the extent permitted by law, any legal action arising from this agreement or the event shall be brought in a court of competent jurisdiction in Harris County, Texas. If any provision is found unenforceable, the remaining provisions will remain in effect.

BY REGISTERING FOR OR PARTICIPATING IN THIS EVENT, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THIS WAIVER AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING CERTAIN RIGHTS TO BRING CLAIMS AGAINST YOPRO SPORT SOCIALS AND THE OTHER RELEASED PARTIES FOR THEIR OWN ORDINARY NEGLIGENCE.
