TRACK LAB WAIVER & RELEASE OF LIABILITY

By registering for and/or participating in Bearly Runners LLC “Track Lab” sessions, including warm-ups, drills, workouts, cool-downs, and any related activities before/after the session (the “Event”), I acknowledge and agree to the following:

Assumption of Risk
I understand that participation in running and track workouts involves inherent risks, including but not limited to: slips, trips, falls, collisions with participants or bystanders, overexertion, dehydration, heat illness, cardiac events, muscle strains, sprains, tendon/ligament injuries, and other serious injury, illness, property damage, or death. I understand additional risks may include: running at higher speeds, crowded lanes, passing and merging, uneven track surfaces, wet conditions, low visibility, and hazards on or near the track (cones, hurdles, timing equipment, curbs, potholes, debris, or vehicles in adjacent areas). I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable.

Medical Clearance
I certify that I am physically and mentally capable of participating in the Event and have no medical conditions that would prevent my safe participation. I understand I am participating at my own risk and that I am responsible for monitoring my own health and physical condition during the Event. I will stop participating and seek help if I feel unwell or unsafe.

Release of Liability
In consideration of being permitted to participate in the Event, I hereby release, waive, discharge, and hold harmless Bearly Runners LLC and all related parties, including its members, managers, officers, directors, employees, contractors, volunteers, run leaders, representatives, ambassadors, affiliates, event partners and sponsors, photographers/videographers, platform providers (including SweatPals), and any track owners, venue operators, property managers, governmental entities, and any other parties connected to the Event (collectively, the “Released Parties”) from any and all claims, demands, damages, losses, liabilities, or causes of action of any kind arising out of or related to my participation in the Event, including those caused by negligence, to the fullest extent permitted by law.

Covenant Not to Sue
I agree that I will not sue or make a claim against any of the Released Parties for any injury, illness, death, property damage, or other loss arising out of or related to my participation in the Event, to the fullest extent permitted by law.

Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, actions, damages, losses, or costs (including reasonable attorneys’ fees) arising from my participation in the Event or my actions during the Event, including claims brought by third parties.

Emergency Medical Authorization
If I am injured or become ill during the Event, I authorize Bearly Runners LLC and event representatives to obtain or assist in obtaining medical care for me, including emergency transportation if deemed necessary. I understand I am responsible for all costs associated with such care and transportation. I release the Released Parties from liability for actions taken in good faith to provide or obtain medical assistance.

Rules & Conduct (Track Safety)
I agree to follow all Event rules, venue rules, and instructions given by Event staff, run leaders, and volunteers. I agree to:
- Run in the correct direction and follow lane guidance.
- Be alert and predictable when stopping, changing lanes, passing, or crossing lanes.
- Yield to faster runners when appropriate and communicate when passing.
- Keep the inside lanes clear when instructed and avoid standing in active lanes.
- Respect other track users and maintain an inclusive, safe environment.
I understand that failure to comply may result in removal from the Event without refund or liability.

Hydration & Heat Safety
I understand Miami and South Florida conditions can be hot and humid. I acknowledge that I am responsible for arriving hydrated and bringing water and any electrolytes needed. I understand the Event may be modified, shortened, delayed, or canceled due to heat, storms, lightning, or unsafe conditions, and I am responsible for my personal decision to participate.

Property & Personal Responsibility
I understand that I am responsible for my own personal belongings and that the Released Parties are not responsible for loss, theft, or damage to personal property.

Media Release
I grant permission to Bearly Runners LLC to use photographs, videos, or recordings of me taken during the Event for marketing, promotional, website, and social media purposes without compensation. I understand Bearly Runners LLC owns the Media and I waive any right to inspect or approve the final Media. I release the Released Parties from claims related to the use of the Media, to the fullest extent permitted by law.

Alcohol & Substances
I agree not to participate in the Event while impaired by alcohol, cannabis, illegal drugs, or any substance that may affect judgment, coordination, or safety. If I choose to participate while impaired, I assume all additional risks and accept full responsibility for my actions.

Minors
If the participant is under 18 years old, a parent or legal guardian must accept this waiver on the minor’s behalf and agrees to all terms, including the release and indemnification obligations, for themselves and the minor.

Severability
If any portion of this waiver is held invalid, the remaining portions shall continue in full force and effect.

Governing Law
This waiver shall be governed by and interpreted in accordance with the laws of the State of Florida.

Acknowledgment
I have read this waiver carefully, fully understand its terms, and voluntarily agree to be legally bound by it. I understand that by registering or participating, I am waiving certain legal rights. By checking “I have read and agree to the waiver” and entering my initials, I am providing my electronic signature.
