EVENT CONSENT AND GENERAL RELEASE OF LIABILITY

I, (Undersigned “Participant”), hereby give the following Consent and General Release to participate in this and any
future “Event” being held by TRACK MEET FESTIVAL EVENTS, LLC (“TRACK MEET”):

1. MEDICAL TREATMENT CONSENT: Participant authorizes TRACK MEET to provide Participant, through medical personnel of TRACK MEET’s choice, medical assistance, transportation, and emergency medical services. This Consent and General Release of Liability does not impose a duty upon TRACK MEET to provide such assistance, transportation, or services. UNDERSIGNED PARTICIPANT WILL BE LIABLE AND AGREES TO PAY ALL COSTS AND EXPENSES INCURRED in connection with such medical assistance, transportation, and emergency medical services rendered to Participant pursuant to this Consent and General Release of Liability.

2. ASSUMPTION OF RISK: Participant is fully aware that there are inherent risks involved with this and any future Event, including but not limited to possible physical injury and loss of life and Participant chooses voluntarily to consent to participate in this or any future Event with full knowledge that participation may be hazardous to Participant and Participant’s property. Participant VOLUNTARILY ASSUMES FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, which may be sustained by Participant in connection with participation in this or
any future Event.

3. GENERAL RELEASE AND WAIVER: In consideration for TRACK MEET’s administration of an Event, Participant HEREBY RELEASES, WAIVES, AND DISCHARGES, TRACK MEET FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS, CAUSES OF ACTION, OR SUITS IN EQUITY OF WHATEVER KIND OR NATURE; WHETHER CAUSED IN WHOLE OR IN PART BY TRACK MEET’S NEGLIGENCE OR OTHERWISE, while participating in an Event, or in any way connected with an Event.

4. INDEMNIFICATION: Participant WILL INDEMNIFY AND HOLD HARMLESS TRACK MEET FOR ANY LOSS, LIABILITY,
JUDGMENT, SETTLEMENT, DAMAGE OR COSTS, INCLUDING COURT COSTS AND ATTORNEY’S FEES FOR BOTH THE TRIAL AND APPELLATE LEVELS, THAT MAY OCCUR AS A RESULT OF OR IN ANY WAY CONNECTED WITH PARTICIPANT’S PARTICIPATION IN AN EVENT AS THE RESULT OF THE NEGLIGENT, WILLFUL, OR INTENTIONAL ACTS OF PARTICIPANT, including expenses incurred attendant thereto.

5. CHOICE OF LAW AND VENUE: Only the laws of the State of Florida govern this Consent and General Release of Liability. If either Participant or TRACK MEET wishes to bring an action regarding this Consent and General Release of Liability, they will bring the action only in Miami-Dade County in the appropriate court.

6. SEVERABILITY: If any term or provision of this Consent and General Release of Liability or the application thereof to any person or circumstances will to any extent or for any reason be invalid or unenforceable, the remainder of this instrument and the application of such term or provision to persons or circumstances other than those as to which it is held invalid or unenforceable will not be affected thereby, and each term and provision of the instrument will be valid and enforceable to the fullest extent permitted by law.

7. Participant hereby represents that Participant HAS READ THIS CONSENT AND GENERAL RELEASE OF LIABILITY IN ITS ENTIRETY AND UNDERSTANDS ALL OF THE TERMS AND CONDITIONS IT CONTAINS AND UNDERSTANDS THAT PARTICIPANT IS GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGNS IT VOLUNTARILY. This Consent and General Release of Liability sets forth all understandings and is the entire agreement between Participant and TRACK MEET
regarding this or any future Event.
