### &#xA;**What it is**

Three days of intentional training, recovery, and community down the shore. Expect sunrise runs, HYROX-style strength blocks, yoga/mobility, mindset workshops, and guided recovery (sauna/cold).


The weekend is anchored by the **VTLZR Games,** a team-based hybrid competition on the beach designed to challenge you physically, bring the community together, and create an unforgettable, high-energy experience.

VTLZR HYBRID ATHLETE RETREAT — PARTICIPANT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY & ARBITRATION AGREEMENT (E-SIGN)

Event: VTLZR Hybrid Athlete Retreat — June 12–14, 2026
Location: Long Beach, NY (including the Allegria Hotel, beach, boardwalk, ocean, and surrounding public or private venues)
Organizer: VTLZR, its owners, officers, directors, employees, contractors, coaches, volunteers, and representatives (“Organizer”)
Released Parties: Organizer; Allegria Hotel & Spa and its owners, officers, directors, employees, agents, and affiliates; City of Long Beach, NY, its officials, officers, employees, agents, departments, volunteers, and representatives; event sponsors; vendors; independent contractors; guest speakers; photographers/videographers; and all other associated parties (collectively, “Released Parties”).

By checking the consent box and submitting electronically, I acknowledge that I have read, understood, and agree to this Waiver and Release.

1. ASSUMPTION OF RISK

I understand that participation in the Event involves strenuous physical activity and inherent risks, including but not limited to:

Running, sprinting, lifting, strength training, conditioning circuits

Kettlebell, dumbbell, sled, and bodyweight exercises

Yoga, mobility, stretching

Recovery modalities including sauna, cold plunge, ice bath

Beach, boardwalk, and ocean proximity

Optional ocean exposure or waterfront activity

Uneven terrain, sand, boardwalk surfaces

Weather conditions (heat, cold, wind, storms)

Dehydration, overexertion, muscle strain, sprains, fractures

Equipment malfunction or participant collision

Marine hazards (currents, waves, submerged objects, marine life)

Travel to and from venues

I voluntarily choose to participate and knowingly and freely assume all risks, whether known or unknown, foreseeable or unforeseeable.

2. OCEAN & WATERFRONT ACKNOWLEDGMENT

I understand that ocean and waterfront areas are inherently dangerous environments.

I acknowledge that:

Lifeguards may not be present at all times.

The Organizer and Released Parties do not supervise individual swimming.

I am solely responsible for assessing my ability to safely enter or approach the ocean.

I assume full responsibility for any risk associated with ocean exposure.

I agree that participation near or in the ocean is entirely voluntary and at my own risk.

3. MEDICAL FITNESS

I certify that I am physically and medically fit to participate.
I have no condition that would endanger myself or others.

I agree to:

Stop immediately if I feel unwell.

Inform staff of any unsafe condition.

Accept first aid if provided.

I consent to emergency medical treatment if deemed necessary and agree to be financially responsible for all related costs.

4. PARTICIPANT CONDUCT

I agree to:

Follow all Event rules and staff instructions

Comply with City of Long Beach regulations and permit requirements

Respect hotel policies and quiet hours

Use equipment properly

Avoid alcohol or drugs before/during training

Maintain hydration and appropriate attire

Organizer may remove me from participation for safety reasons without refund.

5. RELEASE OF LIABILITY & COVENANT NOT TO SUE

To the maximum extent permitted by law, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the Released Parties from any and all claims arising out of:

Personal injury

Illness

Death

Property damage

This release applies EVEN IF caused in whole or in part by the NEGLIGENCE of any Released Party.

This release does NOT apply to gross negligence or willful misconduct where prohibited by law.

6. INDEMNIFICATION & HOLD HARMLESS

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, liabilities, damages, costs, and attorney’s fees arising out of:

My acts or omissions

My breach of this agreement

Claims brought by third parties related to my conduct

7. COMMUNICABLE DISEASE ACKNOWLEDGMENT

I understand that participation may involve exposure to communicable illnesses.
I assume all related risks and agree not to attend if knowingly ill.

8. PERSONAL PROPERTY

I am solely responsible for my belongings.
Released Parties are not liable for lost, stolen, or damaged items.

9. MEDIA RELEASE

I grant Organizer and Released Parties a perpetual, worldwide, royalty-free license to use my name, likeness, image, voice, and statements captured at the Event in any media format for promotional, commercial, or marketing purposes without compensation.

If I wish to limit identifiable close-up usage, I will notify staff at check-in. Public capture cannot be fully prevented.

10. PAYMENT, REFUNDS & EVENT MODIFICATIONS

Event fees are generally non-refundable unless required by law or explicitly stated otherwise.

Organizer may:

Modify schedule

Move sessions indoors

Relocate activities

Cancel sessions due to weather, safety, or permit requirements

I accept such changes without claim.

11. FORCE MAJEURE

Organizer shall not be liable for cancellation or modification due to events beyond its control including weather, governmental action, natural disasters, or emergencies.

12. ARBITRATION & GOVERNING LAW

This Agreement shall be governed by the laws of the State of New York.

Any dispute arising from participation shall be resolved through binding arbitration administered by the American Arbitration Association in New York County, NY.

I waive the right to participate in any class or collective action.

13. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in full force.

14. ELECTRONIC SIGNATURE

By checking the consent box and submitting electronically, I acknowledge:
