D’Wellness Club Event Waiver and Release of Liability

By registering for and attending any D’Wellness Club event, activity, class, gathering, experience, or program, I acknowledge and agree to the following:

## 1. Health & Participation Confirmation

I confirm that I am physically and mentally capable of safely participating in D’Wellness Club activities and experiences, including but not limited to walking, running, fitness classes, strength training, sports, yoga, pilates, mindfulness sessions, wellness experiences, outdoor activities, recreational activities, educational talks, social events, recovery activities, and other event-related programming.

I affirm that I do not have any physical, medical, emotional, or mental condition that would make participation unsafe or inadvisable. I understand that it is my sole responsibility to consult with a physician or healthcare provider before participating if I have any concerns regarding my health, fitness, or ability to safely engage in activities.

I understand that D’Wellness Club does not provide medical advice or medical supervision.

## 2. Assumption of Risk

I understand and acknowledge that participation in D’Wellness Club activities involves inherent and potentially significant risks, including risks associated with physical exertion, exercise, athletic participation, recreational sports, outdoor environments, transportation to and from venues, public spaces, fitness facilities, wellness services, food and beverage consumption, and interactions with third-party vendors, instructors, or participants.

These risks include, but are not limited to:

* physical injury
* illness or sickness
* muscle strains, sprains, soreness, or overexertion
* slips, falls, collisions, or accidents
* emotional distress
* allergic reactions or food-related illness
* dehydration, heat exhaustion, or environmental hazards
* disability, paralysis, permanent injury, or death

I understand that these risks may arise from my own actions or inactions, the actions or inactions of others, event conditions, public or private venues, outdoor conditions, equipment, transportation, food or beverages, third-party providers, or the ordinary negligence of D’Wellness Club, its founders, organizers, instructors, collaborators, volunteers, sponsors, venues, vendors, representatives, or partners.

I knowingly, voluntarily, and freely assume all such risks, both known and unknown, foreseeable and unforeseeable, and accept full responsibility for any resulting injury, illness, damage, loss, disability, or death.

## 3. Release of Liability

In consideration for being permitted to participate in D’Wellness Club activities and events, I, on behalf of myself, my heirs, executors, administrators, assigns, next of kin, and personal representatives, irrevocably release, waive, discharge, and hold harmless D’Wellness Club, its founder(s), organizers, team members, instructors, volunteers, contractors, collaborators, sponsors, venues, vendors, representatives, event partners, and affiliates from any and all liability, claims, demands, actions, damages, losses, expenses, costs, or causes of action arising from or related to any injury, illness, property damage, emotional distress, disability, paralysis, or death resulting from my participation in any D’Wellness Club activity or event, whether caused by ordinary negligence or otherwise, to the fullest extent permitted under Florida law.

I understand and agree that D’Wellness Club shall not be liable for any personal injury, medical condition, illness, emotional distress, property damage, or death occurring before, during, or after participation in any event or activity.

## 4. Indemnification

I agree to indemnify, defend, and hold harmless D’Wellness Club, its founders, organizers, instructors, collaborators, volunteers, representatives, vendors, sponsors, venues, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or legal fees arising out of or related to my participation in any D’Wellness Club event, including claims arising from my own actions, negligence, misconduct, or violations of applicable laws or event policies.

## 5. Third-Party Providers, Instructors & Venues

I understand that D’Wellness Club may partner with independent instructors, wellness providers, fitness coaches, nutrition professionals, sports instructors, meditation facilitators, restaurants, vendors, fitness studios, outdoor venues, and other third parties during events.

I acknowledge that these individuals and entities operate independently and that D’Wellness Club is not responsible for their conduct, recommendations, advice, products, facilities, food, beverages, services, or operations.

Participation in any activity, instruction, or service provided by a third party is voluntary and undertaken at my own risk.

## 6. Food, Beverage, Product & Allergy Disclaimer

I understand that D’Wellness Club events may include food, beverages, supplements, samples, beauty products, skincare, snacks, wellness items, goodie bags, promotional products, or sponsored items provided by third parties.

I acknowledge that I am solely responsible for evaluating ingredients, allergens, dietary restrictions, sensitivities, product suitability, and safety prior to consuming or using any product.

D’Wellness Club makes no guarantees regarding allergens, ingredients, nutritional information, product suitability, medical safety, or outcomes and assumes no responsibility for any reaction, illness, injury, or damages resulting from consumption or use.

## 7. Medical Consent

In the event of illness, injury, accident, or medical emergency, I authorize D’Wellness Club and its representatives to obtain emergency medical treatment on my behalf if deemed reasonably necessary.

I understand and agree that I am solely responsible for any and all medical expenses incurred and release D’Wellness Club from any liability associated with emergency medical care decisions.

## 8. Photo, Video & Media Release

I grant D’Wellness Club and its representatives full permission to photograph, film, record, reproduce, edit, publish, distribute, display, and otherwise use my image, likeness, voice, name, appearance, and participation in photographs, videos, digital media, social media, advertising, marketing materials, promotional campaigns, editorial content, and business purposes, in perpetuity and without compensation or approval rights.

I waive any right to inspect or approve the final content or receive compensation for such use.

## 9. Personal Property

I understand that D’Wellness Club is not responsible for personal belongings that are lost, stolen, misplaced, or damaged during or in connection with any event or activity.

## 10. Governing Law & Venue

This agreement shall be governed by and interpreted under the laws of the State of Florida.

Any dispute arising out of or relating to this waiver, participation in D’Wellness Club activities, or related matters shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

## 11. Acknowledgment of Understanding

I certify that I have carefully read and fully understand this Waiver and Release of Liability.

I understand that by agreeing to this document I am waiving substantial legal rights, including the right to sue for injury, illness, disability, emotional distress, property damage, or death.

I acknowledge that I am entering into this agreement freely, voluntarily, knowingly, and with the intention of being legally bound to the fullest extent permitted by law.
