WATERWAY FIELD DAY IS HERE!!



Saturday, August 29th, we’re bringing back the classic field day, Waterway style.



We’re kicking things off at 12 PM with an afternoon of games and a little friendly competition. Expect volleyball, capture the flag, egg toss, kickball, potato sack races, and more!



We’ll also have food, drinks, and vendors on-site, so you can grab something to eat, hang out, and enjoy the afternoon between games.



We’ll be putting everyone into teams, so come ready to compete. Bring your friends and come ready to play.

# WATERWAY WELLNESS

## PARTICIPATION AGREEMENT, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION & MEDIA RELEASE

**Effective Date: February 13, 2026**

This Participation Agreement and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration for being permitted to participate in any run, walk, jog, workout, training session, meetup, social event, volunteer activity, or related activity organized, hosted, or coordinated by Waterway Wellness (“Organizer”).

### 1. SCOPE OF ACTIVITIES

This Agreement applies to all activities organized by Organizer, including but not limited to:

* Group runs and fitness activities
* Informal social meetups tied to fitness
* Events conducted on public roads, sidewalks, parks, trails, beaches, bridges, parking lots, and other public or private property
* Future events, recurring events, and pop-up events
* Activities conducted anywhere within the State of Florida

This Agreement applies regardless of whether participation is free, donation-based, sponsored, or paid.

### 2. ACKNOWLEDGMENT AND ASSUMPTION OF INHERENT RISKS

Participant understands that running and fitness activities involve inherent, open, obvious, and unavoidable risks, including but not limited to:

* Uneven surfaces, potholes, curbs, cracks, debris
* Motor vehicle traffic and roadway crossings
* Bicycle and pedestrian traffic
* Poor lighting conditions
* Construction zones
* Weather conditions including heat, humidity, lightning, rain, flooding
* Slips, trips, and falls
* Collisions with other participants or third parties
* Wildlife or domestic animal encounters
* Dehydration, heat exhaustion, cardiac events
* Undiagnosed medical conditions
* Negligent acts of other participants
* Equipment failure
* Acts of God

Participant understands that injuries may include sprains, fractures, traumatic brain injury, paralysis, permanent disability, or death.

Participant voluntarily and knowingly assumes all risks, whether known or unknown, foreseeable or unforeseeable, inherent or arising from ordinary negligence.

### 3. FIELD DAY AND SPECIAL EVENT RISKS

Participant understands that Waterway Wellness may organize outdoor field days, recreational competitions, games, and social events involving physical activity and interaction with other participants.

Field Day activities may include, but are not limited to:

* Volleyball
* Capture the flag
* Kickball
* Egg toss
* Potato sack races
* Relay races
* Team-based games
* Running, jumping, throwing, catching, climbing, or other recreational activities
* Use of recreational equipment, balls, nets, cones, sacks, and other event equipment
* Other games or activities added, modified, or substituted by Organizer

Participant acknowledges and voluntarily assumes the risks associated with these activities, including but not limited to:

* Running into, falling into, or colliding with another participant
* Being struck by a ball, equipment, or other object
* Falls while running, jumping, turning, stopping, or changing direction
* Slips, trips, and falls on grass, dirt, pavement, turf, or other surfaces
* Injuries resulting from uneven, wet, slippery, or otherwise hazardous surfaces
* Sprains, strains, bruises, cuts, abrasions, fractures, dislocations, or other injuries
* Overexertion, dehydration, heat exhaustion, heat stroke, or other heat-related illness
* Injuries resulting from participation in competitive or team-based activities
* Injuries resulting from the actions, negligence, recklessness, or conduct of other participants
* Equipment malfunction, failure, improper use, or unexpected movement
* Allergic reactions or other adverse reactions to food, beverages, plants, insects, or environmental conditions
* Weather-related hazards, including excessive heat, humidity, rain, lightning, wind, storms, flooding, or rapidly changing weather conditions
* Any other risks associated with outdoor recreational activities or social events

Participant understands that participation in any particular game or activity is voluntary and that Participant may decline to participate in any activity they believe is unsafe or beyond their physical abilities.

Organizer may modify, postpone, suspend, or cancel any activity or event due to weather, safety concerns, venue restrictions, equipment issues, or other circumstances.

### 4. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

TO THE FULLEST EXTENT PERMITTED UNDER FLORIDA LAW, PARTICIPANT HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE:

Waterway Wellness, its owners, members, managers, volunteers, organizers, employees, independent contractors, sponsors, affiliates, partners, host venues, and representatives (collectively “Released Parties”)

for any and all claims, demands, damages, causes of action, losses, or liabilities arising out of or related to participation in any activity.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS BASED ON THE ALLEGED NEGLIGENCE OF THE RELEASED PARTIES.

This release does not apply to claims arising from gross negligence or intentional misconduct to the extent such claims cannot be waived under Florida law.

### 5. PUBLIC ROADWAY AND TRAFFIC ACKNOWLEDGMENT

Participant acknowledges that activities may occur on public roads and sidewalks not closed to traffic.

Participant agrees:

* Organizer does not provide traffic control.
* Organizer does not guarantee participant safety.
* Participant is solely responsible for obeying traffic laws.
* Participant assumes full responsibility for their own safety at all times.

### 6. FITNESS TO PARTICIPATE

Participant represents that:

* They are physically capable of participating.
* They have not been advised by a medical professional to avoid strenuous activity.
* They are solely responsible for monitoring their physical condition.
* They will stop participating if they feel unsafe or unwell.

### 7. COMMUNICABLE DISEASE ACKNOWLEDGMENT

Participant understands that participation in group activities may increase exposure to communicable diseases, including but not limited to COVID-19, influenza, or other viral or bacterial infections.

Participant voluntarily assumes all risks related to such exposure.

### 8. MEDICAL TREATMENT AUTHORIZATION

Participant authorizes Organizer to obtain emergency medical care if deemed necessary.

Participant agrees to be financially responsible for all medical expenses incurred.

Organizer has no duty to provide medical assistance.

### 9. NO INSURANCE PROVIDED

Participant understands Organizer does not provide medical, health, disability, or accident insurance coverage for participants.

### 10. INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, or attorney’s fees arising from:

* Participant’s conduct
* Participant’s violation of traffic laws
* Participant’s negligent or reckless behavior
* Claims brought by third parties arising from Participant’s actions

### 11. INDEPENDENT PARTICIPATION

Participant understands:

* Organizer is not a coach, trainer, or medical provider.
* Participation is voluntary.
* No employment, partnership, or joint venture relationship is created.

### 12. FOOD, BEVERAGES, AND VENDORS

Participant understands that Organizer may provide, sell, or facilitate access to food and beverages at events and may invite independent vendors, sponsors, food providers, beverage providers, or other third parties to participate.

Participant acknowledges that:

* Food and beverages may contain ingredients or allergens to which Participant may be sensitive or allergic.
* Organizer does not guarantee that food or beverages provided by third-party vendors are free from allergens or contamination.
* Participant is responsible for informing appropriate food vendors of any allergies, dietary restrictions, or other food-related concerns before consuming any food or beverage.
* Participant voluntarily assumes the risks associated with consuming food and beverages at the event.
* Third-party vendors are independent entities and are not employees or agents of Organizer unless expressly stated otherwise.
* Organizer is not responsible for the acts, omissions, products, services, or conduct of independent third-party vendors to the fullest extent permitted by law.

Participant should not consume any food or beverage if they are uncertain about its ingredients or safety.

### 13. ALCOHOL AND IMPAIRMENT

If alcoholic beverages are present or made available at an event, Participant acknowledges that consumption of alcohol is voluntary and may create additional risks.

Participant agrees to act responsibly and understands that they should not participate in physical activities while impaired by alcohol, drugs, or any other substance that may affect judgment, coordination, balance, or physical ability.

Organizer reserves the right to refuse participation in activities or remove a Participant from an event if Organizer reasonably believes the Participant is intoxicated, impaired, acting dangerously, or creating a risk to themselves or others.

### 14. PARTICIPANT CONDUCT AND TEAM ACTIVITIES

Participant agrees to conduct themselves in a respectful and sportsmanlike manner during all activities.

Participant agrees not to:

* Intentionally injure or physically endanger another participant
* Engage in fighting or physical altercations
* Intentionally misuse event equipment
* Participate in activities while knowingly impaired
* Engage in reckless behavior that creates an unreasonable risk of injury
* Ignore reasonable safety instructions given by Organizer, venue personnel, or event staff

Participant understands that field day activities may involve friendly competition and physical contact. Organizer does not guarantee equal skill levels, athletic abilities, or physical conduct among participants.

Organizer reserves the right to remove a Participant from an activity or event for unsafe, disruptive, aggressive, or inappropriate conduct.

### 15. EQUIPMENT AND PERSONAL PROPERTY

Participant understands that Organizer may provide or facilitate the use of recreational equipment.

Participant agrees to use all equipment responsibly and in accordance with reasonable instructions.

Participant acknowledges that equipment may malfunction, move unexpectedly, break, or otherwise contribute to injury.

Participant is solely responsible for their personal belongings brought to or left at an event, including but not limited to phones, wallets, bags, clothing, jewelry, cameras, and other valuables.

Organizer is not responsible for lost, stolen, damaged, or misplaced personal property.

### 16. WEATHER AND EVENT CONDITIONS

Participant acknowledges that outdoor events may be conducted in conditions involving heat, humidity, sun exposure, rain, wind, insects, wet or muddy surfaces, and other environmental conditions.

Participant is responsible for taking reasonable precautions, including maintaining hydration, seeking shade or shelter when necessary, using sunscreen, and stopping participation if they experience symptoms of heat-related illness or otherwise feel unwell.

Organizer may alter, postpone, suspend, relocate, or cancel an event or activity when Organizer determines that weather or environmental conditions create safety concerns.

### 17. MEDIA RELEASE

Participant grants Organizer an irrevocable, perpetual, royalty-free right to photograph, record, and use Participant’s image, likeness, voice, and name for promotional, marketing, advertising, and social media purposes without compensation.

Participant waives any right to inspect or approve such materials.

### 18. CLASS ACTION WAIVER

Participant agrees that any claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class action proceeding.

### 19. GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Any legal action shall be brought exclusively in a court of competent jurisdiction located in Broward County, Florida.

Participant consents to personal jurisdiction in Broward County.

### 20. SEVERABILITY

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

### 21. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or understandings.

### 22. ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges that:

* They have read this Agreement carefully.
* They understand they are waiving substantial legal rights.
* They understand this is a release of liability.
* They sign voluntarily and without coercion.
