This Sunday, Waterway Wellness, Soflo Social, and Island Water Sports for the ultimate beach morning! Whether you’re a seasoned surfer or have never touched a board before, this is the perfect chance to get out in the sun, meet new people, and enjoy an unforgettable day by the ocean.

Our instructors, Cole, Marco, and Mateo, will be leading the session and helping everyone catch some waves!



Not into surfing? No problem! Come hang out, enjoy the beach day, explore the farmers market, listen to the DJ, and connect with an awesome community. (This is a free event only cost $5 if you want to surf)

PARTICIPATION AGREEMENT, RELEASE OF LIABILITY,
ASSUMPTION OF RISK, INDEMNIFICATION & MEDIA RELEASE

Effective Date: February 13, 2026

This Participation Agreement and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration for being permitted to participate in any run, walk, jog, workout, training session, meetup, social event, volunteer activity, surfing activity, beach activity, water activity, wellness event, or related activity organized, hosted, coordinated, sponsored, or promoted by Waterway Wellness (“Organizer”).

1. SCOPE OF ACTIVITIES

This Agreement applies to all activities organized by Organizer, including but not limited to:

Group runs, walks, workouts, fitness activities, and wellness events

Surfing, paddleboarding, ocean activities, swimming, beach workouts, yoga, mobility sessions, and water-based recreation

Informal social meetups tied to fitness, wellness, recreation, or community engagement

Events conducted on public roads, sidewalks, parks, trails, beaches, oceans, waterways, bridges, docks, marinas, parking lots, private property, and other public or private locations

Future events, recurring events, pop-up events, sponsored events, and volunteer activities

Activities conducted anywhere within the State of Florida or elsewhere

This Agreement applies regardless of whether participation is free, donation-based, sponsored, invitation-only, or paid.

2. ACKNOWLEDGMENT AND ASSUMPTION OF INHERENT RISKS

Participant understands that participation in fitness, recreational, beach, ocean, water, and surfing activities involves significant risks, including risks that may result in serious bodily injury, permanent disability, property damage, paralysis, or death.

Participant voluntarily assumes all risks associated with participation, including but not limited to:

GENERAL RISKS

Uneven surfaces, potholes, curbs, cracks, debris

Motor vehicle traffic and roadway crossings

Bicycle and pedestrian traffic

Poor lighting conditions

Construction zones

Weather conditions including heat, humidity, lightning, rain, flooding, hurricanes, tropical storms, high winds, and extreme temperatures

Slips, trips, and falls

Collisions with participants, spectators, vehicles, or third parties

Wildlife, insects, marine life, and domestic animal encounters

Dehydration, heat exhaustion, heat stroke, cardiac events, allergic reactions, seizures, fainting, and other medical emergencies

Undiagnosed or pre-existing medical conditions

Equipment malfunction or failure

Negligent acts of other participants

Acts of God and natural disasters

SURFING, BEACH, AND OCEAN RISKS

Drowning, near-drowning, submersion, or water inhalation

Strong currents, rip currents, undertows, shore breaks, and changing ocean conditions

Large waves, breaking waves, rogue waves, and wave impacts

Ocean floor hazards including reefs, rocks, coral, shells, sandbars, holes, drop-offs, and submerged objects

Collisions with surfboards, fins, leashes, paddleboards, swimmers, surfers, boats, jet skis, kayaks, or other watercraft

Being struck by one's own board or another participant's board

Cuts, lacerations, puncture wounds, abrasions, fractures, concussions, traumatic brain injuries, spinal injuries, paralysis, permanent disability, or death

Equipment damage, loss, misuse, or failure

Surfboard, paddleboard, leash, fin, flotation device, wetsuit, or safety equipment malfunction

Hazardous marine conditions including changing tides, rough surf, poor visibility, fog, storms, and sudden weather changes

Marine wildlife encounters including sharks, stingrays, jellyfish, fish, sea urchins, crabs, and other marine animals

Sunburn, heat illness, dehydration, exhaustion, hypothermia, and exposure-related injuries

Participant understands that injuries may include sprains, fractures, traumatic brain injury, spinal cord injury, paralysis, permanent disability, severe injury, or death.

Participant voluntarily and knowingly assumes all risks, whether known or unknown, foreseeable or unforeseeable, inherent or arising from ordinary negligence.

3. RELEASE OF LIABILITY (INCLUDING NEGLIGENCE)

TO THE FULLEST EXTENT PERMITTED UNDER FLORIDA LAW, PARTICIPANT HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE:

Waterway Wellness, its owners, members, managers, officers, directors, volunteers, organizers, employees, independent contractors, instructors, sponsors, vendors, affiliates, partners, host venues, property owners, municipalities, and representatives (collectively “Released Parties”)

for any and all claims, demands, damages, causes of action, losses, liabilities, costs, or expenses arising out of or related to participation in any activity.

THIS RELEASE EXPRESSLY INCLUDES CLAIMS BASED ON THE ALLEGED NEGLIGENCE OF THE RELEASED PARTIES.

This release does not apply to claims arising from gross negligence or intentional misconduct to the extent such claims cannot legally be waived under Florida law.

4. PUBLIC ROADWAY, BEACH, AND WATERWAY ACKNOWLEDGMENT

Participant acknowledges that activities may occur on public roads, sidewalks, beaches, waterways, oceans, and other locations not controlled by Organizer.

Participant agrees:

Organizer does not provide traffic control, lifeguards, rescue personnel, or water safety guarantees.

Organizer does not guarantee participant safety.

Participant is solely responsible for obeying all applicable laws, regulations, beach rules, and water safety requirements.

Participant assumes full responsibility for their own safety at all times.

5. FITNESS TO PARTICIPATE

Participant represents that:

They are physically capable of participating.

They have not been advised by a medical professional to avoid strenuous activity.

They possess adequate swimming ability and water competency for any water-related activities in which they choose to participate.

They are solely responsible for monitoring their physical condition.

They will stop participating if they feel unsafe, unwell, fatigued, or unable to safely continue.

6. COMMUNICABLE DISEASE ACKNOWLEDGMENT

Participant understands that participation in group activities may increase exposure to communicable diseases, including but not limited to COVID-19, influenza, bacterial infections, viral infections, or other illnesses.

Participant voluntarily assumes all risks related to such exposure.

7. MEDICAL TREATMENT AUTHORIZATION

Participant authorizes Organizer to obtain emergency medical care if deemed necessary.

Participant agrees to be financially responsible for all medical expenses incurred.

Organizer has no duty to provide medical assistance, rescue services, lifeguards, emergency transportation, or medical personnel.

8. NO INSURANCE PROVIDED

Participant understands Organizer does not provide medical, health, disability, life, accident, property, or liability insurance coverage for participants.

9. INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, expenses, judgments, settlements, or attorney's fees arising from:

Participant's conduct

Participant's violation of laws or regulations

Participant's negligent, reckless, or intentional behavior

Claims brought by third parties arising from Participant's actions

Damage caused by Participant to persons, property, equipment, surfboards, vehicles, facilities, or other assets

10. SURFBOARD, EQUIPMENT, AND PROPERTY RESPONSIBILITY

Participant acknowledges that any surfboard, paddleboard, leash, wetsuit, rash guard, flotation device, or other equipment used during participation may be owned by Participant, another participant, a third party, sponsor, vendor, instructor, volunteer, or Organizer.

Participant assumes full responsibility for the use, care, and condition of any equipment utilized during participation.

Participant agrees to be financially responsible for any loss, theft, destruction, or damage caused to equipment resulting from Participant's misuse, negligence, recklessness, or intentional conduct.

Participant releases the Released Parties from any claims arising from damaged, lost, stolen, defective, or malfunctioning equipment.

Participant understands that Organizer makes no warranties regarding the safety, suitability, condition, or fitness of any equipment used during participation.

11. SURF INSTRUCTION AND SKILL ACKNOWLEDGMENT

Participant understands that any tips, demonstrations, coaching, instruction, guidance, recommendations, or assistance provided by Organizer, volunteers, instructors, sponsors, or other participants are offered solely as general information.

Participant remains solely responsible for determining whether conditions are safe and whether they possess the skill and ability necessary to participate.

Participant acknowledges that surfing and ocean activities involve inherent dangers regardless of any instruction received.

12. ALCOHOL, DRUGS, AND IMPAIRMENT

Participant agrees not to participate while under the influence of alcohol, illegal drugs, controlled substances, or any medication that may impair judgment, balance, coordination, reaction time, or physical ability.

Participant assumes full responsibility for any consequences arising from participation while impaired.

13. PERSONAL PROPERTY

Participant understands that Organizer is not responsible for lost, stolen, damaged, or destroyed personal property, including vehicles, surfboards, equipment, electronics, wallets, jewelry, clothing, or other belongings.

14. INDEPENDENT PARTICIPATION

Participant understands:

Organizer is not a medical provider.

Organizer is not guaranteeing participant safety.

Participation is voluntary.

No employment, partnership, agency, or joint venture relationship is created.

15. MEDIA RELEASE

Participant grants Organizer an irrevocable, perpetual, worldwide, royalty-free right to photograph, record, film, livestream, and use Participant's image, likeness, voice, name, and appearance for promotional, marketing, advertising, social media, website, educational, and commercial purposes without compensation.

Participant waives any right to inspect or approve such materials.

16. CLASS ACTION WAIVER

Participant agrees that any claims must be brought solely in an individual capacity and not as a plaintiff or class member in any purported class action, collective action, representative action, or mass action proceeding.

17. GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Any legal action shall be brought exclusively in a court of competent jurisdiction located in Broward County, Florida.

Participant consents to personal jurisdiction and venue in Broward County, Florida.

18. SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, understandings, representations, or agreements.

20. ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges that:

They have carefully read this Agreement.

They fully understand its contents.

They understand they are waiving substantial legal rights.

They understand this is a release of liability.

They voluntarily assume all risks associated with participation.

They sign voluntarily and without coercion.
