Organizer: Revival Wellness Experience LLC (“Organizer”)
Applies To: All dates/events in this pool party series that I attend during the applicable season, unless replaced by a newer version presented at registration.

IMPORTANT LEGAL NOTICE — READ CAREFULLY
By registering for or attending this event and by checking the box indicating “I agree,” I acknowledge that I have read, understood, and voluntarily agree to this legally binding Waiver, Release of Claims, Assumption of Risk, and Indemnification Agreement (“Agreement”).
This Agreement includes a release of liability, a covenant not to sue, and an indemnification obligation.

1. ELIGIBILITY (18+) AND CAPACITY
This event is 18 years of age or older. By accepting this Agreement, I represent and warrant that I am at least 18 years old and legally competent to enter into this Agreement.

2. EVENT RULES — NO ALCOHOL OR SUBSTANCES
I acknowledge and agree that alcohol, illegal drugs, and recreational substances are strictly prohibited at this event. I agree not to possess, use, or distribute prohibited substances at the event.
The Organizer may, in its sole discretion, deny entry and/or remove any person for suspected impairment or any violation of event rules, with or without refund.

3. ASSUMPTION OF RISK — GENERAL AND FITNESS/WELLNESS ACTIVITIES
I understand that attending and participating in this event involves inherent and foreseeable risks, including serious injury and death. This event includes pool-based activities as well as structured fitness and wellness programming, including but not limited to:
•	Outdoor group runs and aerobic exercise
•	HIIT (High-Intensity Interval Training) workouts
•	Pilates sessions
•	Dance classes
•	Acro yoga (partner-based acrobatic yoga)
•	Breathwork and guided breathing exercises
•	Any other movement, fitness, or wellness activations offered at the event
These risks may arise from my own actions, the actions of others, Venue conditions, weather, physical exertion, pre-existing health conditions, and other causes beyond the Organizer’s control.
I voluntarily and expressly assume all risks, known and unknown, foreseeable and unforeseeable, including risks arising from the negligence of the Released Parties (defined below), except to the extent such release is prohibited by law.

4. WATER-RELATED RISKS (NO LIFEGUARD) — EXPRESS ACKNOWLEDGMENT
I understand and acknowledge that:
•	NO LIFEGUARDS ARE ON DUTY at this event.
•	The Organizer does not provide lifeguard services and does not supervise swimmers for safety.
•	Swimming and pool participation can result in drowning, near-drowning, water inhalation, panic, loss of consciousness, cardiac events, and death, even for strong swimmers.
I further agree that I am solely responsible for my own safety, including deciding whether to enter the pool.
Swimming ability / self-assessment
I represent that I am able to swim and safely enter and exit a swimming pool without assistance. I agree that I will not enter the pool if I am tired, distressed, dizzy, dehydrated, overheated, injured, or otherwise unable to do so safely. I understand that I may choose to remain out of the pool at any time for any reason.

5. SPECIFIC RISKS I UNDERSTAND AND ACCEPT
Without limiting the generality of the above, I understand and accept risks including but not limited to:
•	Slips, trips, and falls on wet, uneven, or slippery surfaces (pool deck, stairs, restrooms, walkways, turf, yoga studio floors)
•	Impact with pool edges, steps, ladders, drains, grates, furniture, fixtures, and submerged objects
•	Cuts, abrasions, sprains, strains, fractures, head/neck injuries
•	Musculoskeletal injury, joint strain, or overexertion resulting from fitness activities including running, HIIT, pilates, dance, or acro yoga
•	Injury resulting from partner-based activities (e.g., acro yoga), including falls, drops, or collisions with other participants
•	Dizziness, lightheadedness, hyperventilation, or loss of consciousness related to breathwork exercises
•	Cardiovascular events, heat exhaustion, or heat stroke resulting from physical exertion in warm or outdoor conditions
•	Crowd movement, pushing, collisions, horseplay by others
•	Heat exposure, sun exposure, dehydration, fainting
•	Loud music and sound exposure; lighting conditions; reduced visibility
•	Electrical or equipment hazards related to event production (DJ/AV), to the extent present in public event areas
•	Acts or omissions of other attendees and third parties (including Venue staff, security, DJs, vendors, instructors, contractors)
•	Illness exposure associated with being in public or shared physical contact settings
•	Property damage occurring in or around the pool and Venue areas

6. VOLUNTARY PARTICIPATION; NO DUTY TO SUPERVISE OR RESCUE
I understand that my attendance and participation in all event programming—including pool activities, fitness classes, and wellness activations—are entirely voluntary. I acknowledge the Organizer has no duty to provide supervision for swimming or physical exercise, or to prevent me from participating in any activity. The Organizer may, but is not obligated to, provide general safety guidance or call for emergency assistance.

7. MEDICAL ACKNOWLEDGMENT; PHYSICAL READINESS; EMERGENCY CARE
I understand that:
•	The Organizer does not provide medical services or professional medical personnel.
•	I am responsible for my own health, physical fitness, and safety, and for obtaining medical advice prior to participating in any fitness or wellness activity at the event.
•	I represent that I am in adequate physical condition to participate in the activities I choose to engage in, and that I am not aware of any medical condition that would make such participation inadvisable.
•	In an emergency, the Organizer may call 911 or seek assistance, but has no obligation to provide medical care.
I authorize the Organizer and/or Venue personnel to obtain emergency medical care for me if they choose to do so, and I agree to be financially responsible for all related costs.

I acknowledge that certain fitness classes at the event may be operated by third-party fitness partners, including Barry’s Bootcamp Holdings, LLC (“Barry’s”). I understand that Barry’s classes may involve strenuous physical activity, including treadmill running, interval training, resistance training, floor exercises, and use of fitness equipment. I voluntarily assume all risks arising from participation in any Barry’s-operated class or activity.

I represent that I am physically capable of participating in fitness activities offered at the event and that I have no medical condition, injury, impairment, or other health issue that would prevent my safe participation. I understand that participation is voluntary and that I should consult a physician before engaging in strenuous exercise activities.

8. RELEASE OF LIABILITY; COVENANT NOT TO SUE
To the fullest extent permitted by Arizona law, I hereby release, waive, discharge, and covenant not to sue:
Revival Wellness Experience LLC, and its owners, officers, directors, members, managers, employees, volunteers, contractors, representatives, agents, affiliates, successors, and assigns; and
XSC Phoenix Investments LLC, located at 13355 Noel Rd, Suite 1450, Dallas, TX 75240, as owner of the Venue, and its members, managers, affiliates, employees, contractors, agents, successors, and assigns; and
X Phoenix (The X Phoenix), the Venue, property operators, management, employees, contractors, security, and agents; and any event vendors, DJs, instructors, sponsors, and partners present at or associated with the event, including without limitation Barry’s Bootcamp Holdings, LLC and its affiliates, franchisees, instructors, employees, contractors, agents, representatives, successors, and assigns (collectively, the “Released Parties”)
from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether known or unknown, suspected or unsuspected, arising out of or related to my attendance, participation, or presence at the event or Venue, including but not limited to claims for personal injury (including injury arising from fitness classes, wellness activations, pool activities, or any other event programming), drowning/near-drowning, illness, death, property damage, theft, or economic loss, even if caused in whole or in part by the negligence of any of the Released Parties, except to the extent such release is prohibited by law.

9. INDEMNIFICATION AND HOLD HARMLESS
I agree to defend, indemnify, and hold harmless the Released Parties—expressly including XSC Phoenix Investments LLC (13355 Noel Rd, Suite 1450, Dallas, TX 75240) as a protected third-party beneficiary of this Agreement—from and against any claims, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
•	My acts or omissions at or related to the event, including my participation in any fitness, wellness, or pool activities
•	My violation of any law, rule, or instruction
•	Any injury or damage I cause to myself, other persons, or property
•	Any claim brought by a third party arising from my conduct
I acknowledge and agree that XSC Phoenix Investments LLC, as owner of the Venue, is an intended third-party beneficiary of this Agreement and may enforce this Agreement directly.

10. PERSONAL PROPERTY; LOSS, THEFT, AND DAMAGE
I understand and agree that I am solely responsible for my personal belongings. The Released Parties are not responsible for lost, stolen, or damaged property, including but not limited to phones, wallets, keys, jewelry, eyewear, clothing, footwear, cameras, or other equipment.

11. COMPLIANCE WITH RULES; REMOVAL
I agree to follow all posted rules, staff instructions, and Venue policies. The Organizer and/or Venue may refuse entry or remove any attendee for safety reasons or policy violations, in their sole discretion.

I agree to follow all instructions provided by fitness instructors, event staff, and venue personnel during any class or activation. I understand that failure to follow instructions or safety guidance may increase the risk of injury.

12. PHOTO, VIDEO, AND MEDIA RELEASE
I grant the Organizer (and its designees) the irrevocable right to photograph, film, record, and otherwise capture my name, likeness, image, voice, and appearance at the event, and to use such content for marketing, promotional, educational, or commercial purposes, in any media now known or later developed, worldwide, in perpetuity, without compensation.

13. FORCE MAJEURE; CHANGED CONDITIONS
I acknowledge that conditions may change without notice, including weather, heat, air quality, sound levels, lighting, crowd size, Venue layout, equipment status, and operational decisions. I accept all risks arising from such conditions and understand the Organizer may modify, pause, or cancel aspects of the event for safety or operational reasons.

14. SEVERABILITY
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. GOVERNING LAW; VENUE
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from this Agreement or the event shall be brought exclusively in Maricopa County, Arizona.

16. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between me and the Released Parties regarding the subject matter and supersedes any prior understandings, whether oral or written.

17. DIGITAL SIGNATURE; ACKNOWLEDGMENT
I understand and agree that my acceptance on SweatPals constitutes a legal signature and is enforceable as if signed by hand.
By checking “I agree,” I affirm that:
•	I have read this Agreement in full
•	I understand its terms and the risks involved (including no lifeguards on duty and the physical demands of fitness and wellness activities)
•	I am in adequate physical condition to participate in the activities I choose to engage in
•	I voluntarily accept and agree to be legally bound by it
